The legs 12 in use of the staple are bent through approximately 90° relative to the base. To effect a greater compression of the stapled tissue the legs include a penetrative portion 16 adjacent the tip and a compressive structure 30 which, due to its increased height relative to that of the penetrative portion, spreads the compressive forces of the staple further along the length of the incision being closed. The compressive portion also provides a depth stop to avoid the tip penetrating too deeply into the tissue in which it is deployed.

The surgical staple of claim 1, wherein the compressive portion is disposed on the distal portion. 3. The surgical staple of claim 1, wherein the angle between the proximal and distal portions of each leg is approximately 90 degrees. 4. The surgical staple of claim 1, wherein the penetrative portions are substantially round in cross-section and the compressive portions are substantially flat in cross-section, the flat surfaces of the compressive portions extending in the first direction. 5. The surgical staple of claim 4, wherein the staple is formed from a length of substantially round metallic wire and the compressive portions are formed by flattening a length of the metallic wire forming part of each leg. 6. The surgical staple of claim 4, wherein the staple is formed from a length of substantially round wire and the compressive portions comprise plates attached to the round wire. 7. The surgical staple of claim 1, wherein the compressive portions comprise sections of elongate material bent out of alignment with the penetrative portions in the first direction. 8. The surgical staple of claim 7, wherein the bent sections are sinusoidal. 9. The surgical staple of claim 1, wherein a portion of each leg is divided and the divided portions of the leg are bent away from each other in the first direction to form the compressive portions. 10. The surgical staple of claim 1, wherein the legs and the base are integrally formed of a unitary, monolithic construction from the same piece of material. 11. A surgical staple comprising: a base; anda pair of legs each extending from an opposite end of the base, the legs and the base being integrally formed of a unitary construction from the same piece of material, each leg comprising: a proximal portion extending from the base at a bend point;a distal portion extending from the proximal portion at an angle of between 70 and 110 degrees, the proximal portion and the distal portion lying substantially within a plane;a penetrative portion terminating at a tip, the staple being plastically deformable at a bend point on each leg to bend each leg relative to the base causing each tip to approach the other leg along a substantially arcuate path lying in a plane; anda compressive portion having a substantially flat inner surface located between the base and the distal portion, the compressive portion having a height greater than that of the penetrative portion, the heights being measured in a first direction perpendicular to the plane defined by the arcuate path at a position adjacent a junction of the compressive portion and the distal portion;wherein the compressive portion is formed on the proximal portion. 12. The surgical staple of claim 11, wherein the compressive portion is formed on the distal portion. 13. The surgical staple of claim 11, wherein each leg comprises a proximal portion extending from the base at the bend point and a distal portion extending from the proximal portion at an angle of between 70 and 110 degrees, the proximal portion and the distal portion lying substantially within the plane. 14. The surgical staple of claim 11, wherein the penetrative portions are substantially round in cross-section and the compressive portions are substantially flat in cross-section, the flat surfaces of the compressive portions extending in the first direction. 15. The surgical staple of claim 14, wherein the staple is formed from a length of substantially round metallic wire and the compressive portions are formed by flattening a length of the metallic wire forming part of each leg. 16. The surgical staple of claim 11, wherein the staple is a single piece of flat metal stock, cut and bent to form the staple. 17. A surgical staple comprising: a base; anda pair of legs each extending from an opposite end of the base, each leg comprising: a plurality of penetrative portions, each terminating at a tip, the staple being plastically deformable at a bend point on each leg to bend each leg relative to the base causing each tip to approach the other leg along substantially arcuate paths lying in substantially parallel planes; anda compressive portion having a substantially flat inner surface located proximate the base and having a tapered portion extending toward the base from which the compressive portion extends, the compressive portion having a height greater than that of each penetrative portion, the heights being measured in a first direction perpendicular to the parallel planes defined by the arcuate paths. 18. The surgical staple of claim 17, wherein the penetrative portions of each leg are connected by the compressive portion of the leg. 19. The surgical staple of claim 17, wherein the staple is plastically deformable in a manner which allows the tips of one leg to approach and pass the tips of the other leg, each moving in a different but substantially parallel plane, when the legs are bent. 20. The surgical staple of claim 17, wherein the staple is plastically deformable in a manner which allows at least one of the tips of one leg to substantially abut at least one of the compression portions of the other leg when the legs are bent. 21. The surgical staple of claim 17, wherein the legs and the base are integrally formed of a unitary construction from the same piece of material. 22. A surgical staple comprising: a base; anda pair of legs each extending from an opposite end of the base, each leg comprising a proximal portion extending from the base at a bend point, and a distal portion extending from the proximal portion at an angle of between 70 and 110 degrees, the proximal portion and the distal portion lying substantially within a plane, the distal portion including a penetrative portion terminating at a tip and the leg including a compressive portion having a substantially flat inner surface located between the base and the penetrative portion and having a tapered portion extending toward the base from which the compressive portion extends, the compressive portion having a height greater than that of the distal portion, the heights being measured in a first direction perpendicular to the plane at a position adjacent a junction of the compressive portion and the distal portion, the compressive portion being distal the bend point, the legs bendable between: an open position in which the proximal portions of the legs extend substantially linearly from the base and the tips are spaced apart from each other; anda closed position, in which each leg is plastically deformed about the corresponding bend point between the leg and the base such that the proximal portions of the legs are substantially orthogonal to the base, the tips are positioned adjacent one another and the legs lie within the same plane. 23. The surgical staple of claim 22, wherein in the closed position, the tip of one leg approaches and passes the tip of the other leg, each moving in a different but substantially parallel plane. 24. The surgical staple of claim 22, wherein in the closed position, the tip of one leg substantially abuts the compression portion of the other leg.
