1. The remarkable development of biotechnology helps man resolve the mystery of life. Since the first birth of test-tube baby in 1978, artificial insemination and the development of genetic manipulation led the success of animal cloning in1997. Finally the success of the first human individual cloning was published in Dec. 2002. Due to the concern about defamation of the dignity of man and confusion of identification, the human cloning may cause the disaster of our future. However, the development of biotechnology gives us the hope of resolving the lack of provisions and evergy and obstinate diseases. This study mainly examined the problems of human cloning and took a look about the existing laws and foreign laws, and teh attitude of international agreement in the light of human cloning. Then the need of prohibiting human cloning and its restrictive permission was discussed. 2. The human cloning can be divided largely into embryo cloning and individual cloning. The human individual cloning is a somatic cell nucleus replacement method that bears a new individual through the implantation in a matrix. It becomes the focus of ethical and religious criticism in view of human creation by asexual reproduction and defamation of the dignity and value of man. On the other hand, the human embryo cloning has been admitted as an epoch-making method. Such study as to produce cloning substitute organs or create a healthy cell using an embruo lover cell is in progress, but it is still in an early stage of its study and has not be verified. 3. Lide the IT industry, biotechnology is thought the golden goose. For this reason, some countries legalize the prohibitionof human individual cloning, while others open the possibility of permitting treatment cloning for their economic benefit. Such international agreements as the Agreement of Life and Human Fights by UN and the Declaration of Universal Human Rights by UNESCO have made the prohibition of human body international model Although several bills have been submitted to the National Assembly in Korea, they are drifting. We may have complex problems relevant to human clonig, gene information protection, life patent, or gene therapy in the near future. Although Korea is a barren land of the law of the biotechnology field,we are in urgent need of revising or enacting related laws. 4. Such criminal intervation in biotechnology technique should be put in action only for human's community life as the final means in accodance with the benefit and protection of the law and the principle of supplementation. A human cloning act may be discussed constitutionally in connection with the dignity of man, the freedom of research, embryo's life right, or the obligation of caring a patient. The human clonign deserves prohibiting because it infringes the dignity and value of man in accordance of Article 10 of the Constitution. However, the treatment embryo cloning not to aim at individual generation may have the possibility of permission through the sentence of each benefit considering it can make patients with fatal diseases hopeful about their life. Nobody assure how biotechnology is developed. In this situation, it is considereble to restrict gradually according to the growing of technology rather than to prohibit inclusively the human cloning by terms of methods without legal or ethical problems. In other words, it should be considered to impose administrative sanctions while confirming a crimianl prohibition target under strict procedure and national control. With the development of science, the regulation of human clonign is a very important issue to the future of criminal law. Thus, it should be reached an agreement and carefully legislated through sufficient social discussion.
