The purpose of this study is to provide information to understand the context of the Antarctic Treaty System by looking back on its development process. It also aims to review the roles and activities of the CEP in the System in order to support the improvement of our Antarctic science policy. This study considered the developmental histories of independent conventions for Antarctic conservation and Protocol on Environmental Protection to the Antarctic Treaty under the system. CEP, established in accordance with the Protocol, has expanded its roles in the ATCM under the circumstances of climate change and increasing human activities in the treaty area. I examined CEP's functions, relationships with formal observers, and its activities along with CCRWP. In addition, I have estimated the contribution of the Parties to the CEP based on the documents submitted by the Parties. The leading Parties of the System have strengthened their initiatives to expand contributions to CEP with their output based on national Antarctic Program. However, Korea has not been able to take initiatives in the System even though Korea has invested considerable resources in its Antarctic program. To strengthen Korea's capability to instigate initiatives in the system, I suggest the following approaches: Firstly, Korea should improve its Antarctic science policy based on the newly established CEP five-year work plan; Secondly, Korea should organize a long-standing expert group to focus on Antarctic environmental policy and related scientific information; finally, Korea should intensify its collaboration with other Parties in developing Antarctic environmental priority issues.

제안 방법

전 지구적 환경변화 하에서 환경보호위원회(CEP)는 남극조약 체제의 전문가 자문 기구로서 옵저버 기구들과 함께 남극조약협의당사국회의(ATCM)와 당사국들의 남극 환경 보호 노력을 지원하고자 기후변화 대응 업무 프로그램(CCRWP)을 개발하였다. 또한 남극 정책결정자, 과학자, 운영자들이 활용할 수 있도록 정치 중립적이고 최신 과학 논문과 발견에 기초한 남극 환경정보를 제공하는 남극 환경포탈(https://www.environments.aq)을 구축하였으며(ATCM XXXVIII 2015b), 시대의 변화에 따른 다양한 인간 활동에 대한 환경 지침들을 개발하였다. 그러나 최근 남극조약 체제와 관련 기구들이 필요에 따라 독자적 또는 공동 개발 한 프로그램과 권고들은 복잡하고 다양하여 당사국들이 수행하고 있는 과학 활동의 결과를 적절하게 반영하거나 필요한 과학 연구를 제안하는데 혼선을 가져올 수 있다는 점이 대두되었고, 환경 이슈들 간의 관계를 이해하고 효율적으로 대응하기 위한 종합적인 접근 방법의 필요성이 제기되었다(ATCM XL 2017a).
남극연구과학위원회는 의정서가 만들어지기 훨씬 전에 남극 동식물상 보존을 위한 규정들을 개발하고 1964년에 조치로 채택되도록 주도하였으며, 이후 이 조치들은 의정서의 핵심을 이루게 되었다. 또한 의정서와 제5부속서의 이행에 필요한 남극특별보호구역(ASPA) 관리계획 작성을 위한 지침을 제안하고 관리계획 핸드북을 개발하였다. 남극연구과학위원회는 국가 남극 프로그램 운영자 위원회(COMNAP)와 함께 제1부속서의 이행을 위해 환경영향평가(EIA) 지침과 우수 사례를 발굴하고 환경모니터링 핸드북과 환경 사찰을 위한 점검표를 고안한 바 있다.

동 회의에서는 해양생물자원 관리체제 구축을 위한 2차 남극조약협의당사국 특별회의(SATCM) 개최를 결정하였고, 1978년부터 1980년까지 세 번의 논의를 거쳐 남극 해양생물자원보존협약(CCAMLR)이 마련되었다. CCAMLR는 1980년 5월 20일 호주의 Canberra에서 채택되었고(CCAMLR 1980), 1982년 4월 7일에 발효되었다. 이미 남극해 크릴조업이 성행하는 상황에서 무생물자원의 경우보다 협의당사국의 합의를 이끌어 내는데 상대적으로 수월한 해양생물자원의 이용과 보존에 대한 합의가 먼저 이루어졌다.

이미 남극해 크릴조업이 성행하는 상황에서 무생물자원의 경우보다 협의당사국의 합의를 이끌어 내는데 상대적으로 수월한 해양생물자원의 이용과 보존에 대한 합의가 먼저 이루어졌다. 우리나라는 1985년 3월 29일에 가입하였다.

1973년, 전 세계적인 오일쇼크로 기업들과 협의당사국들의 남극 광물자원에 대한 관심이 더욱 높아졌으며, 미국 기업 Texas Geophysical Instruments는 1975년초 정부에 남극 로스해와 웨델해의 시추 탐사 허가를 신청하기에 이르렀다(US Congress 1989). 이 사건을 계기로 협의당사국들은 남극 광물자원 탐사가 기술적으로 가능하며, 남극 광물자원 탐사에 대한 관리체제의 부재가 개발자들로 하여금 자국의 국내법 또는 영유권 주장국들의 국내법을 적용하여 개발을 진행할 수 있다고 여길 수 있음을 인식하게 되었고, 남극조약 체제의 안정성 유지를 위해 남극 광물자원에 대한 관리체제 마련의 필요성을 절감하게 되었다. 이러한 남극 국제사회의 분위기 속에서 1982년 유엔 해양법 협약 채택 이래 이듬해 처음으로 남극 문제가 유엔 총회에서 거론되기에 이른다.

후속연구

올해 개최된 제21차 위원회에서는 5개년 업무계획에 과학적 요구 사항들의 목록을 조합하고, 정기적으로 검토하여 개정할 것에 합의하였다(ATCM XLI2018c, 2018d). 따라서 우선순위의 이슈들과 과학적 요구들을 연계한 개정된 5개년 업무계획을 통해 위원회의 중요 업무와 향후 나아갈 방향을 예측 할 수 있으며, 남극 관련 기구들은 물론 향후 남극조약 체제에서 활동을 확대하고자 하는 당사국들의 남극 연구 개발과 운영계획 수립에 유용한 지침이 될 것으로 전망된다.
이를 위해 우리나라가 현재 남극조약 체제에 투자하고 있는 자원을 크게 늘리지 않더라도, 우리의 남극 과학정책을 환경보호위원회의 5개년 업무계획을 기반으로 점검하고 현재 진행 중인 과학프로그램을 검토하여 이슈 별로 대응 가능한 프로그램을 식별하는 한편, 필요할 경우 위원회의 과학적 요구에 부합할 수 있도록 기존 프로그램을 보완하여 위원회의 우선순위 이슈 해결에 기여할 수 있을 것으로 본다. 또한 매년 획득한 다양한 정보를 체계적으로 관리하고 남극 관련 정부부처 및 연구기관 등에 제공하여 시의 적절하게 활용할 수 있다면 남극조약 체제에 대한 우리나라의 기여도는 크게 향상될 수 있을 것으로 전망된다. 이를 위하여 남극조약 체제 내에서 활동하고 있는 각 연구기관과 부처 간의 정보 공유의 구심점이 되는 전문가 그룹의 구성이 필요하다.
