In line with the expansion of significance of nurses in the medical practice field, medical accidents relating to nurses have increased and medical suits against nurses have been on the rise. However, legal discussion on medical malpractice focuses on medical doctors, and the significance of medical malpractice of nurses has not been sufficiently recognized. Although nurses claim increasing healthcare responsibilities as employees of doctors or hospitals, the significance of nurses’ roles has not been stressed in comparison to doctors. Today, however, as nurses’ roles are emphasized as a part of important medical care provision, their medical malpractice liability is receiving greater attention. Thus, to further develop the nursing profession, legal discussion in this matter is necessary. Accordingly, this study summarized details of nurses’ role as specified in the Medical Service Act and special acts (Acts on the special measures for public health and medical services in agricultural and fishing villages, Mental Health Act, Tuberculosis Prevention Act, School Health Act, Administration and Treatment of Correctional Institution Inmates Act, etc.). The overall review on role, task and scope of permissible medical practice of nurses was made by categorizing nurses by type and the status of nurses was examined. Furthermore, comparative studies were made by sorting out roles, tasks, qualifications and medical practice scopes of nurses defined in the law from countries where independent law for nurses exist (Germany, U.S.A. and Japan), and the necessity of independent law for nurses in Korea was suggested. As for the medical malpractice liability of nurses, the review of previous studies and judicial precedents were analyzed. First, the conceptual definition of medical malpractice of nurses and its decision criteria were decided. It was followed by the theoretical studies on the liability component of medical malpractice of nurses. Based on the operational rule of nurses in the Medical Service Act, the medical malpractice has been classified by rehabilitation nursing, treatment assistance and public healthcare involvement to analyze related precedents in Korea, along with those in, Germany and Japan. Aforementioned study is expected to contribute in solving medical malpractice No.s for nurses with the following results in the areas relating to nurses’ medical practice, regulatory limitations on practice, and nurse related court rulings.
