한국 영화와 대중가요, 드라마 등 이른바 ‘한류콘텐츠’의 관심이 세계적으로 확대되면서, 한국 대중문화의 원형(元型)에 대한 관심 또한 커지고 있다. 국내에서는 최근 지상파 주요 방송사를 중심으로 과거에 제작된 방송프로그램을 활용하여 ‘아카이브 콘텐츠’ 제작이 잇달아 늘어나면서, 시청자들이 방송·영상콘텐츠를 단순 재시청하는 것에서 더 나아가 연구·교육·창작 등을 위해 적극적으로 활용하고자 하는 수요도 꾸준히 증가하고 있다. 이처럼 방송·영상콘텐츠 2차 활용에 대한 대·내외적 수요에도 불구하고, 지금까지 제작·편성된, 그리고 현재도 만들어지고 있는 방송·영상콘텐츠를 공공 차원에서 수집하고 관리·활용하는 제도는 부재한 상황이다. 반면, 글로벌화·상업화되고 있는 미디어 시장에서. 지상파 주요 방송사들은 각 사가 2000년대 중반을 전후하여 구축한 사내 아카이브를 배타적으로 활용하여 자사 수익을 창출하기 위한 전략을 지속적으로 고민하고 있다. 본 연구는 이와 같은 정책적 공백(空白) 상황에서 시작되었다. 본 연구에서는 지금까지 경제적 의미의 저작권 거래 대상으로만 인식되었던 방송·영상콘텐츠를 문화유산으로서 인식하고 이를 보호하기 위한 방안을 모색하고자 했다. 이를 위해 본 연구에서는 방송·영상콘텐츠 외에도 시청각 유형의 공공기록물, 영화·공연예술·시각예술 분야의 예술작품과 해당 작품 관련 시청각자료, 박물관·도서관·미술관 등에서 관리하는 사진·음성·동영상 자료, 인문학 및 사회과학 연구 과정에서 생산되는 질적 연구자료 등 다양한 범주의 콘텐츠를 포괄하는 개념으로 ‘공공영상문화유산(Public Audiovisual Heritage)’이라는 새로운 개념을 도입할 것을 제안하였다. 본 연구에서는 이러한 다양한 영역 중에서도‘방송·영상 디지털아카이브센터(2000-2006)’폐관 이후 정책적 공백 상황이 가장 오래 유지되고 있는 방송·영상 분야에 초점을 두었다. 영상을 문화유산으로써 국가적 차원에서 멸실·훼손·변형 위기에서 보호하고 관리하기 위한 체제와 제도, 정책 등은 1980년대 이후 유네스코 회원국들을 중심으로 구체화 되고 있다. 이에 따라 본 연구에서는 ‘영상문화유산’보호 체계 마련을 위한 세계적 흐름을 파악하고, 1990년대 후반 이후 유네스코와 유럽·영미 지역 영상선진국을 중심으로 수행된 관련 연구를 통해 ‘영상문화유산’의 개념과 정의, 범주가 무엇인지, 그리고 이를 관리하는 법률·제도·정책 등을 마련하는 방안은 무엇인지 검토했다. 국내에 새로 도입해야 할 개념인 ‘공공영상문화유산’이란 ‘국내 제도와 산업 영역의 콘텐츠 중에서 이미지와 소리를 이용해 공중(公衆)에 특정한 사상이나 감정, 정신 등을 전달할 목적으로 생산, 배포되었고 해당 영상물을 시청 또는 청취한 불특정다수에 어떠한 영향을 미치는 사진/영상/음성콘텐츠와 이를 재생하기 위한 유·무형 장비, 매체, 문서, 지식정보 일체’라고 정의하였다. 하나의 영상은 제작-유통-소비의 과정을 거치면서 다양한 기관과 집단의 행위에 대한 증거이다. 따라서, 본 연구에서 정의한 ‘공공영상문화유산’의 정의는 공중에 노출된 다양한 시청각 유형 기록이 갖는 기술적, 문화적, 역사적, 산업적 측면을 고려한 용어이다. 이러한 개념 정의를 토대로 국내에 ‘공공영상문화유산’아카이브를 구축한다면 방송·영상컬렉션을 어떻게 수집하고 관리·활용할 수 있을지 고민했다. 국내 현황과 주요 이슈를 살펴보기에 앞서, 방송·영상 분야 ‘영상문화유산’관리를 위해 제도화된 5개 해외 국·공립 기관(프랑스 INA, 영국 BFI, 미국 의회도서관 AAPB, 호주 NFSA, 벨기에 Meemoo) 사례를 탐색했다. 해외사례 조사 결과 국내에서 참고할 수 있는 시사점은 각 기관의 설립형태나 법적근거는 서로 다르지만, 각국이 운영하는 국·공립 영상아카이브 기관과 방송사 간의 협력적 파트너십을 기초로 컬렉션 수집·관리하고, 대국민 서비스를 제공하고 있다는 점이다. 또한 각 기관은 수집된 방송·영상 컬렉션의 영구보존(Preservation)과 콘텐츠 접근권 보장(Providing Access)이라는 2대 대기능을 위해 운영된다는 점도 국내에서 참고해야 할 시사점이다. 따라서 수집된 모든 콘텐츠는 궁극적으로 대국민 서비스 대상이 되며, 저작권자와의 콘텐츠 이용 협의 사항에 따라 서비스를 제공하는 시점은 차별화한다. 이는 보안이나 비밀유지 등을 위해 일부 기록물에는 공공의 접근을 제한할 수 있는 행정문서 아카이브 제도와 다른 공공 영상아카이브만의 특수성이다. 이에 따라, 본 연구에서 조사한 해외 기관들은 수집된 콘텐츠의 저작권자와 콘텐츠에 출연한 출연자 등의 권리를 안정적으로 보호하는 제도를 마련하고 있다. 이와 같은 해외 사례가 적용되기 힘든 국내 상황을 확인하기 위해, 지상파 주요 방송사의 사내 아카이브 구축 경과와 콘텐츠 활용 현황을 살펴보았다. 주요 지상파 방송사(KBS, MBC, SBS, EBS)들은 2000년대 중반부터 HD제작시스템을 도입하며 디지털아카이브를 구축했으며, 사내에서는 내부 직원이나 각 사 콘텐츠 제작을 목적으로 한 구축된 아카이브가 적극적으로 활용되고 있다. 일부 방송사들은 저작권 판매가 가능한 아카이브를 구축해 서비스 플랫폼을 운영하고 있거나(MBC), 특정 부서나 자회사를 통해 시청자가 필요로 하는 콘텐츠를 판매(KBS, SBS)하기도 한다. 그리고 조사한 방송사들은 대체로 ‘클래식콘텐츠’에 특화된 유튜브 채널을 개설하고 과거에 제작된 콘텐츠를 재가공하여 업로드한다. 국내에서도 본 연구에서 고민한 방송·영상콘텐츠 대국민 서비스를 위한 몇 가지 정책이 수립·추진된 바 있다. 본 연구에서는 ‘한국방송영상산업진흥원’의 ‘디지털아카이브 센터(2000-2006)’, 과학기술정보통신부의 ‘K-콘텐트사업(2016-현재)’, 한국정책방송원(KTV)의 ‘개방공유포털서비스(2020-현재)’의 구축경과를 조사하고, 지금까지 추진된 정책의 문제점이 무엇이었는지 확인했다. 그 결과, 주요 방송사업자와의 협력체계를 안정적으로 마련하고 지속적인 아카이브 운영계획을 수립·실행하는 것이 매우 중요하다는 점을 알 수 있었다. 본 연구에서는 심층인터뷰를 통해 방송·영상 현업 분야에서, 그리고 문화정책 분야에서 일해온 응답자들의 의견을 수렴하고, 일반인·대학(원)생·교육직·전문직 등 다양한 직업과 연령을 가진 200명의 이용자 설문조사를 통해 현재 ‘옛날 방송콘텐츠’ 이용행태와 공공 차원의 아카이브 플랫폼 필요성에 대한 인식을 조사했다. 본 연구는 이러한 과정을 거쳐 방송·영상 콘텐츠가 문화유산으로서 갖는 특징과 가치에 대해 방송·영상 콘텐츠 제작자와 시청자들의 의견을 탐색했다는 점에서 연구 의의를 찾을 수 있다. 두 조사 결과, 방송·영상콘텐츠는 주제와 기획의도, 제작 환경 면에서, 그리고 그것을 표현한 매체와 기술 면에서 다음 세대에 전승해야 할 다양한 내용과 가치를 담은 콘텐츠를 반드시 ‘문화유산화’해야하는 점을 알 수 있었다. 두 조사 결과 ‘공공 방송·영상컬렉션’구축에서 가장 중요한 수집 대상은‘지상파 주요 방송사(KBS, MBC, SBS, EBS)의 콘텐츠’와 ‘공적 재원이 투입된 콘텐츠(제작지원사업 콘텐츠)’, 그리고 ‘『방송법』에 의한 허가·승인 대상 사업자의 콘텐츠’임을 확인했다. 이와 같은 수집대상을 확보하는 수집방법과 서비스 방안, 연구·창작 목적으로 서비스 되었을 때 예상 가능한 이슈와 이를 해결하기 위한 선결 조건이 무엇인지 알아보았다. 또한, 두 조사 결과 ‘공공 방송·영상콘텐츠’ 활용 차원에서는 관련 현업 종사자들이 ‘유튜브’에 의존하다시피 콘텐츠를 검색하고 있으며, 그런데도 지금까지 국내에서 제작·편성·방영된 콘텐츠에 대한 망라적인 목록 확인이 불가능하다는 점, 이에 따라 정확하고 신뢰할만한 공공 방송·영상콘텐츠 정보 플랫폼이 필요하다는 점을 밝혀내었다. 이러한 한계를 극복하기 위해 본 연구에서는 ‘공공영상문화유산’아카이브 플랫폼 구축을 제안했다. ‘영구보존’과 ‘공공활용’양대 기능을 수행하기 위해 플랫폼을‘보존/관리 플랫폼’과 ‘공공활용 플랫폼’등으로 이원적으로 구성하고 콘텐츠 공급자와 이용자가 교류하는 데 필요한 요건들을 고민했다. 본 연구에서 살펴본 ‘공공 방송·영상콘텐츠’공급자(방송사업자 등 저작권자)는 ‘공공영상문화유산’아카이브 플랫폼에서 2개 서비스 고객 중 하나로, 플랫폼 이용을 통해 각 기관이 소장한 콘텐츠를 콘텐츠 이용자들에게 공개하고 이를 연구·교육·창작 용도로 활용하고자 하는 이용자들과 소통하는 주체이다. 본 연구는 방송·영상 분야 방송사와 해당 분야 현업종사자들과 관련된 이슈를 중심으로 수행되었다. 그러나 ‘공공영상문화유산’이라는 개념에 맞게 좀더 포괄적인 수집과 공공활용을 구상하기 위해서는, 방송·영상 분야 외에도 학술연구, 초/중/고 및 평생교육, 일반 시민들의 문화향유, 해외에서의 한류정책 운영 등의 분야에서 콘텐츠 수집 대상과 방법을 모색하고, 분야별 이용자 서비스 대상 및 방법을 고민해야 할 것이다. 본 연구에서 논의된 내용을 기초로 하여, 우리 사회에서 방송·영상콘텐츠가 특정 방송사나 제작자의 배타적 활용 대상이 아니라 시민들의 문화향유 대상이자‘공공영상문화유산’으로 인식될 수 있도록 다양한 후속 연구가 이어질 것을 기대한다.

In Korea, major terrestrial broadcasters have produced archival contents using broadcast programs produced in the past. At the same time, more viewers have requested broadcasting and video contents for study, education and creative activities beyond simple re-watching contents. Despite of the demand for reuse of broadcasting and video contents, there is still no system to collect, manage and reuse all kinds of broadcasting and video contents at the public level. Recently, there is a flow of preparing a system and policy to protect and manage audiovisual contents as a cultural heritage from the crisis of destruction, damage and transformation at the national level. UNESCO members has specified the system and policy from the 1980s. Accordingly, in this study, the global trend for the provision of a audiovisual heritage protection system is identified, and the concept of audiovisual heritage is analyzed through the related research results conducted mainly by UNESCO and several developed countries in Europe and the United States after the late 1990s. It is reviewed what the process, definitions and categories are, and how to establish related laws, systems and policies to manage them. PAV Heritage, the concept that should be newly introduced in Korea, is all kinds of tangible and intangible device, media, document and knowledge information in order to play audio-visual contents influencing watching or the public viewers with certain thought or emotion through image and sound. An audiovisual content is the evidence of the actions by various institutions and groups through the process of production-distribution-consumption. Therefore, the definition of PAV Heritage defined in this study is a term considered with the technical, cultural, historical, and industrial aspects of various audiovisual types of records exposed to the public. Based on the definition of the concept, this study focuses on how to collect, manage, and utilize broadcasting and video collections if an archive of PAV Heritage is established in Korea. Before the study explores the current situation and major issues in Korea, five overseas national and public institutions cases are preferentially investigated : Institut National de l’Audiovisuel in France, British Film Institute, American Archive of Public Broadcasting initiated by Library of Congress and GBH, National Film and Sound Archives of Australia, Meemoo in Belgium. As a result, some common features are discovered : the acquisition and management of the collection are operated based on the cooperative partnership between archive institution and the broadcasting company, and public services are provided with this partnership. In addition, the fact that each institution operates for the two major functions of Preservation and Providing Access to contents is also an implication that should be taken into account in Korea. Therefore, all collected contents are ultimately subject to public service, and the time of providing services is differentiated according to the use agreement of the contents with the copyright holder. This is a unique characteristic of public video archives that differ from the administrative document archive system that can restrict public access to some records for security or confidential reasons. Accordingly, the overseas institutions investigated in this study are preparing a system to reliably protect the rights of the copyright holders of the collected contents and those who appeared in the contents. In order for the study to identify the situation in Korea where it is difficult to apply such overseas cases, the progress of building in-house archives of major terrestrial broadcasters and the status of content utilization are researched. Major terrestrial broadcasters as KBS, MBC, SBS, EBS introduced HD production systems in the mid-2000s and established digital archives. These archives have been used by internal employees or for the purpose of content production. Several broadcasters operate a service platform with an archive which can control copyrights as MBC or departments or subsidiaries directly sell contents which viewers request from specific as KBS and SBS. In addition, the broadcasters surveyed in this study usually open YouTube channels specialized in classic content and upload specially edited contents which were produced in the past online. In Korea, several policies dealt with in this study have been implemented for the public service of broadcasting and video contents. This study have investigated some national projects like Digital Archive Center(2000-2006) of the Korea Creative Content Agency(KOCCA), the K-Content Bank (2016-present) of the Ministry of Science and ICT, and the Open Sharing Portal Service (2020-Present) of KTV. And some issues of the policies promoted so far have been confirmed. As a result, it is found that it is very important to stably establish a cooperative system with major broadcasting companies and continuously implement an appropriate plan of archive operation. In this study, the opinions of respondents who have worked in the field of broadcasting and video and cultural policy are collected through in-depth interviews. In addition, questionnaire surveys of 200 users with various occupations and ages, such as the general public, university (graduate) students, education workers, and professionals are performed about the current usage behavior of 'old broadcast content' and the perception of the need for an archive platform at the public level. The significance of this study can be found in that it explores the opinions from producers and viewers of broadcast and audiovisual content on the characteristics and values of broadcast and video content as cultural heritage through this process. As a result of the two surveys, it is found that broadcasting and video contents must be 'cultural heritage' of contents containing various contents and values that must be transmitted to the next generation in terms of themes, intention and environment of production as well as the media and technologies that express them. Most of all, PAV Heritage should collect contents produced by major terrestrial broadcasters (KBS, MBC, SBS, EBS), with public funds (production support business content)' and under the korean Broadcasting law. The study tries to find the efficient methods of acquisition and service plans to secure such collection objects, the issues that can be expected and the prerequisites for resolving them when the service is provided for research and production purposes. As a result of the two surveys, these points can be found out : producers and creators in the broadcasting and audiovisual field are searching for contents in 'YouTube' and depending on only the platform in practice. In addition to this, it is still impossible to find a comprehensive list of contents that have been produced, organized, and aired in Korea. In these reasons, it is concluded that an accurate and reliable public broadcasting and video content information platform is necessary. In order to overcome these limits, this study strongly proposes the establishment of a PAV Heritage archive platform. In order to conduct both the functions of Preservation and Providing Access, the proposed platform is dually composed of Preservation and Management Platform and Public Re-use Platform, and the necessary requirements for interaction between content providers and users are considered. Providers of public broadcasting and audiovisual contents like copyright holders or broadcasting companies examined in this study are one of customers provided with two services in PAV Heritage archive platform. They are also the subjects of communication with users by opening the available contents owned by each institution to content users who want to use for research, education, and creative purposes. This study is conducted, focusing on the issues related to the broadcasting and audiovisual field. However, in order to comprehensively collect and use contents in the level of the public, according to the concept of PAV Heritage, it is necessary to find more targets and methods of collection and user service in broadcasting and audiovisual fields as well as others : academic research, elementary/middle/high school and lifelong education, general citizens' cultural enjoyment. Based on the issues discussed in this study, it is expected that various follow-up studies will be conducted in the near future so that broadcasting and audiovisual content can be recognized as PAV Heritage in the society, not as exclusively used contents by specific broadcasters or producers.
