Airline mileage is a frequent flyer program that an airline company compensates its customers for their accumulated mileage so as to honor the customers. The Seoul Southern District Court Decision 2010Gahab15876 delivered on January 21, 2011 is a very noteworthy judgment which is dealing with an issue over the inheritance of an airline mileage. This decision recognized an airline mileage as property rights and denied belonging exclusiveness of an airline mileage. But the court decision eventually denied unfairness of the standard contract terms which prohibit inheritance of an airline mileage.However, the standard contract terms which prohibit inheritance of an airline mileage should be deemed invalid as they are 'stipulations unfairly disadvantageous to customers' under Paragraph 2, Article 6 of Act on Regulation of the Standard Contract Terms. This study deliberated the conclusion of the judgment critically by looking into legal nature of an airline mileage as property rights, and unfairness of the standard contract terms which prohibit inheritance of an airline mileage.
