본 연구의 목적은 우리나라 소년범죄와 소년사건처리의 현황을 분석하여 소년사법체계의 발전에 기여할 수 있는 방안을 제시하는 것이다. 소년범죄자수는 감소하고 소년범죄율도 줄어드는 경향이다. 소년사건의 처리현황에서는 다양한 문제점들이 지적되었다. 먼저, 검사의 불기소율이 지나치게 높았다. 63% 가량이 법원소년부나 형사법원에 송치되지 않았다. 둘째, 전환처우가 적극적으로 활용되지 않았다. 선도유예되는 비율이 6% 내외에 불과할 정도로 소수의 소년만 전환처우되었다. 셋째, 우범소년이 방치되었다. 연간 1-2명 내지는 전무할 정도로 이들에 대한 보호처분이 실시되지 않았다. 넷째, 보호처분의 다양성이 미흡하였다. 5호 처분은 거의 활용되지 않고 4호 처분은 2% 내외에 부과될 뿐이었고 8% 내외만이 소년원의 수용처분을 받았다. 다섯째, 형사법원의 역송비율이 높았다. 35% 내외의 소년형사사건이 법원소년부로 송치될 정도로 역송비율이 높았다. 여섯째, 집행유예의 비율이 높았다. 소년형사사건에서 집행유예되는 비율은 최근에 30% 가량을 차지하였다. 끝으로, 벌금형의 증가추세이다. 벌금형은 최근에 증가하여 소년형사사건의 10% 가량에 선고되었다.

Official statistics show that juvenile crimes tend to stabilize. Fewer incidences have occurred in recent years and juvenile crime rates have gradually decreased from 1996 to 2005. Juvenile offenses tend to become nonviolent in recent years. However, reoffending rates are seen to increase in recent years. About 40 percent of all juvenile offenses are committed by reoffending youths in 2005. In addition, reoffending youths are more likely to be persisent offenders. Findings from the statistics of juvenile justice system show several inadequacies. First, non-referral rates of prosecutors are too high. About 63 percent of juvenile offenders are referred to neither juvenile courts nor adult courts. Second, diversion are rarely utilized. Only 6 percent of juvenile offenders are treated by diversion programs. Third, juveniles of status offenses are almost entirely neglected. None or 1-2 status offenders are referred to the juvenile justice system. Fourth, the kinds of dispositions are too limited in juvenile courts. About 80 percent of juvenile offenders have received the home-based dispositions and about 8 percent of them have received the disposition of residential training school. Fifth, the percent of transferred cases are too high. About 35 percent of juvenile offenders have been tranferred from adult courts to juvenile courts. Sixth, the percent of suspended sentences are too high. About 30 percent of juveniles have received the suspended sentences by adult courts. Finally, fines are too often sentenced by adult courts. About 10 percent of juvenile offenders, who are unable to pay the fines without the support of parents, are sentenced by fines in adult courts. Remedies are provided to deal with the inadequacies found in this study. Juvenile justice policies such as balanced justice, blended sentencing, and restorative justice are suggested to be considered for the establishment of more efficient juvenile justice system.
