As the real estate environment has been changed and information technology has been developed, convergence and integration between industries have been implemented and real estate services have been greatly affected thereby. And, as the consumers want advanced high-quality service of the smart real estate era past the real estate era of legwork, may changes are occurring in the real estate services industry. Therefore, it is becoming necessary to remove the barriers between the business worlds consisting of individual business worlds such as development business, parceling-out business, leasing business, management business, broking business, appraisal and assessment business, etc. and qualitative growth as well as quantitative growth of the real estate services industry are needed now. To keep pace with such trend, the government enacted and enforced the Act on the Promotion of Real Estate Services Industry (Act No. 15276, Enactment Date: Dec. 19, 2017; Enforcement Date: Jun. 20, 2018). The purpose of this Act is to promote the development of the real estate services industry and contribute to the improvement of the convenience of people, creation of quality jobs, and sustainable development of the national economy, by prescribing the matters necessary to provide a foundation for, support, and foster the real estate services industry. According to this APRESI; (1) The Minister of Land, Infrastructure and Transport shall formulate an implement a master plan for promotion of the real estate services every five years to promote the real estate services industry. (2) The Government may formulate and implement policies on convergence an integration of the real estate services industry with related industries, such as the information technology industry, financial industry, logistics industry, and spatial information industry to create new industry and enhance consumer convenience. (3) The Government may provide financial, administrative, and other necessary support to real estate service providers for the development of the real estate services industry. (4) The Minister of Land, Infrastructure and Transport may conduct a fact-finding survey on the real estate services industry to collect baseline data and compile statistics necessary for promoting the real estate services industry. (5) The Minister of Land, Infrastructure and Transport may formulate policies for the fostering and management, etc. of professional manpower in the real estate industry and designate a professional training institute to conduct education and training. (6) The Government may conclude agreements with public institutions, universities, private organizations, and companies to conduct research and development projects necessary for developing the real estate services industry. (7) The Minister of Land, Infrastructure and Transport may certify excellent real estate service providers to foster a high value-added real estate services industry and enhance consumer convenience. (8) In order to promote international cooperation and global market expansion of the real estate services industry, the Government may support exchanges of related technologies and personnel, exhibitions, joint research and development projects, etc. (9) It has been prescribed that the Minister of Land, Infrastructure and Transport may provide the support such as providing outcomes of research and development projects in the real estate services industry in order to facilitate starting a business by small and medium enterprises and to promote the growth and development of founders of the real estate services business. However, there have not been many examples of legislation such as the Act on the Promotion of Real Estate Services Industry in the world, and I am doubtful about the direction and effectiveness. Thus, a research to extract any problems of the Act on the Promotion of Real Estate Services Industry and present improvement plan for the Act by studying the status and legislations of the real estate services industry and the examples of major countries is needed. In this study, I presented the direction of the improvement by analyzing the key matters of the Promotion Act and how many issues required in the promotion have been accepted, emphasized the necessity of the amendment of the Act, and presented the amendment (plan) of the Act on the Promotion of Real Estate Services Industry and amendment (plan) of the legislations related with small and medium enterprises for promotion of the real estate services industry. The amendment (plan) for the Act on the Promotion of Real Estate Services Industry has been classified into reestablishment of the concept of real estate services, amendment of the policy to promote the real estate services industry, amendment concerning establishment of the foundation for the real estate services industry, amendment concerning vitalization of the real estate services industry, and amendment for stabilization of the real estate services industry. Specifically, I emphasized the effectiveness of the Promotion Act by suggesting amendment of the definitions for the real estate services, introduction of the concepts relating to the convergence and integration real estate services industry, materialization of the plan for promotion of the real estate services industry, fostering and support of the convergence and integration real estate services industry, preparation of the grounds for tax benefit and financial support, support of fostering and management of professional manpower, introduction of the regulations for promoting employment of professional manpower, support for research and development of the real estate services industry, vitalization of and reinforcement of support for certification of excellent real estate service providers, introduction of the regulations for vitalization of electronic contract, support of budget for international cooperation and overseas expansion, reinforcement of support for starting up of the real estate services business, fostering of the organizations for service stability and consumer protection, and introduction of the alternative dispute resolution (ADR). I also proposed the matters concerning reorganization of the legislation including amendments for the Small and Medium Enterprises Promotion Act, Special Act on Support for Human Resources of Small and Medium Enterprises, Act on the Fostering of Self-employed Creative Enterprises, Restriction of Special Taxation Act, Restriction of Special Local Taxation Act, and Specialized Credit Finance Business Act, which are the legislations related with promotion of the real estate services industry.
