Systems and methods are provided for pricing, selling, and/or otherwise distributing electronic content using auction mechanisms. A randomized auction mechanism is used to determine both the number of goods that are sold and the selling price. The auction mechanism automatically adapts to the bid distribution to yield revenue that is competitive with that which could be obtained if the vendor were able to determine the optimal fixed price for the goods. In one embodiment a set of bids is randomly or quasi-randomly partitioned into two or more groups. An optimal threshold is determined for each group, and this threshold is then used to select winning bids from one or more of the other groups. In another embodiment, each bid is compared to a competing bid that is randomly or quasi-randomly selected from the set of bids. If the bid is less than the randomly-selected competing bid, the bid is rejected. Otherwise, the bid is accepted and the bidder buys the auctioned item at the price of the randomly-selected bid.

A system for vending copies of an electronic work, the system including: (a) means for receiving a plurality of bids from a plurality of bidders; (b) means for storing the bids; (c) means for select a bid from the plurality of bids, wherein the bid being submitted by one of the bidders; (d) means for selecting a sample of bids from the plurality of bids, wherein the sample of bids does not include the bid from the one bidder; (e) means for deriving a threshold from the sample of bids, (f) means for comparing the bid of the one bidder with the threshold to determine whether to vend a copy of the electronic work to the bidder based, at least in part, on the comparison; and (g) a network interface unit for sending a copy of the electronic work to the bidder; wherein copies of the electronic work available to be vended by the system comprise a quantity of copies that is greater than the quantity of bids in the plurality of bids. 2. A system as in claim 1, further including: (h) payment processing software for collecting payment for the electronic work from the bidder. 3. A system as in claim 1, in which the sample of bids is selected from the plurality of bids in a random fashion. 4. A system as in claim 1, in which the network interface is operable to send a copy of the electronic work to the bidder in a relatively secure manner. 5. A system as in claim 1, wherein the system obtains payment from the bidder in an amount equal to the threshold. 6. A system as in claim 1, in which the sample comprises a single bid, and in which the threshold comprises the bid value of said single bid. 7. A system as in claim 1, in which said threshold is chosen to maximize a quantity obtained by multiplying (a) the number of bids in the sample that exceed the threshold, by (b) the bid value of the highest bid in the sample that is less than or equal to the threshold. 8. A system as in claim 1, in which the means for deriving is a processor which compares the bid with the threshold in order to determine whether to distribute a copy of the electronic work to the bidder. 9. A system as in claim 1, wherein the means for selecting a sample of bids comprises means for selecting a new bid and a new sample of one or more bids from the plurality of bids each time a new bid is submitted by a new bidder. 10. A system as in claim 9, in which each new sample of bids is different from all samples of bids previously selected. 11. A system as in claim 9, in which the new sample of bids include each of the plurality of bids except for the bids included in the previous samples. 12. A system as in claim 1, further including a payment processing component that processes payment information regarding the electronic work. 13. A system as in claim 12, in which the sample of bids is selected from the plurality of bids in a random fashion. 14. A system of claim 12, wherein the payment from the bidder is equal in amount to the threshold derived from the sample of bids. 15. A system of claim 12, wherein the payment processing component is a server. 16. A system as in claim 15, in which the sample of bids is selected from the plurality of bids in a random fashion. 17. A system of claim 15, wherein the payment from the bidder is equal in amount to the threshold derived from the sample of bids. 18. A system of claim 12, wherein the payment processing component comprises a computer readable media containing a program of instructions. 19. A system of claim 18, wherein the program of instructions includes a control program. 20. A system as in claim 19, wherein the control program is an auction control module. 21. A system as in claim 18, wherein the program of instructions is stored in the memory unit. 22. A system as in claim 18, in which the sample of bids is selected from the plurality of bids in a random fashion. 23. A system of claim 18, wherein the payment from the bidder is equal in amount to the threshold derived from the sample of bids. 24. A system as in claim 1, wherein a maximum number of copies of the electronic work subject to vending is not specified in advance of receiving the plurality of bids.
