심지어 荀子儒를 중심으로 儒家內的 통합과 그 사상적 한계(=약점)를 극복하려 했던 「樂記」나 동중서의 인성론 속에서도 皇帝敎化論을 이끌어 낸 것이라든가, 賈誼의 인성론 속에서 성왕에 의해 제작되는 예악전장제도의 합리적 근거를 마련하고자 한 것도 이러한 문제들과 관계된 것이었다. 그리고 賈誼와 董仲舒가 法家의 法治를 수용하면서도 이를 儒家的 理想에 활용하고자 한 것도 엄밀히 말하면 이러한 사회·정치적 수요에 부응한 것이라 할 수 있다. 따라서 이들의 이러한 현상을 정치철학적이라 말할 수 있다. 왜냐하면 그 안에는 정치적인 문제들, 즉 중앙집권(=권력집중)과 권력분점(=지방분권), 황권제한과 황제절대권 옹호, 현실 정권의 정당성과 제국의 長治久安策 등의 주장들이 들어있기 때문이다.
본 논문은 이런 문제들이 동중서의 사상형성과 어떤 방식으로 연결되었는지를, 儒術獨尊이라는 주제에 초점을 맞추어 다루었다. 董仲舒 儒術獨尊의 가능근거를 크게 둘로 나누면, 첫째는 儒家 內적인 문제들이다. 戰國末-漢初에, 孟子와 荀子 철학의 본래적인 차이와, 각각의 한계(약점) 때문에 빚어진 대립·충돌을 통합하려는 ‘儒學의 改新趨勢들’이 등장한다. 이 추세들은 맹자와 순자의 人性論·工夫論의 차이를 인식하고, 양자의 장점을 수용하면서 그 차이를 최소화하여 유가의 사상통합을 지향했다. 秦과 漢初에 국가철학에서 배제되었던 전철과, 焚書坑儒와 挾書律 등의 수모가 이 추세의 저변을 형성했다. 그래서 이들은 또 황제 절대권 확립을 당시의 시대적 요청으로 인식하여 그것에 부응하고자 했다. 이러한 추세들을 󰡔禮記󰡕「樂記」편과 賈誼 및 董仲舒의 人性論을 위주로 살펴보았다.
「樂記」와 賈誼는 荀子적 인성론을 주로 하면서도 맹자 인성론을 통해 성인(=성왕)의 作禮근거를 확보하고, 또 일반인들의 타락가능성을 증폭시켜 교화설의 근거를 확보하고 있다. 그리고 동중서는 맹·순의 인성론을 보다 긴밀하게 절충했다. 그리하여 맹자 인성론의 장점인 도덕의 내재성을 수용하여(善質) 순자 인성론의 단점인 도덕의 외재성을 극복함으로써 성인의 作禮근거를 확보했다. 한편 그러면서도 또 맹자의 性善說을 비판하면서 사람들이 善質을 가지고 있지만 아직 善한 것은 아니라는 未善의 인성론을 제출함으로써 황제교화의 필요성을 주장했던 것이다.
둘째는 儒家 外적인 사상의 영향이다. 즉 陰陽五行說과 宇宙生成論(❶) 및 法家思想(❷)을 수용하고 발전·변용시킨 것이다. 이 중 ❶음양오행설과 우주생성론은 동중서 우주론의 상·하부 구조와 연결된다. 당시의 우주론은 황제를 중심으로 하는 封建等級秩序와 皇帝絶對權, 中央集權과 그 정당성과 밀접하게 관련되었다. 따라서 그 시대가 요구하는 이러한 문제들에 능동적으로 대처하기 위해서는 유가 내에 이러한 形而上學을 구축할 필요가 있었다. 이 때문에 동중서는 당시에 이미 유행하고 있던 陰陽五行說과, 道家나 黃老學派의 우주론을 수용하여 새롭게 재구성하였다. 동중서는 그 학설들에서 황제절대권과 중앙집권을 저해하는 요소들을 가능한 배제함으로써 시대적 요청에 충실히 부응했다. 그러면서도 이러한 과정을 통해 유가적 理想도 구현해 내었다.
동중서는 鄒衍 등 陰陽家가 발전시킨 五行相勝說(易姓革命의 정당성)과 五行相生說(천자의 自意적 행동이나 전횡방지)을 새 시대에 적합한 방향으로 변용시켰다. 당시는 이미 대통일왕조가 건설된 상태였고, 또 음양가가 말하는 五行相生의 時令·月令체계는 황권을 제한하는 것으로 판단했기 때문이다. 따라서 동중서는 오행상생관계를 父子관계로 묘사함으로써 왕권의 제한이 아닌 황권계승의 정당성을 설명하는데 사용했다. 또 이전에는 병렬적인 위치에 있었던 ‘土’(임금의 자리)의 위치를 돌출시킴으로써 황제의 위상을 提高시켰다. 또 五行相勝과 相生관계 역시 관료조직 내부의 권력상호견제와 책임소재를 묻는 방식으로 전환시켰다. 또한 五行相勝說을 三統說로 전환함으로써, 秦왕조의 정통성을 부정하고 漢왕조의 정통성을 공고히 구축하면서, 당시의 曆法개정의 수요에도 부응했다. 그리고 天人同型 구조에 근거한 天人感應說을 주장함으로써 한편으로 祥瑞를 통해서는 황제의 주체적이고 능동적인 작용을 추동하였고, 다른 한편으로 災異를 통해서는 그 失政에 책임을 물을 수 있게 하였다.(추연의 단점극복)
한편 동중서의 관점에서 볼 때, 이전의 󰡔管子󰡕4편과 󰡔淮南子󰡕 등의 思想은 많은 단점이 노출되었다. 특히 宇宙說에서 氣적인 작용방식이 가진 無意志·無目的·無造作적 특징의 문제, 또 無爲說의 문제, 또 황권을 인정하는 道(=임금)에서 사물(=신하)로의 전이과정 속에 깃든 권력분점의 위험성의 문제 및 道에서 만물로의 전이가 지닌 無意志나 無目的성 때문에 생긴 황권의 지속적인 보장결핍 등의 문제들이 인식되었다. 그리하여 동중서는 어떠한 조건과 상황 속에서도 황제절대권과 중앙집권 및 그 정권의 정당성을 절대적으로 옹호해 주기 위해 王權神授說의 보장처인 人格天을 요청했다. 또 그러면서도 당시의 迷信팽배현상에 제동을 걸기 위해 도덕이 투사(projection)된(도덕천) 자연천의 생성과정인 元氣宇宙生成論을 동시에 주장하게 되었다. 그러나 동중서는 이것에 그치지 않고 우주자연을 도덕적으로 해석함으로써 유가의 封建統治綱領(仁)과 倫理綱常(三綱五倫) 및 封建等級秩序(禮), 그리고 德治·禮治와 王道政治의 우주론적 증거도 확보하였다. 따라서 그가 구성한 인격천은 신앙을 위해서가 아니라 유가내적 수요와 사회·정치적인 수요에 필요하기 때문에 요청된 것이라 평가할 수 있다.
끝으로 董仲舒는 대통일 제국을 효율적으로 관리하는데 법이 필요했기 때문에 ❷법가의 성문적인 法(혹은 刑)을 유가에 수용했다. 그는 秦나라 멸망의 교훈 때문에 禮 절대주의를 지향하며, 황제로부터 백성에 이르는 봉건등급질서를 구축하는 禮治의 완성을 시도하는 가운데서도, 통일제국 통치에서의 法의 필요성을 인정하였던 것이다. 다만 그것의(法) 사용을 가급적 제한하여 예치의 보조적인 수단으로 활용코자 했다. 이러한 구조를 완성하는 데는 일정한 과정이 있었다. 즉 (1)秦나라의 唯法主義로부터, (2)賈誼의 ‘進攻時의 법과 무력위주의 정복전쟁도 인정한 상태에서, 守成時의 禮法兼施와 均衡을 고려한 禮主法輔를 주로 하면서도, 여전히 형세(勢)의 변화에 따라 禮를 主로 하기도 하고 法을 主로 하기도 하는 구조’를 거쳐, (3)동중서의 ‘어떤 상황과 조건에서도 변함없는 우주적 정당화로 인한 禮主法輔의 구조’로 발전해 왔다. 이들의 노력은 ‘어떻게 하면 진나라 이래의 嚴刑峻法 風土를 바꾸어 유가식의 덕치·예치구조로 전환할 수 있을 것인가’라는 고민에서 출발하였다. 특히 동중서는 이러한 문제의식에서 유가의 이상인 仁을 중심으로 動機主義를 강조하였고, 유가경전의 정신을 법해석에 적용하여 󰡔春秋決獄󰡕을 지었다. 그리하여 法을 儒家의 정신아래서 작동하게끔 했다.(法律 儒家化) 거기에 民生보장과 한나라의 長治久安의 보장이 있다고 여겼기 때문이다.

The purpose of this study is to examine the Han Dynasty Confucian hegemony, which was only made possible by the synthetical works of Dong Zhongshu(179-104 BC), from a politico-philosophical perspective.
From the end of the Warring States period to the early Han dynasty, society underwent a new phase in terms of politics and philosophy. During this period, according to the political demand of the newly unified empire, various forces and scholarship competed against each other for preemptive authority. The ideas and principles set out by each group are closely related to the societal and political demands they respectively faced: (1) the Qin Legalist school(秦法家) who maintained severe punishment and harsh laws(嚴刑峻法), and supported the absolute autocracy of the emperor, (2) Zou Yan’s Yin Yang and the Five Elements School who maintained Mutual generation and suppression between the five elements(五行相勝說 and 相生說), (3) The Cosmology of Qi-Hua (氣化宇宙論) conveyed in the four chapters of Guanzi(管子), which tried to comprehend the structure of the natural universe and actual society and the organization of humanity with a single system, (4) The dualism of Dao-Qi (道氣二元論) found in Huainanzi(淮南子), that tried to overcome the shortcomings of the Cosmology of Qi-Hua, (5) Dong Zhongshu’s theory of heaven(天論) and the theory on the formation of cosmos from the Original-Qi(元氣宇宙生成論) and etc.
Furthermore, the development of Yue Ji(樂記 Classic of Music) which aimed to integrate the various schools of Confucianism under the thoughts of Xunzi and to overcome the weak points of those ideas, or the fact that the theory of emperor's edification(皇帝敎化論) could be found even in the theory of human nature of Dong Zhongshu's, or that Jia Yi(賈誼), in his theory of human nature, tried to establish a reasonable foundation for the system of rites and laws which have been supposedly created by the sage-kings, are all associated with these kinds of problems. Also, even while Jia Yi and Dong Zhongshu accepted the Legalist school’s rule by the laws(法治), their application of it for the ideals of Confucianism, strictly speaking, was to satisfy the political demands of society. As such, their situation can be construed as politico-philosophical, because within those situations there were many political problems such as centralization vs. decentralization of power, absolutism vs. restriction of emperor's powers, and etc.
In this study, I focus on Confucian hegemony in order to see how these problems connect with the development of Dong Zhongshu’s philosophy. The available evidence of Dong Zhongshu’s Confucian hegemony can be split into the following two categories: The First kind is the problems internal to Confucianism. From the end of the Warring States period to the early Han dynasty, evident were the fundamental philosophical differences between Mencius and Xunzi and the conflicts that emerged due to the limitations of each thinker. There appeared a trend among scholars who were aware of the difference between the two schools' theory of human nature(人性論) and the theory of study(工夫論), but still aimed to integrate Confucian ideology by accepting the benefits of both and minimizing the differences. The elimination of Confucianism as a national philosophy during the Qin and the early Han dynasty period, such indignities like FenshuKengru(焚書坑儒, Burning of the books and burying of the scholars) and JiaShuJu(挾書律) formed the basis of this trend. Therefore, they recognized the demand of the time for an emperor with absolute power and tried to satisfy that request. These trends were examined by looking at the chapter of Yue Ji(樂記, Classic of Music) in the Li Ji(禮記, Classic of Rites) and Jia Yi(賈誼) and Dong Zhongshu’s theory on human nature.
Although the Yue Ji and Jia Yi mainly advocate Xunzi's theory of human nature, they also procure the basis for the establishment of rites by the sages through Mencius's theory of human nature. Moreover, they amplify the possibility of the corruption of the ordinary people and thus secure the basis of edification. Also, Dong Zhongshu compromised Mencius' and Xunzi's theory of human nature more intimately. As such, by accepting the strengths of Mencius's theory of human nature in regards to intrinsic virtue he overcame the shortcomings of Xunzi's theory of human nature in regards to external virtue, thus successfully securing the basis of sages's establishment of rites. Yet, while he criticized Mencius's view on ‘human nature as being originally good,’ he argued that although people are intrinsically good, this ‘good’ is not fully manifested, therefore he advocated the necessity of the emperor’s edification.

From the end of the Warring States period to the early Han dynasty, evident were the fundamental philosophical differences between Mencius and Xunzi and the conflicts that emerged due to the limitations of each thinker. There appeared a trend among scholars who were aware of the difference between the two schools' theory of human nature(人性論) and the theory of study(工夫論), but still aimed to integrate Confucian ideology by accepting the benefits of both and minimizing the differences.
