This study analyzes Rule of Origins of each FTA that was taken effect by Korea with Chile, Singapore, EFTA, ASEAN, EU and India. The purpose of study is to investigate the effect of strict Rule of Origin on trade under condition of FTA. Tariff on trade is reduced or abolished between countries that were agreed on FTA. This effect on tariff causes increased trade by allowing trade to compete with domestic products under same condition and to obtain a competitive price against foreign products. However, increased trade will not be accomplished if Rule of Origin is difficult to apply and takes great effort to satisfy the criteria of FTA. Before analyzing the effect of Rule of Origin, there is goods wholly obtained test (WO) and substantial transformation test in content of Rule of Origin. WO is used for all product produced in one country. Substantial transformation test is used for product manufactured in many countries and it includes change in tariff classification method (CTC), value added test (VA) and criterion of specific manufacturing. Furthermore, supplementary criteria such as direct consignment, cumulation rule, deminimis rule, roll-up principle, are included in Rule of Origin. Rule of Origin of Korea FTA employs all criteria but extent of usage of each criterion is different for each Korea FTAs signed with different countries. This difference gives problem to companies because multiple Rule of Origins may be applied to same product. To measure restrictiveness of Rule of Origin, Restrictiveness Index (RI) is used. This method permits numerical and quantitative measure rather than abstract concept such as hardness or complicatedness. By employing RI, relative restrictiveness between FTAs signed by Korea is acquired. Also, to identify industrial characteristics, all products are classified into fifteen categories by the International Convention on the Harmonized Commodity Description and Coding System (HS), and the difference between Rule of Origins in different industries is analyzed by attaining industrial average restrictiveness. To understand the effect of Rule of Origin on trade, the gravity model, which is commonly used to measure outcome of FTA, is applied. Trade volume, occurred from 2007 to 2010 when Korea FTA was actually taken effect, is classified into fifteen categories and penal analysis using gravity model is conducted. From result of analysis, it is found that restrictiveness of Rule of Origin gives negative effect on trade volume of Korea’s main export such as processed food, chemical product, cloths & texture, electronics, precision instruments and automobiles. This proves that if restrictiveness of Rule of Origin is high, in other words, if it is too complicated and hard to satisfy criteria of FTA, it affect negatively on trade volume or increased trade. In conclusion, Korea need to approve less complicated Rule of Origin for later FTA negotiation to increase trade volume which is greatest purpose of FTA. In addition, it is requested to fix the problem that many Rule of Origins are applied to one product. Moreover, proper information, training expert, improvement of administrative procedure are needed for education and usage of Rule of Origin.
