This article intends to explore complicated relations between national security and free speech and to try proper weighing those interests in the system of freedom of expression, mainly in interpreting and enforcing Korean National Security Act(KNSA) of the Republic of Korea. Chapter Ⅱ deals with general theory of criminal security laws, which as an political criminal laws penalizing threats to national security adopt strict preventive measures that may in effect restrict free speech. And in the course of explaining those political criminal laws, I refer to symbolic nature of political expression crime as causing danger to national security, that is abstract ideal interest, and as generated by actor"s convinced ideological conscience. Here causation rule that should be determined to justify the restriction raises especially important problems, about which I consider German theories and case law as offering rational and practical resolving alternative. Chapter Ⅲ, Prolog to the Korean National Security Act overviews its statutory chronology and its changing enforcement and functioning under the circumstantial evolution that responds social and political change in Korean society, especially the particular situations where North Korea proves to be incessant threat to overthrow South Korean Government. In that perspective political security laws are on the basis of opportunism observed as having fluctuating effect. Chapter Ⅳ describes individual regulations of the Korean National Security Act, that raises competing interests in conflict between national security and free speech and intends to seek rational practical balancing between them.
