I. 배경 및 목적
□ 2012년 기후변화협약(UNFCCC)에 따른 교토의정서의 1차 이행시기가 종료됨에 따라, 온실가스 감축과 관련하여 이른바 포스트 교토체제에 대한 논의가 제안되고 있음
□ 2007년 유럽연합은 재생에너지 로드맵을 동하여 2020년까지 유럽연합 내 재생에너지 비율을 20%로 상향하기 위한 장기 전략을 제시하였으며, 이를 달성하기 위하여 2009년 재생에너지 지침을 채택하고 회원국들에게 개별적인 목표를 설정하도록 하였음

II. 주요내용
□ 유럽의 재생에너지 법제와 정책 개관
O 유럽연합은 재생에너지지침으로 2001년지침(2001/77/EC)과 2009년 지침(2009/28/EG)이 있고, 이 지침을 동하여 2020년까지 전기, 냉·난방, 수송 분야에 대한 재생에너지 비율을 20%까지 확대할 목표를 제시하고 있음
0 이 지침에는 재생에너지의 이용을 통하여 온실가스 배출을 저감하고 에너지 전환을 촉진하기 위한 기본적인 틀이 갖춘어져 있음

O 재생에너지의 개념은 재생에너지법에서는 일반적인 재생에너지 원별로 법적 정의하고, 재생에너지열병합법에서 열기와 냉기를 중심으로 법적 정의함
O 독일은 재생에너지 구축을 위하여 에너지컨셉, 원자력출구전략, 에너지전환 등의 국가전략을 수립하였고, 재생에너지의 조기 구축을 위하여 해양계획, 십만지붕프로젝트 등의 정책을 시행함
O 독일은 1990년 「전력공급법」에 이어 2000년 「재생에너지법」을 제정하였고 현재는 2014년에 최종 개정되면서 관련 재생에너지법 제도가 계속적으로 변천되었음
O 재생에너지 제도는 우리나라에 발전차액제도로 알려진 매입보상제도를 중심으로 발전하였고, 매입보상제도는 송전망사업자가 재생에너지 시설사업자로부터 전력을 공급받고 보상하는 제도임. 이후 매입보상제도는 재생에너지법 부담금으로 최종소비자에게 전가되었으나, 전력고소비기업에 대한 재생에너지법 부담금을 면제해주면서 전력요금이 대폭 상승하여 최근 에너지법 개혁으로 매입보상제도와 부담금감면제도를 대폭적으로 손질함

□ 우리나라 재생에너지법의 체계 개선 및 정책형성을 위하여 영국과 독일의 시사점은 큰 도움이 될 것임
□ 영국과 독일은 재생에너지 법제와 정책으로 인하여 재생에너지 구축에 성공적이었으므로 이러한 법제 및 정책적 효과를 도입할 필요가 있음
□ 재생에너지 구축은 기후변화에 대비한 온실가스 감축 외에도 고용성장, 기술발전 등의 경제적·사회적 효과도 크다고 볼 수 있음

□ In 2007, the European Commission published a Renewable Energy Roadmap outlining a long-term strategy. Tt called for a mandatory target of a 20% share of renewable energies in the EU’s energy mix by 2020. To achieve this objective, the EU adopted a new Renewables Directive in April 2009, which set individualized targets for each member state.
□ Examining the laws and policies of the UK and Germany in the European Union where successful establishment of Renewable Energy System were found will shed lights towards improvement of our still-developing renewable energy structure.
II. Main contents
□ Study on Renewable Legislation and Policy in European Union
o Directive 2009/28/EC on the promotion of the use of energy from renewable sources (hereinafter “RES Directive") not only sets the objective of reaching 20% of the EU’s energy consumption through renewable energy sources by 2020, but it also incorporates, for the first time, all three sectors (electricity, heating and cooling, transport) into the usage of the energy from renewable sources.
o RES Directive establishes a common framework for the use of energy from renewable sources in order to limit greenhouse gas emissions and to promote energy transition.
o Each Member State has a target calculated according to the share of energy from renewable sources in its gross final consumption for 2020. This target is in line with the overall ’20-20-20’ goal for the European Community.
o The Member States are to establish national action plans which set the share of energy from renewable sources consumed in transport, as well as in the production of electricity and heating, for 2020.
o These action plans must take into account the effects of other energy efficiency measures on final energy consumption (the higher the reduction in energy consumption, the less energy from renewable sources will be required to meet the target). These plans will also establish procedures for the reform of planning and pricing schemes and access to electricity networks, promoting use of energy from renewable sources.

o The UK Government’s goal for renewable energy production is to supply 20% of electricity in the UK from renewables by the year of 2020. The 2002 Energy Review set a target of 10% to be in place by 2010/2011. The target is 15% by 2015, and the 2006 Energy Review further set a target of 20% by 2020. To meet the challenge of climate change, the UK has been coping up with a rapid transition to renewable energy.
o In 2007, a draft Climate Change Bill was published following cross-party pressure over several groups. The Bill puts in place years, led by environmental a framework to achieve a mandatory 80% cut in the UK’s carbon emissions by 2050(compared to 1990 levels), with an intermediate target of between 26% and 32% by 2020. With its passing, the UK became the first country in the world to set such a long-range and significant carbon reduction target into law.
o In 2009, the UK Low Carbon Transition Plan was released, and the Plan details the actions to be taken to cut carbon emissions by 34% by 2020, based on 1990 levels (of which 21% had been achieved at the time of publication). As a result, the efficiency of 7 million homes is expected to be improved, with over 1.5 million of them generating renewable energy, and 40% of electricity will be generated from low carbon sources (renewables, nuclear power and clean coal).
o Government action can shape the market to drive further progress. Planning decisions and access to the grid are becoming quicker and easier. Households, communities, public services, and business will be able to generate their own renewable energy, through the introduction of a new Renewable Heat Tncentive and ’Feed-Tn Tariffs’ to provide guaranteed payments for energy they produce.
口 Study on Renewable Legislation and Policy in Germany
o From 1970s and 1980s, environmental issues have been considered as important than ever in German politics. Legislation such as the 1990 Electricity Feed Law and 2000 Renewable Energy Law played major roles in advancing the deployment of renewable energy technologies as well. These laws mandated the purchase of electricity generated from renewable sources by electric utilities and also offered large subsidies and government loans to renewable power producers.
o A 1997 Directive on Renewable Energy Sources adopted by the European Union also contributed to the cause of renewable energy by aiming to boost the renewable share of the electricity generating fuel mix to 22% by 2010. Similarly, the EU’s ratification of the Kyoto Protocol has given all EU member states additional legal incentives to reduce their domestic greenhouse gas emissions through the use of renewable energy. Renewable energy technologies are part of a broader long-term German energy strategy to reduce greenhouse gas emissions and other environmental impacts of energy use, to curtail dependence on the oil and gas imports that now satisfy 62% of German energy demand, and to contribute to German economic growth via high technology exports.
o The successes of renewable energy in Germany over the past decade must be balanced with other considerations. Tncreasingly, suboptimal sites have been developed for renewable energy production as the highest quality (and lowest cost) sites both onshore and offshore have been exploited. Also, Germany’s gas, coal, and electric power industries have objected to mandates for the purchase of more expensive renewable power and to the subsidies granted to renewable producers.
o In addition, the accelerated deployment of renewable energy technologies in Germany has paralleled a sharp decline in investment in energy research and development by the German government, prompting concerns that early deployment of renewable technologies may come at the expense of future generations of energy technologies. While renewable energy is likely to make further gains in Germany and throughout Europe in the near- to mid-term, domestic growth of renewable energy may be slowed in the longer term by political pressures and technological limitations.
