The Law Applicable to an Employment Contract under the Private International Law

This article deals with the rule of determination of the law applicable to a contract for the employment under the Private International Law of Korea based on the comparison study of the EEC Convention on the Law Applicable to Contractual Obligations (‘Rome Convention’), Regulation (EC) 593/2008 on the law applicable to contractual obligations (‘Rome I’), Japanese Private International Law and the Second Restatement of Law on Conflict of Laws(“Restatement”). Contracting Parties have freedom to choose the law applicable to their employment contract and there are some rules for the deter- mination of the law applicable to a contract of individual employment in the absence of choice under Rome Convention, Rome I Regulation, Japanse PIL, the Restatement of USA and the Korea PIL. In a contract of employment a choice of law made by the parties shall not have the result of depriving the employee of the protection afforded to him by the mandatory rules of the law which would be applicable in the absence of choice. And a contract of employment shall, in the absence of choice in accordance with the rule of choice, be governed: (a) by the law of the country in which the employee habitually carries out his work in performance of the contract, even if he is temporarily employed in another country ; or (b) if the employee does not habitually carry out his work in any one country, by the law of the country in which the place of business through which he was engaged is situated. Unless it appears from the circumstances as a whole that the contract is more (in Rome Convention, and Rome I) or most(in Korean PIL) closely connected with another country, in which case the contract shall be governed by the law of that country. There are some restrictions in determining of a law applicable for a contract of individual employment such as the mandatory rules and the rules based on the public policy of the forum. There are some issues in determining the law applicable to employment contracts such as the relationship between paragraph 4 of art. 18 and art. 28, and the relationship between art. 24 and art. 28, the determination of the law applicable to loan out work and carriage workers in Korean PIL.
