Ⅰ. 배경 및 목적

Ⅱ. 주요 내용
▶ 과태료 제도 일반론
○ 개념 : 국가 또는 지방자치단체가 일정한 행정상의 질서위반행위에 대하여 부과하는 금전적 제재
○ 유사개념 : 과료, 과징금, 범칙금, 이행강제금 등과 구별
○ 성격 : 행정의 실효성 확보수단으로서 공법상의 의무이행을 간접적으로 강제하는 행정질서벌로서 행정형벌과 구별
○ 법적 근거 : 과태료에 부과 및 징수에 관한 일반법으로서 질서위반행위규제법이 존재하며, 개별적인 부과권자와 부과기준 및 과태료 금액 등은 개별 법령에서 정함

▶ 주요 외국의 과태료 제도
○ 미국, 독일, 영국, 프랑스, 일본, 중국의 행정질서벌로서의 과태료제도에 대한 입법 사례 조사를 통하여 시사점 도출
○ 미국 : 민사금전벌제도가 있으며, 우리나라의 과태료 제도와 과징금 제도를 모두 포함하는 제도임. 연방과 주차원에서 광범위한 분야에서 홛용되고 있으며, 연방항공법 등 개별법에서 민사금전벌을 규정
○ 독일 : 행정적 제재수단으로 과태료라는 금전적 제재수단이 존재하고, 질서위반행위법이 일반법으로서 기능. 다만, 독일은 행정질서벌인 과태료와 행정형벌인 형사벌금간의 절차가 동일하여 우리나라의 과태료제도와는 구별됨
○ 영국 : 일번법이 존재하지 않고, 각 분야의 개별 법률 차원에서 해당 분야의 고유한 행정목적을 달성하기 위하여 행정적 과태료제도를 광범위하게 활용. 각 분야별로 과태료 부과 행위 유형을 구체화하여 질서위반행위를 구체적으로 규제
○ 프랑스 : 형벌적 벌금과 행정적 벌금을 일괄적으로 벌금이라는 명칭을 사용하며 그 부과근거에 따라 구별. 개별법에서 벌금 및 과태료와 유사 제재들을 모두 행정상 제재의 하나로서 금전적 제재로 포함
○ 일본 : 금전적 제재수단인 과료(過料)가 있으며 형법상의 벌금과 명확하게 구별.
과료에 대한 일반법은 존재하지 않고, 개별 법률에서 이를 규정하고 있으며, 비송사건수속법(非訟事件手続法)과 지방자치법(地方自治法)에서 규정
○ 중국 : 행정처벌의 일종으로 행정상 제재 등 행정처벌과 관련한 일반법인 ‘중화인민공화국 행정처벌법’ 에서 규정하고 있음. 법체계상 형사적 처벌과 행정적 제재가 명확하게 구분되어 있지 않고 혼용되고 있음
○ 과태료와 같은 행정적 제재수단은 각국의 입법 현실에 따라 차이는 있으나 다양한 행정분야에서 활용되고 있음. 일반법과 개별법체계로 구분되며, 부과의 법적 근거, 부과권자, 부과기준 및 산정, 부과 및 징수 절차, 부과처분에 대한 이의절차, 강제징수절차 등을 일반적으로 규정하고 있음
▶ 과태료 제도의 입법모델 정비방안
○ 현행 법령(법률, 하위법령상 【별표】)에서 규정되고 있는 과태료 규정의 입법형식과 규정내용 개선을 위한 정비방안을 도출하고자 하였으며, 이에 있어 입법기술상 “명확성의 원칙”을 적용, 실무상 담당자의 편의성과 관계 국민의 예측가능성을 확보하여 종국적으로 과태료 제도운영에 있어서의 합리성을 제고함
○ 현행 과태료를 규정하고 있는 5개 부처 소관법률 및 하위법령 등 총 272개 법률을 우선 조사 및 분석대상으로 함
- 국토교통부 소관 「개발이익 환수에 관한 법률」 등 93개 법률, 행정안전부 소관 「개인정보보호법」 등 41개 법률, 환경부 소관 「가축분뇨의 관리 및 이용에 관한 법률」 등 49개 법률, 보건복지부 소관 「감염병의 예방 및 관리에 관한 법률」 등 58개 법률, 문화체육관광부 소관 「게임산업진흥에 관한 법률」 등 31개 법률
Ⅲ. 기대효과
▶ 과태료의 개념을 비롯하여 과태료의 기능에 대한 이론적 논의는 단순한 행정형벌의 보충적 수단이 아닌 행정의 실효성 확보수단으로서의 고유한 성격을 부각시킴으로써 과태료 제도의 실효성을 제고하는 데에 기여할 수 있음

▶ Verify the status of the < Act on the Regulation of Violations of Public Order > within the Korean legal system, as a general law on administrative fines, at the 10th anniversary of its enactment, and the function of the administrative fine system as a system and an institution.

Ⅱ. Major Content
▶ General Discussion of the Administrative Fine System
○ Concept: An administrative fine is a financial penalty imposed by a government or local government agency for certain violations of public order.
○ Similar concepts: An administrative fine is distinct from minor fines, restitutive fine, punitive fine, and enforcement fine.

▶ Administrative Fine Systems in Major Countries
○ Examine administrative fine systems used in the U.S., Germany, U.K., France, Japan and China as a mechanism for punishing violations of public order to derive implications.
○ Research into legislative examples related to the administrative fine system (administrative order penalty system) from the U.S., Germany, U.K., France, Japan and China to derive implications.
○ U.S.: The civil money penalty (CMP) system is a system that covers both financial penalties known in Korea as administrative fines and restitutive fines. Civil money penalties are imposed at the federal level, as well as at the state level, and are provided for in various laws including the < Federal Aviation Act >.
○ Germany: Monetary sanctions are also used in Germany, as a means of administrative enforcement. The < Administrative Offences Act (Gesetz über Ordnungswidrigkeiten, OWiG) > is the general law regulating financial sanctions. However, in Germany, administrative order penalties (Geldbuße) are imposed and collected following the same procedure as administrative criminal penalties (Geldstrafe); which makes the German system distinct from the Korean administrative fine system.

○ Japan: Karyo, the monetary enforcement means used in Japan, is distinct from punitive fines under criminal law. No general law exists on administrative fines, which are provided for by individual laws, including the < Non-Contentious Case Procedures Act > and the < Local Autonomy Act >.
○ China: Administrative fines are regulated by the < Administrative Punishment Law of the People’s Republic of China >, a general law providing for administrative sanctions and punishments. In the Chinese legal system, there is no clear boundary between criminal punishments and administrative sanctions.
○ Administrative fines and other means used for administrative enforcement vary depending on the country, due to their specific legislative situation.
Notwithstanding, administrative fines are widely used in many administrative fields across the world. Administrative fines may be regulated by a general law or individual laws. No matter what their type, these laws usually stipulate the legal basis for the imposition of administrative fines, entities authorized to impose them, criteria for imposition, method for calculating their amounts, procedures for their assessment and collection, procedures for contesting a fine and procedures for forcible collection of fines.
▶ Suggested Improvements for the Legislative Model for Administrative Fines
○ Identify ways to overhaul the current laws (the laws and the Appendix Tables in their associated regulations) in a manner to improve the legislative approach in administrative fine-related provisions and the content thereof. Achieve greater compliance with the principle of clarity in legal provisions so as to guarantee the predictability of these laws for citizens and make their application more convenient for officials in charge to ultimately enhance the rationality and efficiency of the overall administrative fine system.
○ Review and analysis of 272 laws and regulations on administrative fines, proposed and implemented by five cabinet ministries, which are currently in effect.
- 93 laws and regulations including the < Restitution of Development Gains Act > by the Ministry of Land, Infrastructure and Transport, and 41 laws and regulations including the < Personal Information Protection Act > by the Ministry of Interior and Safety, 49 laws and regulations including the < Act on the Management and Use of Livestock Excreta > by the Ministry of Environment, 58 laws and regulations including the < Infectious Disease Prevention and Control Act > by the Ministry of Health and Welfare, and 31 laws and regulations including the < Act on the Promotion of the Game Industry > by the Ministry of Culture, Sports and Tourism.
Ⅲ. Expected Effects
▶ The theoretical discussion of administrative fines with regard to both the concept and function can help underscore their unique role as an administrative enforcement means, beyond being simple complements to administrative criminal penalties, which can, in turn, contribute to an increased effectiveness of the administrative fine system.
▶ Analyzing legislative approaches used in the < Act on the Regulation of Violations of Public Order > and individual laws that provide legal basis for the imposition and collection of administrative fines and designing a new legislative model by taking into consideration the input of those practically involved in their imposition and collection are likely to contribute to a more rational and efficient operation of the administrative fine system.
