The present disclosure relates to electrosurgical instruments for use in sealing various tissues. The instrument includes a housing having a shaft attached thereto and an end effector assembly attached to a distal end of the shaft, wherein the end effector assembly includes first and second jaw members attached thereto. The jaw members are movable relative to one another from a first position for approximating tissue to at least one additional position for grasping tissue therebetween. The jaw members have an elastomeric material disposed on an inner facing tissue contacting surface thereof with the elastomeric materials including an electrode disposed therein. The electrodes are offset a distance X relative to one another such that when the jaw members are closed about the tissue and when the electrodes are activated, electrosurgical energy flows through the tissue in a generally coplanar manner relative to the tissue contacting surfaces.

A surgical instrument, comprising: an end effector including a first jaw member and a second jaw member, the end effector defining a longitudinal axis;a first electrode disposed in mechanical cooperation with an inner facing tissue contacting surface of the first jaw member, the inner facing tissue contacting surface of the first jaw member defining a plane; anda second electrode disposed in mechanical cooperation with an inner facing tissue contacting surface of the second jaw member, the first electrode and the second electrode being offset a variable distance X relative to one another in a direction transverse to the longitudinal axis and in a direction parallel to the plane, wherein the first jaw member includes a plurality of electrodes extending across a width thereof. 2. The surgical instrument of claim 1, wherein the distance X is in the range of about 0.005 inches to about 0.200 inches. 3. The surgical instrument of claim 1, further comprising at least one sensor disposed in electrical communication with at least one of the first electrode and the second electrode, the at least one sensor being configured to provide information to a feedback circuit for regulating electrosurgical energy through tissue. 4. The surgical instrument of claim 3, wherein the at least one sensor measures at least one of tissue impedance, tissue temperature and tissue thickness. 5. The surgical instrument of claim 1, wherein the surgical instrument is adapted to connect to a feedback circuit that selects one electrode of the plurality of electrodes for electrically opposing the second electrode. 6. The surgical instrument of claim 5, wherein the feedback circuit includes a sensor that measures at least one of tissue impedance, tissue temperature and tissue thickness. 7. The surgical instrument of claim 1, further comprising an insulative material disposed on the inner facing tissue contacting surface of each of the first jaw member and the second jaw member. 8. The surgical instrument of claim 7, wherein the first electrode is disposed at least partially within the insulative material of the first jaw member. 9. The surgical instrument of claim 7, wherein the first electrode is recessed within the insulative material of the first jaw member. 10. The surgical instrument of claim 7, further comprising an elastomeric material disposed on each of the first jaw member and the second jaw member. 11. The surgical instrument of claim 1, further comprising an elastomeric material disposed on each of the first jaw member and the second jaw member. 12. The surgical instrument of claim 11, wherein the first electrode is disposed at least partially within the elastomeric material of the first jaw member. 13. The surgical instrument of claim 11, wherein the first electrode is recessed within the elastomeric material of the first jaw member. 14. A surgical instrument, comprising: an end effector including a first jaw member and a second jaw member, the end effector defining a longitudinal axis; the first jaw member including a tissue contacting surface defining a plane;a first electrode disposed in mechanical cooperation with the first jaw member; anda second electrode disposed in mechanical cooperation with the second jaw member, the first electrode and the second electrode being offset a distance X relative to one another in a direction transverse to the longitudinal axis and in a direction parallel to the plane, wherein the distance X is variable, wherein the first jaw member includes a plurality of electrodes extending across a width thereof. 15. The surgical instrument of claim 14, wherein the distance X is in the range of about 0.005 inches to about 0.200 inches. 16. The surgical instrument of claim 14, wherein the surgical instrument is adapted to connect to a feedback circuit that selects one electrode of the plurality of electrodes for electrically opposing the second electrode. 17. The surgical instrument of claim 16, wherein the feedback circuit includes a sensor that measures at least one of tissue impedance, tissue temperature and tissue thickness. 18. The surgical instrument of claim 14, further comprising an insulative material disposed on an inner facing tissue contacting surface of the first jaw member, and wherein the first electrode is disposed at least partially within the insulative material of the first jaw member.
