This study was conducted in order to clarify the vague boundary between complementary and alternative therapy and medical practice, which has been controversial since the enactment of the Medical Service Act to the present. For this purpose, judicial cases were collected using Legal Information Services of the Court of Korea and LAWnB as search engines. In a total of 15 cases, we could find indirect provisions on medical practice, definition of illicit medical practice, and the positions of the Constitutional Court and the Supreme Court on complementary and alternative therapy. By the fact that provisions defining medical practice were not found in the Medical Service Act, however, it was reconfirmed that the boundary between medical practice and complementary and alternative therapy was not clear. Different from foreign countries where all practices other than general practices of contemporary medicine are categorized into complementary and alternative therapy, Korea has a dual medical system unique throughout the world. This system is for distinguishing Oriental medicine from complementary and alternative therapy, which is non?medical practice, by legalizing Oriental medicine as medical practice along with general medical practice in the Medical Service Act. However, some of Oriental medical procedures are executed without scientific verification and such procedures are often exaggerated to be effective for diseases incurable with Oriental medicine, and for these reasons the dual medical system is faced with opposition. Because the use of complementary and alternative therapy is increasing steadily in the contemporary society, institutional changes are required. Korea shows the highest suicide rate of adolescents, university students, and elders aged over 65 among the OECD countries, and economic poverty, academic stress, loneliness, lack of sleep, etc. are mentioned as possible reasons for the high suicide rate. In particular, it is hard to resolve economic poverty without correcting institutional problems in the principle of market economy, global market, etc. In contrast, complementary and alternative therapies such as psychological counseling therapy, music therapy, and art therapy, which are hardly harmful to people’s lives, bodies, or public health, appear to mitigate psychological disorders (such as depression) induced by economic poverty to some degree. According to conclusions drawn from the review of judicial cases in this study, a medical practice is an experience and function based on medical expertise and indicates an act for preventing or treating disease through examination, inspection, prescription, medication or surgical procedure. Some of such practices, if not carried out by medical professionals, are likely to pose a risk to health and hygiene. Illicit medical practice, which is non?medical practice, is a preventive or therapeutic act by one who is not a medical professional but has medical expertise and likely to harm people’s lives, bodies, or public health. According to the Journal of the American Medical Association, alternative therapy must be scientifically verifiable, and its efficacy, safety, etc. should be proved by scientific methods. Such verification is required for promoting the stability, efficiency, and future development of alternative therapy among the practitioners and consumers. Therefore, it is necessary to systematize complementary and alternative therapies used in Korea and Oriental medicine that has not been itemized clearly to the present. In order for complementary and alternative therapies to be used freely from regulations under the Medical Service Act, there should be first scientific verification of such therapies and institutional measures (such as improvement of related laws and regulations) for regulating indiscreet practices causing social problems. Such measures may include minimizing potential harms to consumers’ lives and bodies and obligatory hygiene education for practitioners and places. In the past, knowledge about diseases was monopolized by specialists (medical professionals) and it was relatively hard for consumers to make critical decisions on medical practice. With the spread of the Internet these days, however, ordinary people can access expert knowledge easily and, as a result, they have higher decision?making power than before.
