This thesis studies measures to protect characters under the intellectual property law such as current Copyright Act, Trademark Act, Design Protection Act, and Unfair Competition Prevention Act.
Existing intellectual property law discussions related to characters have been mainly dealt with in the Trademark Act or the Unfair Competition Prevention Act, but they tend to prefer easy protection measures under the Copyright Act because it is not easy to meet the requirements for trademark registration and unfair competition. In order for characters to be protected under the Copyright Act, they must be included in the subject of protection under the Copyright Act. Discussions on whether the character's independent copyrightability is recognized are taking place at home and abroad. Accordingly, it is divided into visual and verbal characters, and the positions of theories and precedents on whether the character's copyrightability is applicable are reviewed.
Characters who are characters of cartoons or movies can be protected by video works or art works, even if they are not independently recognized for their copyrights. On the other hand, the original character refers to a character developed for commercialization without appearing in a cartoon or movie, so the protection method is different. Therefore, as a way to protect original characters under the Intellectual Property Law, the requirements for protection of copyrights and trademarks under the Trademark Act, and design rights under the Unfair Competition Prevention Act under subparagraph 1 (a), (b), (i) and (m) of Article 2 are reviewed. With the technological development of the 4th Industrial Revolution, not only virtual reality and augmented reality, but also metabuses are gradually expanding in various industrial fields. In the metaverse world, virtual influencer, a virtual digital figure for corporate marketing purposes, has emerged, and virtual influencers have a strong influence on social network services and are attracting attention, and the business of utilizing characters, including virtual influencers, is expanding.
Natural persons have personal rights such as portrait rights, name rights, and voice rights based on Article 10 of the Constitution. Virtual influencer is similar to humans and is difficult to distinguish, but it is difficult to guarantee personal rights because it is not a natural person. Virtual influencer is a visual character and creative character, which can be protected by copyright if it meets the requirements of a work under copyright Act, and if the drawing of virtual influencer is combined with a product, it can be protected by each law if it meets the registration requirements under trademark Act or design protection Act. However, virtual influencer is used not only to be expressed as a visual element but also to combine voice as an auditory element. In the event of an infringement on the voice of virtual influencer, it is examined whether infringement can be regulated by applying the type of unfair competition behavior of Article 2, Subparagraph 1(l) of the Unfair Competition Prevention Act and the newly established revision.
