A dynamic fixation device is provided that allows the vertebrae to which it is attached to move in flexion within the normal physiological limits of motion, while also providing structural support that limits the amount of translation motion beyond normal physiological limits. The present invention includes a flexible portion and two ends that are adapted for connection to pedicle screws. In at least one embodiment of the present invention, the normal axis of rotation of the vertebrae is substantially duplicated by the dynamic fixation device. The flexible portion of the dynamic fixation device can include a geometric shape and/or a hinge portion.

A vertebral implant assembly for posterior attachment to a first vertebra and an adjacent second vertebra of a spine of a patient to allow controlled bending of the first vertebra relative to the adjacent second vertebra, comprising: a first pedicle screw adapted for posterior attachment to the first vertebra, and a second pedicle screw adapted for posterior attachment to the adjacent second vertebra;a first connector interconnectable to the first pedicle screw and a second connector interconnectable to the second pedicle screw; anda dynamic fixation member, comprising: a first rod arm interconnectable to the first pedicle screw by the first connector, and a second rod arm interconnectable to the second pedicle screw by the second connector; anda deformable portion connected to the first and second rod arms, the deformable portion including an upper member with a first void space and a lower member with a second void space, the first void space and second void space each including at least two rounded inner corners, wherein the upper member and the lower member further comprise a variable thickness, and wherein a connecting member interconnects the upper member to the lower member;a gap located between a lower surface of the first rod arm and an upper surface of the second rod arm, wherein the gap extends anteriorly between the upper member and lower member to a posterior side of the connecting member, and wherein a first gap height is greater adjacent the connecting member than a second gap height located between the lower surface of the first rod arm and the upper surface of the second rod arm. 2. The vertebral implant assembly of claim 1, wherein the upper member and the lower member comprise thinned portions adjacent the connecting member. 3. The vertebral implant assembly of claim 2, wherein each of the upper and lower members comprise a top substantially anterior-posterior aligned arm and a bottom substantially anterior-posterior aligned arm bordering each void space, and wherein the top and the bottom substantially anterior-posterior aligned arms each comprise thinned portions. 4. The vertebral implant assembly of claim 2, wherein the upper member, the lower member and the connecting member substantially comprise a reverse C shape. 5. A deformable member configured to be interconnected in a posterior orientation to a first vertebra using a first pedicle screw and a first connector, and an adjacent second vertebra using a second pedicle screw and a second connector, the deformable member comprising: a first rod arm configured to be interconnected to the first pedicle screw using the first connector, and a second rod arm configured to be interconnected to the second pedicle screw using the second connector;an upper member connected to the first rod arm, the upper member including a first void space partially enclosed by an upper member top section and an upper member bottom section;a lower member connected to the second rod arm, the lower member including a second void space partially enclosed by a lower member top section and a lower member bottom section;a connecting member interconnecting the upper member to the lower member; anda gap located between a lower surface of the first rod arm and an upper surface of the second rod arm, wherein the gap extends between the upper member and lower member to a side of the connecting member, and wherein a first gap height is greater adjacent the connecting member than a second gap height located between the lower surface of the first rod arm and the upper surface of the second rod arm;wherein, when implanted posteriorly in the patient, the deformable member allows controlled bending motion while limiting sagittal translation of the first vertebra relative to the adjacent second vertebra. 6. The deformable member of claim 5, wherein the void spaces each include at least two rounded inner corners. 7. The deformable member of claim 5, wherein the upper member and the lower member comprise thinned portions adjacent the connecting member. 8. The deformable member of claim 7, wherein the upper member, the lower member and the connecting member substantially comprise a reverse C shape. 9. A deformable member for use in dynamic fixation of a first vertebra and an adjacent second vertebra, the deformable member comprising: a first rod arm and a second rod arm;an upper member connected to the first rod arm, the upper member including a first void space partially enclosed by an upper member top section and an upper member bottom section;a lower member connected to the second rod arm, the lower member including a second void space partially enclosed by a lower member top section and a lower member bottom section;a connecting member interconnecting the upper member to the lower member; anda gap located between a lower surface of the first rod arm and an upper surface of the second rod arm, wherein the gap extends between the upper member and lower member to a side of the connecting member, and wherein a first gap height is greater adjacent the connecting member than a second gap height located between the lower surface of the first rod arm and the upper surface of the second rod arm.
