The Act on Employment Promotion and Vocational Rehabilitation for the Disabled Persons was established in 1990. Even though the Act was revised many times, there is no study systematically analyzing this important legal decree. Thus, the purpose of this study is to analyze the act in regards to the reasons for the revision, provisions etc in order to enhance understanding of the act for policy-makers, scholars, practitioners etc.This paper addresses the background and process of establishment, reasons for revision,revised articles and transition process of the Act on Employment Promotion and Vocational Rehabilitation for the Disabled Persons. In addition, we have included a statute book on the revision of provisions for easy access for our readers.In Korea, discussions on the employment of people with disabilities developed through the influence of the United Nations and International Labor Organization externally, and through the development of domestic politics internally. After the Seoul Paralympics in 1988, the Act on Employment Promotion and Vocational Rehabilitation for the Disabled Persons was proclaimed in 1990(No. 4,219) The established law recognized the disability standards stated in the Disability Welfare Law. Also, this Act included provisions regarding a 2% quota in the public sector and in the private sector(companies with 300 employees or more), recognition of exempt areas, subsidy for entities that employee more than the 2%quota, levies for those that employ less than 2%, establishment of the Korea Employment Promotion Agency for the disabled etc. The act was implemented in 1991 and was revised 19 times in the last 20 years. The Enforcement Ordinance was revised 25 times and the enforcement regulations were revised 9 times. Revisions include : introduction of a connected employment system(1995), amendment of the definition of disability(1999,2003,2005), change of the title of the act(2000, 2005), preference of the severely disabled(2000), increase of applicants to companies that employ more than 50employees and reduction of levies for companies that employ the severely disabled(2004),abolishment of the exemption policy(2006), introduction of the disability centered workshop as a subsidiary company and strengthening of the quota system to 3%(2007). Currently, a legislative bill to increase the quota system of the private sector, amendment of the subsidies etc is pending.
