Rooted in Roman law, cultivated in medieval England, and refined during more than two centuries of American jurisprudence, the public trust doctrine is a powerful legal principle to which society has frequently turned in order to more effectively protect natural resources. The public trust doctrine holds that some natural resources, particularly lands beneath navigable waters or washed by the tides, are either inherently the property of the public at large, or are at least subject to a kind of inherent easement for certain public purposes. In an influential article in 1970, Joseph Sax argued for the expansion of the public trust doctrine in order to more effectively protect natural resources. For environmentalists and preservationists who view private ownership as a source of the degradation of our natural and historical resources, the public trust doctrine holds out the hope of salvation through what amounts to a judicially enforced inalienability rule that locks resources into public ownership. For those who view private property as the bulwark of the free enterprise system and constitutional liberty, the doctrine looms as a vague threat. The leading case establishing the doctrine in the United States is the United States Supreme Court"s 1892 decision in Illinois Central Railroad Company v Illinois. Since Illinois Central, courts and state legislatures have slowly expanded the public trust doctrine. While once limited to navigable and tidal waters, the doctrine has crept from beaches and rivers to lakes, tributaries, riparian banks, and now encompasses aquifers, marshes, wetlands, springs, groundwater, beach access, trees and forests, parks, wildlife, fossil beds, and whole ecosystems under the doctrine"s increasingly broad umbrella. This Article proceeds as follows. Chapter Ⅰ reviews the introduction and goal of this article. Chapter Ⅱ makes a more detailed inquiry into the theoretical development and cases of the public trust doctrine in U. S. A. Chapter Ⅲ reviews the discussion between those who are for expansion of the public trust doctrine and those who are against expansion of the public trust doctrine. Chapter Ⅳ reviews the possibility of introduction of public trust doctrine into Korea, considering flexibility and comprehensiveness of the public trust doctrine. Chapter Ⅴ considers conclusion of our study on the public trust doctrine as a potent tool for general environmental protection.
