국 문 초 록 국민이 누려야 할 교육기회의 균등한 보장이라는 「헌법」상의 권리를 실현시키기 위해 국가는 의무교육의 실시와 함께 교육제도 및 그 운영과 교육재정에 관한 사항을 법률로 정함으로써 이를 제도적으로 확립하여야 한다. 이에 따라 「교육기본법」에서는 국가와 지방자치단체에게 교육재정의 안정적 확보를 위한 시책의 수립의무와 장학금제도 및 학비보조제 등의 실시의무를 지우고 있다. 그러나 이러한 국가의 각종 지원에도 불구하고 소득수준에 따른 교육기회의 양극화현상은 항상 사회문제로 대두되고 있다. 장학사업은 이를 위한 공공 및 민간에서의 제도적 공익활동이다. 즉, 광의의 장학사업이란 학업의 지속을 원하지만 경제적 이유 등으로 소외된 자들에게 학업을 권장하는 일체의 제도적 활동을 의미하며, 협의의 개념으로는 학업의 유지와 권장을 위한 학자금 등의 급부행위를 의미한다. 이러한 장학사업은 그 수행의 주체에 따라 국가 또는 지방자치단체의 공적 장학사업과 민간의 영역에서 행하는 장학사업으로 구분된다. 그러나 대부분의 장학사업은 국가를 대신한 민간조직이 직ㆍ간접적으로 수행하고 국가는 이에 대해서 조세혜택 등의 인센티브를 제공하는 양태가 오늘날의 일반적인 흐름이다. 그 이유는 제도적ㆍ재정적인 면에서 또는 효율성 측면에서 민간의 영역이 더 효과적이라는 경험적 판단에 의한 것이다. 오늘날 그 중심에 있는 단체가 재단법인 형태의 장학법인이다. 2013년도의 통계에 의하면 우리나라의 학술ㆍ장학단체의 비율은 종교법인을 제외한 전제 공익단체의 28.7%로 가장 많은 비중을 차지하고 있는 것으로 나타났다. 그러나 장학단체의 이러한 양적 비중만큼이나 이들이 공익활동이 비례적이지 않다는 것이 일반적인 평가이다. 많은 경우 명목상으로만 공익을 표방하여 장학재단을 설립하였지만, 그 실질은 재산출연을 통한 조세회피 또는 주식출연을 통한 기업지배력 유지 등의 방편으로 장학재단을 이용하고 있다는 것이다. 이는 곧 법인의 설립 후 소극적 공익활동으로 이어지는 문제점을 지니게 된다. 장학재단의 이러한 비공익적 활동의 이면에는 상당부분 설립근거법 또는 세제상의 제도적 허점에서 기인하는 것으로 판단된다. 즉, 재산출연에 대해서 이미 세제혜택을 누린 장학재단이 법인설립 이 후에도 그 설립목적대로 충실히 장학사업 등의 공익활동을 수행하고 있는지에 대한 검증시스템과 사후관리제도가 현행 법령체계 내에 충분히 마련되어 있지 않다는 문제를 지니고 있는 것이다. 여러 문제점 중 하나가 장학재단의 재산 대부분을 항구적으로 ‘기본재산’에 묶어 두고, 그 ‘기본재산’의 처분을 주무관청의 허가라는 매우 까다로운 절차로 봉쇄함으로써 오로지 과실소득 등으로만 장학활동을 하도록 하는 것이다. 장학재단은 장학사업의 특성상 그 목적사업을 영위하기 위하여 특별한 시설을 필요로 하지 않는 공익법인이다. 그러므로 장학재단의 경우에는 특별히 출연재산의 처분을 엄격하게 규제하여야 할 이유가 없는 것이고, 따라서 다른 공익법인과는 달리 취급되어야 하는 것이다. 그럼에도 불구하고 장학재단에 속해 있는 소유재산의 대부분을 직접적인 장학금 지급의 재원으로 사용하지 못하도록 현행 법령에서 규제하고 있는 모습은 장학재단이 소극적으로 공익사업을 할 수 밖에 없는 요인이 되고 있는 것이다. 이와 관련한 여러 유형의 문제점을 사례별로 살펴보고 그 개선방안을 제시한다. 첫째, 장학재단의 설립시 ‘기본재산’으로 출연되어야 할 최저한의 재산출연제도는 ‘보통재산’의 경우에도 동일하게 적용되어야 하고, 그 수준은 ‘기본재산’의 최저출연수준을 상회하도록 개선하여야 한다. 그 이유는 장학사업을 수행함에 있어서 직접적으로 사용가능한 재원은 ‘보통재산’에 한정되어 있으므로, 이를 법제화하여야만 자율적이고 능동적인 장학사업을 기대할 수 있기 때문이다. 한편, 장학재단이 무수익자산 출연에 대해서는 특별한 제한을 받지 않는 문제점에 있어서는 무수익자산의 처분요구 권한을 주무관청에게 부여하는 방안이 필요하며, 공익활동을 소극적으로 행하거나 사실상 공익활동을 중단하고 있는 장학재단에 대해서는 법인설립허가를 취소하는 입법적 개선방안이 필요하다. 둘째, 장학재단의 자산소유 구조가 장학금의 재원창출이라는 측면에 있어서 지극히 비효율적인 문제와 관련해서는 미국의 IRC 제4942조에서 규정하고 있는 것과 같은 유보소득 과세제도를 도입할 필요가 있다. 이는 순투자자산의 일정율 이상을 장학금 지급에 활용하도록 함으로써 무수익자산에 대한 문제를 해결할 수 있기 때문이다. 그리고 방만한 수익사업의 경영으로 인해 공익재원이 감소되거나 과다 인건비의 지출 등을 막기 위한 제도로서 장학재단의 전체 비용 중 장학금의 지출비율을 일정율 이상으로 강제하는 기준을 마련할 필요가 있다. 또한 주식을 보유할 뿐 배당실적이 없는 주식에 대해서는 주식출연시 부여받은 증여세 면제 등의 세제혜택을 박탈하는 개선방안도 필요하다. 배당실적이 없는 주식은 공익에 전혀 공헌하지 않는 자산이기 때문에 이에 대해서는 증여세를 면제할 이유가 전혀 없는 것이기 때문이다. 아울러 현행의 ‘선감면 후사후관리’ 제도는 그 공익적 활동과 연계시켜 감면을 행하는 ‘선과세 후비례적 감면’으로의 제도개편이 필요하다 할 것이다. 셋째, ‘기본재산’의 처분을 통한 장학사업의 활성화를 위해 출연재산과 ‘기본재산’의 개념을 달리하는 제도개선이 필요하다. 즉, 일본의 사례와 같이 출연재산의 최소기준을 법제화하는 한편, 이를 제외한 자산은 모두 그 처분이 가능하도록 ‘기본재산’ 제도를 폐지하여야 할 것이다. 이는 기존의 ‘기본재산’을 처분함에 있어서 ...

Accordingly, ‘the Fundamental Law of Education’ regulate national and local governments for establishing measures to ensure the stability of financial education. Furthermore, the laws denoted burden of clear obligations, such as scholarships and tuition aid. However, despite the support of nation’s variety, polarization of educational opportunities according to income level has always been a social problem. And it is required legislative improvements to cancel the license of incorporation of scholarship foundation that performing passive activities or suspending activities.
