It is a crime when the desire to photograph a person's secret body or figure, and the false desire to photograph a child or adolescent sexually, is realized. It is ironic that the higher the performance of the camera, the greater the degree of damage. Since crimes using smartphones will not disappear for a while, illegal filming has already become a part of our daily lives. There is a distinction between an actor shooting a certain phenomenon and shooting a specific person. In addition, it should be prohibited to photograph a person's body or parts thereof for sexual purposes. This is because it has a deep relationship with the subject's right to sexual self-determination and personal right. Above all, it is more so in terms of guaranteeing the freedom not to be photographed recklessly. If the target is a child or adolescent, the problem becomes more serious. This is because the sexuality of children and adolescents is absolutely a value that must be protected. The dissemination of illegal filmed material causes more serious damage than the problem of filming the victim. This is because damage to filming is a matter between the perpetrator and the victim, but damage to distribution is a matter between the victim and an unspecified majority. However, in spite of the seriousness of the problems caused by illegal filming as above, the interpretation of criminal laws should be strict, and the punishment should be proportional to the responsibility of the perpetrators. However, even if they succeed in secretly filming someone for sexual purposes, they are not punished, but rather they are punished if they fail to film. And if a sexual video is made for children or adolescents, it is unconditionally viewed as a production regardless of the motive or purpose. It is appropriate to punish those who distribute illegally filmed videos, but it is also questionable whether broad punishment for those who consume them is in line with responsibility. In addition, I had to think about whether it is possible to prevent these problems and furthermore, how to secure the effectiveness of the evidence-gathering procedure. In this study, the discussion started with the above problems. First, in relation to the body of‘a person who may cause sexual desire or shame’ in the crime of illegal filming, the Supreme Court precedent provided an ambiguous standard, providing an excuse for the lower courts to arbitrarily interpret it. And recently, it has been confirmed that there is no punishment for taking a full body picture. However, considering the function of the camera mounted on the smartphone, whether the photographed body is a whole body or not should not be a criterion for determining punishment. Therefore, it is necessary to deviate from the previous interpretation and consider punishing it as a standard offense. It is also possible to apply the attempted offence or the incapacitated attempt. However, what can clearly solve this problem is the clarification of the legal regulations. Therefore, the body of a person that can cause sexual desire or shame is materialized as undressing, nude, genitals, buttocks, breasts, etc. By doing so, it is possible to solve the above problems. Second, with respect to child and adolescent sexual exploitation mediated by filming, precedents regard it as production without considering the purpose of the actor or the will of the child or adolescent who is the character. However,‘filming(making)’and ‘production’are clearly distinguished. The precedent is an interpretation that focuses only on the punishment of the perpetrator, which is an extended interpretation or analogical interpretation, which is contrary to the principle of the criminal justice system. Of course, producers of child and juvenile sexual exploitation should be severely punished. However, there is a risk that the punishment will be infinitely extended if the reasons for creating such a video or the intention of the parties are not taken into account at all. Therefore, the principle of strict interpretation must be observed, and if it is not resolved through interpretation, it must be resolved through legislation. It should be rearranged into a legislative system that is proportional to the responsibility corresponding to the mode of action. This can be solved by separating filming(making) and production, and in the case of production, strictly holding the responsibility instead of setting the purpose of distribution or provision. Third, as much as the existence of illegally filmed films, one must be wary of their dissemination. This is because the moment the illegal filmed material is circulated, the victim cannot escape the pain. However, apart from severely punishing those who spread it, it is necessary to be careful in punishing the consumption of illegally filmed images. There is no justification for the act of purchasing illegally filmed images. However, whether this should be the subject of punishment is a completely different matter. Currently, the punishment rules for illegally filmed videos do not distinguish whether the target is an adult, a child, or a teenager, and the degree is excessive. Punishment is not the only way to stop the distribution of illegally filmed videos. In this regard, an amendment that removes unconstitutionality is necessary. Fourth, procedural responses to illegal filming cannot be neglected either. In particular, Germany's undercover investigation was introduced as 'identity secret investigation' and 'identity disguise investigation'. Enacting this into law is meaningful, but it is a mistake to completely allow the use of illegally filmed images for the purpose of investigation. There is an urgent need to revise this. In addition, the introduction of 'online search' can be considered as an investigative technique to prevent the distribution of illegally filmed images. And, in proportion to the forensic technology, the smartphone security function is also being strengthened. In other words, it is easy to destroy evidence of illegally filmed images, but the process of securing them is difficult. As such, investigative agencies often secure evidence through voluntary submission rather than seizure by warrant. However, it should not be overlooked that the convenience of the investigation method cannot take precedence over the principle of due process. As such, this thesis is meaningful in that it analyzes the criminal law problems of crimes related to illegally filmed among digital sex crimes, attempts a new interpretation, and suggests a legislative alternative.
