A dynamic fixation device is provided that allows the vertebrae to which it is attached to move in flexion within the normal physiological limits of motion, while also providing structural support that limits the amount of translation motion beyond normal physiological limits. The present invention includes a flexible portion and two ends that are adapted for connection to pedicle screws. In at least one embodiment of the present invention, the normal axis of rotation of the vertebrae is substantially duplicated by the dynamic fixation device. The flexible portion of the dynamic fixation device can include a geometric shape and/or a hinge portion.

An implant assembly for flexibly linking a first vertebra of a spine to a second vertebra of the spine of a patient, comprising: a rod member including at least one geometric shaped portion having a perimeter wall and a hollow interior region, said perimeter wall having an interior surface comprising a sloped face, wherein said sloped face is oriented at an angle, said angle less than about 90 degrees relative to a plane aligned with a posterior side of the geometric shaped portion, wherein the perimeter wall is configured around an opening, and wherein the opening is smaller on an anterior side of the geometric shaped portion than on the posterior side of the geometric shaped portion;means for attaching said rod member to the first vertebra and the second vertebra;wherein said geometric shaped portion permits flexion of the vertebra when the patient bends their spine. 2. The device as claimed in claim 1, wherein said device comprises a metal alloy. 3. The device as claimed in claim 1, wherein said means for attaching comprises at least one rod connector and at least one pedicle screw. 4. A dynamic fixation member adapted for implantation in a patient by posterior attachment to a first vertebra of a spine of the patient using a first pedicle screw and a first connector, and to a second vertebra using a second pedicle screw and a second connector, to allow controlled bending of the first vertebra relative to the second vertebra, comprising: a first rod arm adapted for connection to the first pedicle screw by the first connector, and a second rod arm adapted for connection to the second pedicle screw by the second connector; anda deformable portion connected to the first and second rod arms, the deformable portion including a plurality of branch segments interconnected by a plurality of elastomeric hinges, wherein the plurality of elastomeric hinges are aligned with their axes in a substantially anterior-posterior orientation, wherein the plurality of branch segments and the plurality of elastomeric hinges are configured around an opening, wherein an interior surface of both the plurality of branch segments and plurality of elastomeric hinges around the opening are sloped, and wherein the opening is smaller on an anterior side of the deformable portion than on a posterior side of the deformable portion; andwherein when implanted posteriorly in the patient, the deformable portion allows controlled bending motion while limiting sagittal translation of the first vertebra relative to the second vertebra with lengthening and shortening of the deformable portion. 5. The dynamic fixation member of claim 4, wherein the plurality of branch segments form a perimeter wall having an interior surface comprising a sloped face oriented at an angle less than about 90 degrees relative to a plane aligned with a posterior side of the deformable portion. 6. The dynamic fixation member of claim 5, wherein the angle is greater than about 45 degrees. 7. The dynamic fixation member of claim 5, wherein the angle of said sloped face varies. 8. The dynamic fixation member of claim 4, wherein the plurality of elastomeric hinges comprise partially circular corners. 9. The dynamic fixation member of claim 4, wherein the plurality of branch segments are substantially equal in length. 10. The dynamic fixation member of claim 4, wherein the deformable portion is a diamond shape and each branch segment of the plurality of branch segments is substantially straight. 11. The dynamic fixation member of claim 4, wherein at least three elastomeric hinges of the plurality of elastomeric hinges are oriented in a plane. 12. A dynamic fixation member adapted for implantation in a patient by posterior attachment to a first vertebra of a spine of the patient using a first pedicle screw and a first connector, and to a second vertebra using a second pedicle screw and a second connector, to allow controlled bending of the first vertebra relative to the second vertebra, comprising: a first rod arm adapted for connection to the first pedicle screw by the first connector, and a second rod arm adapted for connection to the second pedicle screw by the second connector; anda deformable portion connected to the first and second rod arms, the deformable portion including interior sidewalls around an interior hollow region, the interior sidewalls including a sloped interior surface oriented at an angle θ of between about 45 to 90 degrees to a planar surface on a posterior side of the deformable portion;wherein a perimeter of the deformable portion is diamond shaped and has four branch segments that are substantially equal in length; andwherein when implanted posteriorly in the patient, the deformable portion allows controlled bending motion while limiting sagittal translation of the first vertebra relative to the second vertebra with lengthening and shortening of the deformable portion. 13. The dynamic fixation member of claim 12, wherein the deformable portion includes a plurality of elastomeric hinges. 14. The dynamic fixation member of claim 13, wherein at least one of the plurality of elastomeric hinges comprise partially circular corners. 15. The dynamic fixation member of claim 13, wherein the plurality of elastomeric hinges are aligned with their axes angled anteriorly to an anteriorly-located virtual axis of rotation. 16. A dynamic fixation member adapted for implantation in a patient by posterior attachment to a first vertebra of a spine of the patient using a first pedicle screw and a first connector, and to a second vertebra using a second pedicle screw and a second connector, to allow controlled bending of the first vertebra relative to the second vertebra, comprising: a first rod arm adapted for connection to the first pedicle screw by the first connector, anda second rod arm adapted for connection to the second pedicle screw by the second connector; anda deformable portion connected to the first and second rod arms, the deformable portion including a perimeter wall including four branch segments around an opening, wherein the opening is smaller on a first side of the deformable portion than on a second side of the deformable portion, the perimeter wall having a plurality of elastomeric hinges and an interior surface comprising a sloped face, wherein said sloped face is oriented at an angle, and wherein said angle of the sloped face is either (a) a constant value along the entire interior surface, or (b) varies from about 60 degrees near a top of the deformable portion to about 90 degrees near a bottom of the deformable portion. 17. The dynamic fixation member of claim 16, wherein the plurality of elastomeric hinges comprise partially circular corners. 18. The dynamic fixation member of claim 16, wherein the deformable portion is a diamond shape. 19. The dynamic fixation member of claim 16, wherein at least three elastomeric hinges of the plurality of elastomeric hinges are oriented in a plane.
