LMOs의 잠재적 위해를 방지하고 바이오산업발전을 비롯한 LMOs편익을 극대화하기 위해서는 사전주의적 예방조치와 함께 사후적 구제조치를 얼마나 효과적으로 수행하는가에 달려 있다. 전자에 관하여는 LMOs의 국가간 이동 등에 따른 피해사고를 효과적으로 억제하기 위한 사전안전성심사체계와 표시제를 비롯한 의무준수체계를 엄격하게 운영하여야 한다. 이러한 국제적 의무준수체계는 LMOs의 안전성을 확보하기 위하여 사전적 규제에 초점을 두고 안전관리기준과 지침에 의한 행정규제방식으로 이루어지고 있다. 그리고, 후자에 관하여는 피해사고 발생시 신속하고도 적합한 대응조치와 피해사고에 따른 손해를 충분하고도 적절하게 구제 또는 배상할 수 있도록 공정한 책임 및 구제법체계를 마련하여 시행하는 데 있다. 물론, 사후적 구제조치보다 사고를 미연에 방지하는 사전대응의 방안이 보다 더 중요하다. 이 두 체계는 서로 분리된 독립적인 관계가 아니라 상호 유기적인 관계로 작동하는게 바람직하다. 그러므로 LMOs에 대한 엄격한 사전안전성 확보방안과 공정한 사후 책임 및 구제법의 마련은 LMOs의 잠재적 위해를 방지하고 손해의 공평 타당한 분담을 통하여, 국민의 생명과 건강 그리고 재산을 보호하고 환경생태계를 보존하며, 나아가 바이오산업의 건전한 발전을 구축하는데 있어서 두 가지 법적 기둥을 형성하고 있다고 할 수 있다. 기본적으로 LMOs의 잠재적 위해성으로부터 향후 피해가 현실화 될 때 공평 타당한 손해분배를 위하여는, 책임문제의 규명과 효과적인 피해구제방안에 대하여 국제적으로 구속력 있고 통일된 법적규율의 마련이 필수적이다. 그러나, 각 국가들의 책임 및 배상에 대한 법적체계와 배상책임법규정의 상이로 인하여, 추가의정서에 책임 및 배상절차를 규정하지 못하고 LMOs 관련 책임 및 구제에 대한 대부분의 중요한 핵심사항이 당사국의 국내법 결정사항으로 위임됨으로써, 불완전한 추가의정서로서 채택되었다. 그러므로, 국가간에 분쟁해결의 준거법이 될 책임 및 구제법은 통일된 규칙과 절차를 마련하지 못하여 국제적인 민사책임규범이 부재한 상태에 있다. 현재 우리나라는 LMOs의 사전안전성을 확보하기 위하여 국내이행법으로 사전대응의 원칙을 규범화한 LMO법과 위해성심사기준을 마련하여 2008년 1월 1일부터 시행하고 있으나, 사후적 책임 및 구제에 대한 국내이행법으로서의 입법체계는 아직 마련하지 못하고 최근 검토단계에 있다. 따라서 향후 추가의정서의 비준과는 별개로, 국내 책임 및 구제법 입법시 현행 책임법체계의 한계와 문제점을 극복할 수 있는 중요한 입법사항을 반영하여 국내 이행법으로서 책임법체계를 갖출 필요가 있다. 본 논문은 LMOs로 인한 피해가 현실적으로 발생하였을 경우, 그에 대한 법적책임과 공평타당한 피해구제를 위하여는 LMOs 피해의 특수성을 고려하여 위험책임법리에 기초한 책임 및 배상체계로서 특별법의 도입방안을 마련하는 데 있다. 그리고 책임 및 구제에 관한 입법체계는 환경관련법과 유사한 형식의 입법체계가 바람직하다고 생각된다. 즉, 환경관련법의 체계와 같이 기본법과 개별환경법 형식으로 입법체계의 정당성을 갖추면 각 법률의 입법취지와 목적을 명확하게 할 수 있으며, 법률적용을 효과적으로 할 수 있어 정책당국과 법률이용자 관점에서 적합성이 있다. 따라서, 현행 ‘생명공학육성법’을 ‘생명공학기본법’으로 개

A B S T R A C T A Study on the Domestic Legislation about Liability and Redress relating to LMOs Damages by Kim, Young-won Department of Law Graduate School Korea National Open University (Supervised by Professor : Cho, Sung-Hyun) LMOs appearing with the development of modern biotechnology are expected to give infinite economic and social advantages to mankind and environment. However, because of the fundamental limitation of biotechnology, some people speak out the potential possibility of harm and safety issues that LMOs have; they emphasize negative effects on human health and on conservation and sustainability of biological diversity. Thus, LMOs Parties have diversely tried to integrate methods from a safety point of view involving environmental issues, which resulted in the official implementation of the Cartagena Protocol on Bio-safety as the Agreement of Convention on Biological Diversity. After that, the Supplementary Protocol on Liability and Redress to the Cartagena Protocol on Bio-safety was completed and adopted in the COP-MOP5. The adoption of the Supplementary Protocol indicates that international laws related to LMOs and about the liability and compensation to the damaged are established. The Bio-safety Protocol based on the Convention on Biological Diversity enacts ex ante compliance system of the duty and the Liability and Redress as ex post response measures to secure domestic execution. To prevent potential harm and maximize the benefits of LMOs comprising the bio-industry are dependent on how effectively not only the ex ante but ex post measures are carried out. It is desirable that these two systems are operating not independently of each other but organically. Therefore, the establishment of the precautionary measures of ensuring safety and that of response measures such as the law of the Liability and Redress are able to ward off the potential danger of LMOs. Also, providing parts of responsibility about damages fairly helps protect the people’s lives, health, and properties and preserves ecosystem as well as forms the legal basis of building firm basis for bio-industry. In order to distribute damages caused by the latent risk of LMOs, it is necessary for the government to establish international binding effect by setting unified legal regulations of the Liability examination and Redress for damages. However, one was not able to prescribe procedures of responsibility and compensation to the Supplementary Protocol because of the difference among all countries' legal systems and compensation rules. Then incomplete Supplementary Protocol was adopted by entrusting each Party with legislating its own Acts about the LMOs Liability and Redress laws. Consequently, no civil liability rules exist on an international level because nations do not agree with the integrated Liability and Redress for solving international strife as the governing law. Korea has been looking forward to introducing institutions according to the ex ante principles so as to keep precautionary safety and has conducted LMO law and risk assessment since 2008. 1. 1, but the ex post Liability and Redress laws are not enacted yet, which are currently under examination. Thus, when domestic Liability and Redress laws are legislated regardless of the ratification of the Supplementary Protocol, having the Liability legal system as an internal executive law is necessary to overcome the limit and defect of current legal system of the Liability laws and reflect important issues of legislation. In order that legal liability and compensation are fairly provided, one could think the enactment of the Special Law as Liability and Compensation systems, which requires someone to take responsibility for the dangers in consideration of the peculiarities of the damages, resulted from LMOs. On the other hand, arranging the legislative system and ways of both substantive law and adjective law is important, because it is expected that international conflicts concerning accidents according to trans-boundary movements will increase in the future. If each country solves the problem using its own judicial proceedings of the Redress, it will meet with different consequences of responsibility and compensation about the same LMOs case. In other words, in the light of LMOs accident's specialty, the negative effects might be given rise to the solution through existing rules of international jurisdiction. Therefore, applying to international conflicts the solution through Alternative Dispute Resolution such as mediation and arbitration is considered. As a result, our society, by properly legislating domestic legislation of the Liability and Compensation and preparing Dispute Resolution early days, is able to keep our life, health, and property from latent dangers, to make biotechnology develop consistently, and to contribute to the conservation of the biodiversity and sustainable uses of LMOs resources.
