우리나라는 2017년에 고령사회가 되었고, 2025년에는 초고령사회가 되어 노인의 주거복지가 국가적 과제가 되고 있다. 사회 복지적인 관점에서 노인의 삶을 기본적으로 유지하기 위해서는 3대 기본요건인 의·식·주를 해결해야 하고, 그 중에서 식사와 주거의 문제를 해결하는 것이 가장 중요한 요건이 되고 있다. 이 두가지 문제를 함께 해결하기 위한 제도가「노인주거복지시설」제도이다. 그런데 바람직한「미래형 노인주거복지시설」을 가정하면, 노인의 복지 문제를 해결하는 시설이어야 하므로 노인들의 일상생활이 편리한 건강한 집에서 외롭지 아니 하며, 건강한 식사와 숙면 및 즐거운 여가생활과 소득 활동의 보람으로 수명 연장이 가능한 시설이어야 할 것이다. 이런 전제에서 살펴보면 미래형 노인주거복지시설은 건강한 주거시설과 다른 사회복지시설이 결합된 복합형 주거복지시설이어야 하고, 노인의 신체적 특성을 고려한「고령 친화형·친환경건축물」이어야 하며, 친환경 급식을 위한 식재료 생산과 가공으로 여가 활용이 가능한「공유경제 실천 프로그램」이 상설되어야 한다. 이런 관점에서 다음과 같은 제안을 하고자 한다. 첫째, 노인주거복지시설의 복합화는 법제상 복합화가 가능하도록 되어 있으나 노인의 사회참여 및 소득 활동에 대한 지원 활동이 미진하므로 여기에 대한 지원의 확대가 필요하다. 노인주거복지시설의 타 사회복지시설 및 교육시설과의 복합화가 법제상 가능하나 다른 사회복지시설에 비하여 노인주거복지시설이 복합화되는 사례가 많지 않는데, 노인주거복지시설에 대한 인식을 개선하여 복합화를 적극적으로 추진할 필요가 있다. 복합형 노인 주거복지 단지는 도시와 농촌을 구분하여 조성 하여야 하며 소득 창출을 위한 마을공동체 활동이 활성화 되어야 한다. 둘째, 노인주거복지 운영에 관련된 주무 부처는 보건복지부와 국토교통부로 이원화되어 있고, 노인주거복지시설의 명칭도 법률에 따라 달라 혼선이 발생하고 있다. 예컨대 노인복지법에 따른 노인복지주택(입주자 개인 부담)국토교통부가 주도하는 고령자복지주택(정부의 재정 지원)은 그 명칭에서 차이를 느낄 수 없다. 노인주거복지 주무 부처를 일원화하는 것이 어렵다면 일본의 「고령자주거법」을 일본 후생노동성과 국토교통성이 공동 주무 부처로 법률을 제정하고 시행하는 것을 참고하여 우리나라의 보건복지부와 국토교통부가 관련 법률의 제정과 시행에 공동보조를 맞출 것을 제안한다. 현재의 우리나라의 노인주거복지 공급과 운영 관련 법제는 너무 복잡하여 이용 당사자인 노인에게 혼란을 주고 있다. 셋째, 「노인복지법」에서 노인주거복지시설로는 양로시설, 노인 공동생활가정, 노인복지주택, 노인 의료복지시설로는 노인요양시설, 노인 공동생활가정을 규정하여 입소 인원, 비용 부담과 요양 서비스의 제공 정도가 다르다. 그러나 노인주거복지시설 비용 부담과 요양 서비스의 다양성이 부족하므로 우리나라도 일본과 마찬가지로 비용 부담과 요양 서비스 제공의 정도에 따라 노인주거복지시설의 유형을 다양화할 필요가 있다. 넷째, 「노인복지법」의 시설설치 기준의 개선이 필요하다. 공유 주거에 해당하는 양로시설과 노인 공동생활가정에는 거실 설치 의무가 없는데 거실 설치를 의무화하여, 노인의 공동생활의 질을 높이고 노인복지주택 인근에 상점이 있으면 별도로 식료품 또는 매점을 설치할 필요가 없으므로 노인복지주택에 식료품 또는 매점의 설치 규정을 삭제할 필요가 있다. 그리고 양로시설과 노인 공동생활가정의 침실 사용 인원을 2인 이하로 제한하고, 침실면적 기준을 상향할 필요가 있다. 다섯째, 「노인복지법」의 안전기준에 비하여「주거약자법」의 안전기준이 더 상세하고 엄격하므로 노인주거복지시설 안전기준에 「주거약자법」의 안전기준을 준용하는 것으로 개정할 필요가 있다. 여섯째, 노인주거복지시설 운영자가 입소보증금만 받고 보증금 수납일로부터 10일 이내에 이행보증서를 제공하지 않아 입소자가 퇴소 시 입소보증금 반환에 애로를 겪지 않도록 하기 위해서는 노인주거복지시설의 이행보증 가입이 입소보증금 수납과 동시에 또는 사전에 되도록「노인복지법」을 개정할 필요가 있다. 일곱째, 노인주거복지시설의 규모가 작아도 화재가 발생한 경우 신속하게 감지하고 대응하는 것이 피해를 예방할 수 있으므로 면적 규모에 관계없이 모두 스프링클러 또는 간이스프링클러, 비상 경보설비 및 자동화재탐지기 설치를 의무화하는 것으로「소방시설법 시행령」을 개정할 필요가 있다. 여덟째, 「건축법」상 양로시설과 노인 공동생활가정은 단독주택 또는 공동주택에 해당되는데, 공동주택인 양로시설과 노인 공동생활가정에는 노유자시설인 노인복지주택과는 다르게 “그 밖의 시설”로 분류되어 1, 2층에는 피난기구 설치가 의무화되어 있지 않고 노인이 사용법을 잘 모르거나 사용에 거부감을 가지고 있는 완강기 또는 공기 안전 매트도 피난기구로 허용되고 있다는 문제가 있다. 양로시설과 노인 공동생활가정 중 공동주택인 경우 1, 2층에도 피난기구를 설치하고, 완강기와 공기 안전 매트를 피난기구에서 제외시키기 위해서는「피난기구의 화재 안전기준」에서는 양로시설과 노인 공동생활가정을 노유자시설로 취급하는 것으로 규정을 개정할 필요가 있다. 아홉째, 노인주거복지시설의 단체급식소에 친환경 식재료의 효율적 공급과 품질 향상을 위해서는 첫째로 지역별로 공공 급식 지원센터를 운영하여 친환경 식재료 유통을 지원하는 것이다. 향후 공공 급식 지원센터가 전국적으로 확대될 것으로 예상되므로 지역별·센터별 독립적인 시스템 개발·적용에 따른 예산 낭비·중복과 지방자치단체의 어려움을 해소하기 위해 정부 차원에서 표준시스템 개발·이용하도록 할 필요가 있고, 둘째로 로컬푸드를 지역의 노인복지시설에 공급하여 친환경 식재료를 안정적으로 확보하는 것이다. 열번째, 노인주거복지시설의 텃밭이나 인근 유휴경작지를 활용하여 친환경 농산물을 재배하여 자체 조달하고 잉여분을 부설 상점에서 판매하는 지역 영농 노인 일자리사업이 있지만, 이것의 수익성이 높지 않기 때문에 보건복지부에서 일부 예산을 지원하고 있다. 그러나 텃밭 또는 인근 유휴경작지를 활용한 지역 영농 활성화를 하기 위해서는 텃밭, 스마트팜 또는 인근 유휴경작지 확보에 대한 정부의 추가 예산 지원이 필요할 것으로 보인다.

Senior housing and welfare has become a big issue since Korea entered a new era of aging society in 2017, and is prospected to be a super aging society by 2025. From the perspective of social welfare, satisfying the fundamental human needs such as food, clothing and shelter to be alive is of utmost importance to sustain society’s basic wellbeing. Especially for the elderly, to meet their needs in regard to food and shelter can be critical to their life in old age. To resolve both the problems simultaneously, elderly housing welfare facilities can be an answer. This perspective supposes that future elderly housing welfare facilities should be a combination of healthy housing and other social welfare facilities. For senior housing to serve as such, it must be built to be elderly friendly and environmentally friendly reflecting physical attributes of the elderly, and it must be a workplace where seniors produce environmentally friendly food material for healthy food for themselves generating income as well. If the supposition comes true and works well in reality, senior housing can also become a good model for shared economy in a sense. One can possibly imagine a desirable senior housing as follows: Senior citizens have convenient and comfortable daily lives in the center; they no longer feel lonely; healthy food is provided for every meal; they can enjoy sound sleep and leisure time; income generation is sometimes possible; altogether, their life expectancy is prolonged and they enjoy their old age in the housing. From this perspective my suggestions are summarized as belows: First, while mixed-use of senior housing as described above is permitted by laws, seniors’ social participation and income generation activities are extremely limited due to lack of relevant support measures. Complex senior welfare housing in rural areas, in particular, must be linked to local community to generate appropriate income for the residents. Government support is necessary in this respect. Second, confusion may arise because various names are referred to as senior housing, elderly welfare housing or nursing house in accordance with relevant laws, and because dual government authorities are in charge of operating senior housing system such as Ministry of Health and Welfare and Ministry of Land, Infrastructure and Transport. In short, current legislations and systems concerning elderly welfare are too complicated to benefit the users. Therefore, cooperation between the two related authorities is necessary for the enactment and enforcement of unified legislation regarding senior housing. like what two different government authorities of Japan collaboratively did to enact Housing Act for the Elderly. Third, while Welfare of the Aged Act regulates various types of housing for the elderly in terms of the number of residents, expense and service provided, Senior facilities provided in the market, in reality, seriously lack diversity failing to meet the various needs. It is urgent and necessary to diversify types of facilities in accordance with the level of expense and the degree of service provided. Fourth, standards for the establishment of the facilities must be complemented or improved to better fit the elderly residents’ life styles. For example, it is not a legal obligation for nursing houses and senior congregate housing to have living rooms. Living rooms can be good space to enhance the quality of seniors’ shared life, and therefore must be incorporated in the law. Standards regarding bed rooms must also be improved toward enhancement of the elderly life quality. Fifth, when it comes to safety standards of senior housing, it is considered necessary to apply the standards of Housing for the Underprivileged Act as it is more strict and detailed than Welfare of the Aged Act. Sixth, it sometimes happens that the operator of senior housing facilities may have difficulty in returning the deposit which the residents have paid when they entered the facility. So mandatory performance guarantee clause must be included in the revision of Welfare of the Aged Act in order to make it mandatory for the operator of senior facilities to sign up for performance guarantee when or before they get paid the deposit money by the will-be residents. Seventh, senior housing, big or small, may suffer serious damage and casualties if fire breaks out. Since the residents are usually aged and physically weak, they can not respond quickly to any kind of accident. To prevent such disastrous accidents from happening, laws regarding fire-fighting or protection system must be amended so that fire protection system such as a spring cooler and a fire detector, to name but a few, must be installed in any type of senior housing facilities, big or small. Eighth, Building Act in regard to elderly welfare housing facilities also needs to be revised to reflect behavioral characteristics of the elderly more practically. In fact, most senior citizens find it hard to use a descending life line or a safety mat even when they have to in case an emergency such as fire breaks out. Ninth, it may be necessary that public food service center on a regional basis be established and operated to help distribute environmentally friendly food material in the region more efficiently than any private business can do. This can benefit both the local food suppliers with stable and secured income source and the local senior housing facilities located in the region with provision of fresh, good quality and environmentally friendly food material. Tenth and finally, although some senior housing facilities produce vegetables and crops in the yard or in idle land nearby out of senior employment program, the productivity or profitability of the job remains quite low. So Ministry of Health and Welfare is currently supporting a fraction of its budget to the facilities. Bigger budget support is needed to help promote local agricultural advancement and to boost seniors’ active participation in the program.
