○ 해양의 안전관리와 관련된 법은 해상교통·선박·선원·해난 등 매우 광범위한 영역에 걸쳐 있으므로, 본 연구는 해양에서 발생되는 가장 큰 위험원을 찾고 그에 대한 적절한 대응체계가 법을 통해 마련되고 있는지를 분석할 것
▶ 연구의 방법
○ 본 연구는 실용적인 입장에서 입법의 최종 수요자인 국민들의 입장을 반영하여 국민이 체감하는 해양에 대한 위험원, 그 발생원인, 그에 대하여 기대되는 안전 보장 방향이 무엇인지를 염두에 두고 접근하고자 함
○ 이를 도출하는 방법으로 소셜 빅데이터 분석을 통해 국민들이 가장 많이 접하게 되는 해양에서의 안전의 위협요인들과 그 대응을 위하여 중점적으로 다루어야 할 문제를 찾아내고자 하였음
○ 해양안전과 관련된 규범은 국제규범에서 출발된 경우가 많으며, 국내에서도 직접 적용되는 규범인 만큼, 관련 국제법령와, 미국, EU, 영국, 일본 등 주요 국가의 관련 기관과 법적 근거를 살펴보고자 하였음
○ 보다 심층적인 이해와 분석을 위하여 국제해사기구와 영국의 해양안전관련 기관들을 방문하여 구체적인 경험과 현황에 관한 정보를 획득하였음
Ⅱ. 주요 내용
▶ 해양안전의 의의
○ 해양안전과 해양안보
- 해양안전(maritime safety)은 선박·선원의 안전관리, 인명구조, 해상교통 등 전통적인 선박의 항행의 관점의 안전과 관련되며, 해양안보(maritime security)는 해적, 테러와 같이 고의적인 보안상의 위협과 관련되어짐
- 넓은 의미의 해양안전은 해양안전과 해양안보를 포괄하는 의미로 사용되어지기도 하고, 반대로 해양안보의 개념이 최근에는 전통적인 해상영토의 수호에서 확장되어 항행의 자유, 무역교통의 보호 등으로 확대되고 있음
○ 해양안전사고 현황
- 국내 해양안전사고가 2014년 세월호 이후 지속적으로 증가하고 있는 점을 유의할 필요가 있으며, 선박산의 충돌, 기관고장, 선박의 구조·설비·운용 등으로 인명손실이 발생하는 경우가 증가하여 전체적인 해양에서의 안전관리체계에 문제가 있는 것으로 보임
- 특히, 어선과 그중에서도 소형 어선과 관련된 사고 비중이 높아 대응책마련이 필요한 것으로 보이며, 법집행과 대응기관의 대응력과 이에 비례하는 권한 부여 등 법제도적 관리체계에도 문제가 있음
▶ 해양 안전관리에 관한 빅데이터 분석
○ 빅데이터 분석의 의의과 적용
- 제8차 국가교통안전기본계획을 통해 추출된 해양안전에 기본 지표들과 해양조난사고 통계연보(2015년)를 통해 선정한 해양안전에 대한 평가지표를 기반으로 온라인상의 소셜데이터 확보를 위한 모집단 구성함
- 평가지표를 기반으로 텍스트 마이닝을 통한 키워드 분석을 시행하였으며, 평가지표 선정결과에 따라 법적 검토를 통한 정책적 방향 제시
○ 정책평가지표 분석
- 주요 평가지표로는 사고 발생 및 원인과 관련하여, 소형선박, 어선·낚시어선, 배타적 경제수역이, 사고 대응과 관련해서는 전복, 기상악화, 해양경찰 등이 제시되었고, 이와 관련된 연관어들을 기계·장비(통신), 규모·선종, 대응기관·주체, 사고원인, 대처방안 등으로 나누어 빈출도를 분석함

○ 관련 조직
- 우리나라 해양안전관리를 담당하는 주요조직으로는 해양수산부와 해양경찰이 있으며, 해양수산부는 해양 관련 정책의 총괄, 해양경찰은 안전 및 보안사고 대응 및 수사를 담당하며, 해양안전심판원이 해양사고 관련 사건의 조사 및 심판업무 수행
○ 사고원인 관련 법령
- 소셜빅데이터 분석에 따라 가장 위험관리가 필요한 부분에 관련된 법령을 중심으로 살펴봄
- 어선의 안전관리에 관하여는, 「선박안전법」, 「어선법」, 「해사안전법」등이 있으며, 어선에 관하여는 개조, 무선통신설비, 위치발신장치 등을 「어선법」에서 정함

- 사고 대응과 관련하여서는, 전복사고 대응과 관련된 법으로, 「선박안전법」, 「선박직원법」, 「선원법」, 「해양경비법」, 「수상에서의 수색·구조 등에 관한 법률」이 있음
- 기상악화에 대한 사고대응과 관련된 법으로, 「해사안전법」, 「선원법」, 「수상에서의 수색·구조 등에 관한 법률」, 「해양경비법」이 있음

○ 안전관리체계의 문제점
- 주요 사고 원인에 관한 규칙·기준의 설정과 이에 대한 이행력 확보에 관한 업무가 해양수산부와 해양경찰청 각각에 귀속되어지는 경우가 있는데, 해상에서의 법집행의 실효성을 확보할 수 있는 수단을 보다 강화할 필요가 있으며, 사고 대응과 관련하여서는 관리주체가 여러 기관에 귀속됨으로 인한 비효율성을 관리체계의 단순화를 통해 개선할 필요가 있음
▶ 해양 안전관리에 관한 국제법 및 비교법적 분석
○ 국제협약
- 해양 안전에 관한 대표적인 국제협약으로는, 우리나라가 가입한 협약으로는, 「UN 해양법협약」, 「바다에서의 인명안전에 관한 협약」, 「선박으로부터의 해상오염방지를 위한 협약」, 「국제해상충돌예방규칙협약」, 「해상수색 및 구조에 관한 국제협약」, 「선원훈련·자격증명 및 당직유지의 기준에 관한 국제협약」이 있음
- 우리나라가 가입하지 않은 협약에는 「어선의 안전에 관한 토레몰리노스협약」, 「어선원 훈련·자격증명 및 당직유지의 기준에 관한 국제협약」이 있음
- 국제해사기구(IMO)는 60개 이상의 해사 관련 협약에 간여하며, 관할 협약을 내부 조직에 맞춰, 해양안전과 보안, 해양오염의 방지(환경보호), 책임과 보상, 기타로 분류

- 전후 해군조직의 전환으로 창설된 해상보안청이 현재 국토교통성의 외청으로, 「해상보안청법」에 따라 특별사법경찰조직 설립되었으며, 군사활동은 인정되지 않으나, 해난구조, 해양오염방지, 선박의 항행질서유지, 해상범죄 예방·진압·수사·구속, 교통규제, 수로·항로 표지 등의 해상의 안전·치안 확보 업무 담당

- 우리나라의 해양안전에 있어 가장 취약한 영역으로, 각 법에서 소형선박에 대한 안전관리 관련규정의 적용제외가 있어 안전관리상의 공백의 우려가 있으므로, 소형선박, 소형어선에 관한 안전관리가 강화될 필요가 있음

- 무선장치, 위치추적장치의 적용 제외선박에 대한 위험관리 강화와 관련 기술개발로, 고장 및 고의적 미작동행위에 대한 제재 등 통신장치의 미비로 인한 위험 증가에 대응할 필요가 있음

- 실제 해상사고 대응에 있어 선장의 역할이 매우 중요하다는 점을 감안할 때, 의무와 권한을 보다 명확히 하고 강화할 필요가 있으며, 제재관련기준도 행위의 위법성 정도를 염두해두고 합리적으로 설정할 필요가 있음
○ 관리 기관
- 해양의 안전관리와 관련하여 나라마다 군조직, 행정조직 형태로 설치하는지 여부가 다르며, 정책·집행에 있어서도 일원화된 형태와 분리된 형태가 있는데, 우리나라의 경우, 행정조직의 일부이면서, 정책·집행이 해양수산부와 해양경찰로 분리된 형태로 이루어지고 있어, 정책·집행에 있어 중첩 및 혼란이 야기될 여지가 있음

- 법제도 관련 정책연구에 있어 처음으로 소셜빅데이터 분석방법론의 적용을 통해 관련 주요 논점을 도출함

- The State of Secretary’s Representative (SoSRep) has independent jurisdiction and authority in case of maritime accidents. A team of volunteers are also on stand-by in case of maritime accidents. The Marine Accident Investigation Branch (MAIB) also maintains independent jurisdiction, allowing for an objective and thorough investigation into the causes and facts of any maritime accident.
○ Japan
- The Japan Coat Guard was established as a special law enforcement agency under the control of the Ministry of Land, Infrastructure, Transport, and Tourism in the post-War reorganization of the Japanese Navy. The Japan Coast Guard does not take on any military role, but is responsible for maritime rescue, prevention of maritime pollution, maritime traffic regulation, prevention of maritime crime, maritime criminal investigation, and other necessary maritime safety and security activities.
- Related legal frameworks include laws on maritime traffic, seamen, vessels, maritime accidents, waterways, shipping and port regulation, and fisheries. There are separate laws on smaller vessels, smaller fishing boat safety regulations, and operation of smaller vessels.

Because exemptions in existing legal frameworks create blind spots in safety regulations when it comes to smaller vessels, there is a need to strengthen regulations on small vessels and small fishing boats.
○ Communication
- There is a need to introduce stronger regulations and appropriate technical developments to better respond to threats posed by a lack, malfunctioning, or deliberate misuse of communication devices on vessels.
○ Captain
- Taking into account the fact that the ship’s captain plays an important role in maritime disaster response, there is a need to clarify the responsibilities and authorities of the captain, as well as penalties against any illegal actions.
○ Responsible Agencies
- Different nations take different approaches on whether responsible agencies should be under civilian or military control; and on whether to establish a single responsible agency or multiple agencies. In the case of Korea, the fact that regulatory responsibility is divided between the Coast Guard and MOF may cause redundancy and confusion in the establishment and administration of maritime regulation.
