The Cameroonian legal system is the continuity of what was brought into the country during colonialism, by the different colonial authorities. That is, Common law by the British and Civil law by the French. Hence, dual Colonialism in the past set up the foundational development for the coexistence of common law and civil law in the country, sometimes term'' bijuarlism''. From this, Cameroon appears to be a sui-generis country in Africa and among the few in the world in terms of legal systems. In this respect, the Cameroon legal system provides an excellent example of a comparative law melting pot, with the manifestation of certain characteristics that shows up when two, often divergent legal systems, the English common law and the French civil law are convened. Furthermore, the present of common law and civil law in the country serves as an important area of research for legal scholars, among whom are Vernon V. Palmer in her book entitle ‘' Mixed jurisdictions worldwide'' classifying Cameroon under a family of mixed jurisdiction because the foundation of its legal system is built on dualism and the dual foundation is noticeable to outside observers where the common law applies to the Anglophone regions and the civil law to the Francophone regions which are common phenomena for countries with a legal system of a mixed jurisdiction. This study of Cameroon bijuarlism analysis its distinctive peculiarities experienced in a mixed jurisdiction.
The aim of this paper is to examine and analyses some of the problems faced due to the ineffective harmonization of the Cameroonian legal systems (Common and Civil Law system) in the context of developing and establishing home grown laws and supranational laws, with the latter been at the regional level like the modernization and harmonization of business law among other states in Africa. This business law (OHADA law) automatically applies to both regions (the civil law and common law region). The home grown Laws involves unifying the principles and rules of common law and civil law. The reason was to put the final nail on the coffin so as to complete the reunification of the former west and East Cameroon, with harmonized business Law aimed at attracting foreign investors both to Cameroon and Africa as a whole who are willing to invest and carry out business transactions. Because most foreign investors believed that the laws of Africa countries are unsatisfactory, thereby influencing judicial decisions. Due to the improper manner of harmonization of these two different inherited legal systems in the country, certain problems standing as a hindrance to the continual existence of this uniform national and supranational law has been noticed, with the impact felt more on the interpretation and application of this harmonized laws. The various attempts to formulate such legislation, or to unify or at least harmonize some of the applicable received foreign laws, had created problems because of the complications that spring-up. According to the common law legal scholars, their civil law counterparts orchestrated the harmonization in order to downplay the common law practice in Cameroon. For that reasons, there has been some struggle by the Anglophone Lawyers to protect common law in their respective district. Therefore, this paper will address the problems faced by these uniform national and supranational laws as a result of the harmonization of the received foreign laws. Recommendation to measures that can bring about future prospect for any harmonized laws whose application and interpretation will be free from these flaws will be provided
