However, the legal system could not catch up with the development speed. This led to the uncontrolled development disregarding laws occurred frequently during this time. At the time, the building code was not strict as much as now. Thus, problems for the safety of buildings endlessly occurred due to the limits of building technologies and the illegal use of buildings. In the 1980s, the number of the buildings violating the building code sharply increased. Most of the buildings were difficult to be corrected for reasons such as financial ones, etc. Thus, the legalization bill was established and the 450, 871 rule violation buildings were legalized until June 30, 1985. But since the punishment was not severe even after violating the building code, there arose expectations that rule violation buildings would be legalized someday without correction even after the correction order. This led to side effects. For example, the client violated the building code after an approval for use as a building was complete. Such a violation has been continuously committed by the client without his awareness of illegality. This resulted in the damage to nearby residents and the unjust enrichment from the economic point of view. Additionally it led to being vulnerable to the safety of buildings, which was problematic at all times. According to the current status of the rule violation buildings, which have occurred in 25 autonomous regions of Seoul, more than 15,000 rule violation buildings are disclosed each year from 2010 to 2012. Most of these buildings are an unauthorized type aimed at increasing their area, which reach more than 10,000 in number. In recent years, the rule violation buildings increased by approximately 7.7% against 2011, gradually increasing each year. This study intended to review the institutional problems for breaking a repeatedly occurring vicious cycle that the enforcement is carried out through inspections and complaints when violations occur to buildings, followed by the complaint of the client and the corrective steps thereof. Thus, this proposed a measure for improvement aimed to promote the safety of buildings due to such unauthorized use of the buildings and to prevent the occurrence of direct and indirect damage to nearby clients as well as the disorderly order in a wide range. When a rule violation building is uncovered, the continuous and strong law enforcement is required until the correction is carried out under the building code. But if the administrative measure is insufficient, the client tends to violate the building code in defiance of the rule violation building even if he may get punished by law enforcement and can be at a disadvantage. It is because he expects to obtain economic interests in spite of that. A study reported that rule violation buildings were caused by various problems, such as architect service system, complexity of construction - related regulation system, reckless misconduct considering only economic benefits, difficulty in disclosure, limits of existing laws, lack of standards to impose enforcement fine, etc. The efficient measures derived in order to eliminate such problems are as follows: First, it is necessary to introduce a construction professionalized - public servant system for efficient, specialized services. For this, it is needed to place only professionally knowledged, qualified persons to government departments in the building construction field. Thus, they should be able to process architect acting services and promote the safety of buildings, which leads to improving the overall level of quality or performance of buildings. Second, complex construction-related laws and regulations should be streamlined. Acts applied to construction activities are diverse and complex, and different administrative departments are in charge. Thus, the contents are different and overlapping. To solve these problems, distributed laws should be integrated, organized, and simplified by abolishing and amalgamating them. Therefore, it is needed to simplify administrative procedures and unify departments in charge. In other words, it is important to proceed with the unification of windows for civil petitions and administrative departments, as well as to prepare items dispersed in several related laws as construction standards by creating standards appropriate for the rationalization of law contents. Third, it is required to raise the awareness of rule violation buildings through public advertising. The general public is very vulnerable to the awareness of a building violation, and lots of first clients tend to exploit this. Multifaceted ways, such putting public service announcements, distributing posters to agencies and posting them, etc. will allow the general public to easily distinguish the rule violation buildings visually. In addition, it will be difficultly for them to sell their rule violation buildings to the general public who have already recognized the violation. Thus, this measure serves as a means to prevent the primitive rule violation generation. Fourth, the authority of building instructors should be strengthened to ensure inspection and enforcement. The minimum right should be given to get a free access to the public space of buildings. Fifth, buildings to be legalized should be limited. The“Act on Special Measures for Specific Buildings Theorem”, periodically enforced by the government, is exploited by clients, which causes the deliberate violation. In the“Act on Special Measures for Specific Buildings Theorem”conducted periodically by the government in the future, the criteria should be limited to the approval date for the use of the target architecture and thus the time of the approval date for use will be specified. Then, the measure to legalize rule violation buildings will switch into the strong regulatory to ensure no more legalization of newly constructed buildings. Thus, it will primitively block clients’expectations for legalization as well as the result in the mass production of rule violation buildings. This finally will serve as an effect to prevent rule violation buildings. Sixth, standards should be strengthened to secure imposing enforcement fine. To this end, a new system should be introduced to impose the enforcement fine not only on the current client but also on the first client retained ownership registration. For rule violation building approved for their use after the period of the last legalization, the related law should be amended without limiting the number of impositions until the corrective order is fulfilled. Then, a greater improvement effect is expected in preventing rule violation buildings. In a situation where the efforts to abide to the laws for buildings are insufficient, the building code means a merely formal one. But if more powerful laws and regulations are equipped than the current ones, it will have a large effect on inhibiting the occurrence of rule violation buildings. Thus, this study consequently puts an emphasis on the need for continuous research and application for improvements regarding rule violation buildings.
