(Extended Producer Responsibility: A Guidance Manual for Governments)에 따르면 EPR 정책에는 다음의 두 가지 특징이 있다고 한다.

The world stands at the turn from an unilateral logistics system of “resource, development, production, consumption and disposition” to a resource-cycling society where resources and products and recycled and reused, and natural resources are no longer wasted. Therefore, it is necessary to revisit Korea’s legal system in order to transform the society’s waste treatment practices from burning and burying to recycling. In addition, a resource-cycling society will be based on the cycle of resources before they become wasted, a new notion of resource cycling that is “free from wastes.” As conforming to previous studies that have promoted the extended producer responsibility (EPR) as an effort to develop a resource-cycling society, this study is to quote and summarize key points as follows. The first point is the needs to reform Korea’s recycling policies. The reform must upgrade the EPR as an overarching principle for all recycling policies, utilize it as a tool to integrate recycling policies and promote integration of policies governing manufacturers’ products and processes. Qualitative change is also required. In order to lay the foundation for autonomous growth of the recycling industry, government regulations should be replaced with evaluation on consumers and markets; financial institutions should consider EPR performances as a key factor in rendering credit ratings; and policies should shift their focus from quantitative to qualitative growth, such as improving evaluation standards that include qualitative factors like added values of recycling activities. Secondly, in the same context, the objective of the EPR is to reinforce producers’ responsibilities for recycling used-products and used-packages. Therefore, policies should be designed to encourage producers to choose eco-friendly materials and designs in their design and production processes, and to enhance the possibilities of recycling and reducing wastes (Article 16 of Act on the Promotion of Saving and Recycling of Resources). In addition, according to the OECD’s guidance manual (Extended Producer Responsibility: A Guidance Manual for Governments) published in March 2001, EPR policies bear two following characteristics. One is to transfer upstream recycling responsibilities (both physical and financial) from local governments to producers, and the other is to motivate producers to consider the environment from the beginning of product design process. Desirable is to enact EPR Act and to enforce administrative orders and punishments accordingly under the shared authority of the Ministry of Environment and relevant government agencies. Lastly, regarding amendments to law for the establishment of resource-cycling society, it may be causes for confusion in the legal system that “waste recycling” is governed by Act on the Promotion of Saving and Recycling of Resources, rather than by Waste Control Act, while “recycling,” which is the pillar of Act on the Promotion of Saving and Recycling of Resources, is defined and governed by Waste Control Act. In order for the general public to better understand and access law, and for the government to more efficiently enforce law, some experts insist that the two acts should be integrated or at least amended. The integration approach is justifiable on its own. However, in order to establish a resource-cycling society, a new act, namely “The act on the promotion of establishing resource-cycling society,” should be enacted to replace the existing Act on the Promotion of Saving and Recycling of Resources so that the new act serves as a framework for waste and recycling management. The act on the promotion of establishing resource-cycling society may define the concept and principle of the establishment of resource-cycling society, the process and design of a resource-cycling society, and effective policie
