본 논문 제 I.장 서론에서는 연구의 필요성과 목적, 그리고 그 범위와 방법에 대해 간단히 살펴본 후, 제 II.장에서는 검찰개혁의 의의와 방향에 대해서 알아본다. 제 II.장 제1절에서는 검찰개혁의 필요성에 대해 알아보았다. 대한민국 검찰은 막강한 권한을 가지고 있는데 부정부패비리 수사에 있어서 검찰이 정치적인 영향력을 받아 불기소처분하기로 한다면, 또는 죄가 없을지라도 기소를 해서 무고한 이를 억울하게 누명 씌운다면 이는 검찰권력을 남용하는 것이 된다. 이는 국민의 기본권 침해로 이어지고 국민주권주의에 기초한 자유민주주의의 근간을 해칠 위험이 있다. 그럼에도 검찰은 대한민국 중요 권력을 장악하다시피 하고 있는데, 이 폐단을 해소할 수 있는 길은 검찰개혁에 달려있기에 그 필요성이 강조되고 있는 것이다. 검찰개혁은 ‘국민의 정부’ 때 최초로 시도되었는데 성과는 적었고 제도화에도 실패하였다. 그 후 ‘참여정부’ 때에는 ‘국민의 정부’ 때에 비해 많은 성과가 있었다. 그 성과로는 검찰권력을 견제하는 방안과 검찰의 정치적 독립성을 보장하는 방안이었다. 하지만 권력의 순화, 분산과 견제를 위한 시스템의 구축, 정검유착의 종언 등을 달성하는 것에는 실패하였다. 법률적 근거를 갖는 법치주의 통치를 원했던 지난 민주화 20년 동안 검찰권력은 역설적으로 크게 성공해 나가 정권과 대등한 위치로까지 성장하였는데, 이 비대화된 검찰권력은 권한 남용 문제로 이어져 문제점을 드러내기 시작했던 것이다.
제2절에서는 검찰개혁이 나아갈 방향에 대해 모색해 보았다. 검찰권력이 민주주의의 근간을 훼손할 위험을 없애는 방안, 즉 검찰권한의 분산과 견제를 위해 외부적 통제를 가하고 권력을 분산하고 축소하여 권력의 비대화를 완화하는 방법에 대해 알아보았다. 검찰권력은 인간 기본권 침해에 직접적 영향을 미치므로 객관적이고 공정하고 투명하게 견제되어야 생명과 신체의 자유가 수호되는 것이다. 이를 위한 방안으로는 첫째, 검찰 권력에 대한 외부적 통제이다. 이는 검찰의 구조 자체를 개혁하기보다 기존 권한을 인정하고 대신 검찰권력이 남용되지 못하도록 통제하는 외부적 장치를 둠으로서 그 문제점을 보완하는 것이다. 둘째, 권력을 분산하는 방안이다. 이는 그 거대한 권한의 일부를 다른 기관에 나누어주는 것을 말한다. 과거에 검찰은 군사정권이라는 정치권력에 봉사하다가 그에 알맞은 ‘검사동일체’ 라는 개념을 만들어냈고, 그 후 민주화 되면서부터는 자본권력과도 공생의 길을 모색해왔는데 이는 과거사 청산의 과제이지만 이를 감시하거나 견제하는 또 다른 국가기구가 별로 없었기에 이 문제를 해결하기 위해 집중된 권력을 분권화시켜 권한을 나누어 분산시키고 감시하고 통제하자는 것이다. 이러한 외부적인 통제 그리고 권한분산과 관련한 검찰개혁의 중요 과제를 살펴보면, 단연 ‘정치적 중립성’ 과제이다. 제2절에서는 이 중립성을 위한 방안들에는 무엇이 있는지를 알아보았고 이 정치적 중립과 관련해 생기는 문제점들도 지적해보았다.
제3절에서는 검찰개혁의 원인이 된 고위공직자들의 부패·비리의 개념과 현황에 대해 살펴보았다. 고위공직자부패의 의의가 무엇인지 그 범위와 개념과 유형에 대해 알아보았고, 고위공직자의 부패비리 현황을 파악할 수 있는 방법에 대해 잠시 살펴보았다. 그리고 고위공직자 부패비리와 관련한 문제점과 개선방안에 대한 바람직한 방향을 간단히 제시해 보았다.
제 III.장에서는 주요국의 공직자비리수사기구와 그 권한들에 대해 알아보고자 외국의 사례들을 논의해 보았다. 외국의 공직자비리수사기구를 살펴보면, 각 국가만의 ‘법적 전통’과 ‘사회문화적 특성’에 따라 그 소속도 형식도 저마다 다르다. 그러나 외국의 독립수사기관 역시 우리나라와 마찬가지로 정치권과 행정권에 대한 불신에서 시작되었고 정치적 영향력으로부터 독립된 기관 설치를 통해 국민의 기본권을 보장하고 업무적 전문성을 가지고 공정성과 중립성을 담보하고자 하였다는 공통점이 발견되었다. 제 III.장에서는 각 국가별 법적 전통이나 형사사법 배경을 먼저 알아본 후, 대륙법계 국가의 공직자비리수사기구, 영미법계 국가의 공직자비리수사기구로 나누어 검토해 보았고, 우리나라와 비교하여 공수처가 나아갈 방향을 모색해보았다. 또 위 외국 기관들에 대해 비판적 시각에 대해서도 고찰해보고 이 외국 기관들이 우리나라와 비교법적 검토대상이 될 수 있는지의 당부당에 대해 알아보고 이를 통해 공수처 성패여부를 가늠해보는 것이 합당한지도 지적해보았다.
제 IV.장에서는 우리나라의 고위공직자비리 수사를 위한 독립수사기관을 설치하는 것에 대해 서술하였다. 제1절에서는 과거 공직자부패 수사기관 즉, ‘대검찰청 중앙수사부, 부패방지위원회{국가청렴위원회}, 국민권익위원회’의 역할과 성패여부에 대해 조명해본다. 제2절에서는 기존의 독립 특별수사기관으로서의 우리나라 특별검사제도의 현황과 의의, 헌법 합치성 등에 대해 살펴보았다. 그리고 한시적 특별검사제 및 상설 특별검사제와 관련한 문제를 각각 알아보고, 마지막으로 현재 시행되고 있는 한시적 특별검사제의 한계와 문제점들, 그리고 이 때문에 새로이 등장하게 된 공수처와 이 기관의 실효성 확보 방안에 대해 서술하였다. 제3절에서는 독립수사기관 즉 공수처 신설과 관련한 그동안의 입법추진과정과 장단점에 대해 논의해보았다. 공수처 법안과 관련한 입법추진과정의 연혁별 현황, 그리고 그간의 도입 논의와 관련한 쟁점들, 즉 찬성론과 반대론의 입장을 각각 검토해보았다. 제4절에서는 2017년 국회제출 공수처 설치 입법발의안 및 입법청원안을 비교 검토해 보았다. 가장 최근 2017년 ‘법무·검찰개혁위원회’가 발의한 「개혁위안」과 법무부 자체방안인 「법무부안」을 ‘규모, 권한, 권한의 제한, 관할권, 관할권 경합, 구성’ 등등으로 나누어 서술하였다. 제5절에서는 공수처 신설 방안에 관한 보완적 사항을 제시해 보았다. 첫 번째로 공수처의 법적인 검토를 통해, 법률에 의해 고위공직자범죄수사처를 설치하는 방안, 그리고 헌법 개정에 의해 고위공직자범죄수사처를 설치하는 방안에 대해 나누어 그 소속과 관련한 문제점들을 비교 검토해보았고, 마지막으로 사회적 합의 추진으로 시작해서 법적 지위보장까지 어떠한 노력들이 있어야 하는지를 모색해보았다.
제 V.장 결론 부분에서는 주권자인 국민을 지키기 위해 존재하는 국가와, 인간의 존엄을 지키기 위해 존재하는 법의 가치에 대해 고찰해보았다. 법집행은 정의실현을 위한 ‘최후의 수단’으로 조심히 사용되어져야 한다는 것을 시작으로 검찰권의 남용으로 공정성·객관성·투명성을 잃고, 정치적으로 중립을 지키지 못하는 것이 인권 문제와 어떤 상관관계를 가지는지 지적하였다. 헌법의 핵심이자 유엔 등 국제사회가 함께 수호하고자하는 전 인류적 가치인 인권은 검찰도 당연히 수호해야 하는데 이것이 지켜지지 않는 경우 결국 권력가와 금력자에 대한 봉사와 특혜로 이어져 이는 바로 부패비리로 연결되어지는 폐해를 낳는다. 결론에서는 이러한 폐해를 해결하기 위한 노력들을 살펴본 후, 무엇보다 검찰 활동에 대해 국민의 목소리가 반영되고 능동적이고 직접적인 참여가 보장되어야 한다고 주장하였다. 그래서 국민, 고위공직자, 검찰이 상호 불신을 버리고 서로 신뢰하게 될 때, 그리고 공수처가 부패수사기구로의 제 역할을 다 할 때 자연히 국가경쟁력이 높아질 것이고, 권력은 국민에게 봉사하고 국민은 민주 국가의 주인으로서 자신의 역할에 최선의 노력을 다 하게 되어 이는 국력의 증대라는 국가발전으로 이어질 것임이 확실하다는 결론으로 마무리 지었다.

Korea has made several attempts to reform the prosecution. Key tasks of the prosecutorial reform are to maintain political neutrality of the prosecution and come up with measures to distribute and monitor the authority of the prosecution. The background of the prosecutorial reform has been always involved in power-related corruption cases. The corruption of high-ranking officials, namely people in authority, is called ‘power-related corruption’ which can cause a national crisis because of its huge impact on our society. In the past, the collusion between politics and business was typical, and it was particularly customary for astronomical amounts of money to be used for presidential elections. As such, power was quite interchangeable with wealth, and a democratic political system is bound to conflict with a capitalist economic system, which led politicians to turn away from the interests of the public and serve business leaders with economic power and eventually caused a crisis of democracy. This is why claims for the establishment of ‘Criminal Investigation Agency of High-Ranking Officials (hereinafter referred to as ‘CIAHO’)’ have been stronger. It is also because there has been criticism of the prosecution that does not observe neutrality, fairness, and objectivity in ‘power-related corruption’ cases in terms of ‘biased investigation, targeted investigation, easy-going investigation, protecting its own members, and overlooking chaebol’s corruption’, and there has been the necessity of an independent investigation agency such as CIAHO as an institutional device to check and control abusive exercises of the prosecution’s powerful authority (investigative rights, right to request a warrant, executive power, right to prosecute, exclusive right to prosecute, discretionary power to prosecute, etc.).
The introduction, Chapter I. of this thesis, briefly deals with the necessity, the purpose, scopes and methods of study and in Chapter II. it discusses the significance and the direction of the prosecutorial reform. Section 1 of Chapter II. handles the need to reform the prosecution. Given prosecutors in Korea have mighty power, it is abuse of the prosecutorial power when the prosecution determines a non-prosecution disposition in its investigation into a corruption case, as a result of political influence, or when an innocent man is indicted on a false charge. This leads to violate a basic right of the people and can harm the basis of a liberal democracy based on sovereignty of the people.
