A surgical instrument is adapted for applying a plurality of surgical fasteners to body tissue. The surgical instrument includes an anvil and a cartridge housing containing a plurality of surgical fasteners. The cartridge housing and anvil are relatively movable between a first spaced apart position and a second closed position. A firing mechanism is associated with the cartridge housing for ejecting the surgical fasteners from the cartridge housing to be driven against the anvil. A lockout mechanism interacts with the cartridge housing for activation and deactivation; the lockout mechanism preventing movement of the cartridge housing to its second closed position but permitting relative reapproximation movement of the cartridge housing and anvil, whereby reapproximation provides an indicator that the instrument is not malfunctioning.

The invention claimed is: 1. A surgical instrument adapted for applying a plurality of surgical fasteners to body tissue, the surgical instrument comprising: an anvil; a cartridge housing containing a plurality of surgical fasteners, the cartridge housing and anvil being relatively movable between a first spaced apart position and a second closed position; a firing mechanism associated with the cartridge housing for ejecting the surgical fasteners from the cartridge housing to be driven against the anvil; and a lockout mechanism interacting with the cartridge housing for activation and deactivation; the lockout mechanism preventing movement of the cartridge housing to its second closed position but permitting relative reapproximation movement of the cartridge housing and anvil, whereby reapproximation provides an indicator that the instrument is not malfunctioning. 2. The surgical instrument according to claim 1, wherein the lockout mechanism includes a lockout lever having a distal end and proximal end with a central section therebetween. 3. The surgical instrument according to claim 2, wherein the central section is pivotally mounted to a closure member of the surgical instrument in a manner allowing the lockout lever to rotate in a controlled manner. 4. The surgical instrument according to claim 3, wherein the lockout lever is spring biased down toward a base of a supporting structure of the surgical instrument. 5. The surgical instrument according to claim 3, wherein the proximal end of the lockout lever includes a cam surface and a locking groove. 6. The surgical instrument according to claim 3, wherein the distal end of the lockout lever is shaped and dimensioned to engage a driver of the cartridge housing upon loading of a new cartridge housing into the surgical instrument. 7. The surgical instrument according to claim 1, wherein reapproximation constitutes approximately 쩌 to approximately ⅔ of the total distance between the cartridge housing and the anvil when in the first spaced apart position. 8. The surgical instrument according to claim 7, wherein reapproximation constitutes approximately 쩌 of the total distance between the cartridge housing and the anvil when in the first spaced apart position. 9. The surgical instrument according to claim 7, wherein reapproximation constitutes approximately ⅓ of the total distance between the cartridge housing and the anvil when in the first spaced apart position. 10. The surgical instrument according to claim 7, wherein reapproximation constitutes approximately 쩍 of the total distance between the cartridge housing and the anvil when in the first spaced apart position. 11. The surgical instrument according to claim 1, further including a retaining pin, and the retaining pin is not moved to a fully closed positioned during reapproximation. 12. A surgical instrument adapted for applying a plurality of surgical fasteners to body tissue, the surgical instrument comprising: an anvil; a cartridge housing containing a plurality of surgical fasteners, the cartridge housing and anvil being relatively movable between a first spaced apart position and a second closed position; a firing mechanism associated with the cartridge housing for ejecting the surgical fasteners from the cartridge housing to be driven against the anvil; and a lockout mechanism interacting with the cartridge housing for activation and deactivation; the lockout mechanism including reapproximation means for preventing movement of the cartridge housing to its second closed position, but permitting relative reapproximation movement of the cartridge housing and anvil, whereby reapproximation provides an indicator that the instrument is not malfunctioning. 13. The surgical instrument according to claim 12, wherein the lockout mechanism includes a lockout lever having a distal end and proximal end with a central section therebetween. 14. The surgical instrument according to claim 13, wherein the central section is pivotally mounted to the closure member allowing the lockout lever to rotate in a controlled manner. 15. The surgical instrument according to claim 13, wherein the lockout lever is spring biased down toward a base of a supporting structure of the surgical instrument. 16. The surgical instrument according to claim 13, wherein the proximal end of the lockout lever includes a cam surface and a locking groove. 17. The surgical instrument according to claim 13, wherein the distal end of the lockout lever is shaped and dimensioned to engage a driver of the cartridge housing upon loading of a new cartridge housing into the surgical instrument. 18. The surgical instrument according to claim 12, wherein reapproximation constitutes approximately 쩌 to approximately ⅔ of the total distance between the cartridge housing and the anvil when in the first spaced apart position. 19. The surgical instrument according to claim 18, wherein reapproximation constitutes approximately 쩌 of the total distance between the cartridge housing and the anvil when in the first spaced apart position. 20. The surgical instrument according to claim 18, wherein reapproximation constitutes approximately ⅓ of the total distance between the cartridge housing and the anvil when in the first spaced apart position. 21. The surgical instrument according to claim 18, wherein reapproximation constitutes approximately 쩍 of the total distance between the cartridge housing and the anvil when in the first spaced apart position. 22. The surgical instrument according to claim 12, further including a retaining pin, and the retaining pin is not moved to a fully closed positioned during reapproximation. 23. A surgical instrument adapted for applying a plurality of surgical fasteners to body tissue, the surgical instrument comprising: an anvil; a cartridge housing containing a plurality of surgical fasteners, the cartridge housing and anvil being relatively movable between a first spaced apart position and a second position in close approximation with one another; a firing mechanism associated with the cartridge housing for ejecting the surgical fasteners from the cartridge housing to be driven against the anvil; and a lockout mechanism interacting with the cartridge housing for selective activation and deactivation; the lockout mechanism preventing movement of the cartridge housing to its second closed position, but permitting relative reapproximation movement of the cartridge housing and anvil, whereby reapproximation provides an indicator that the instrument is not malfunctioning, and the lockout mechanism includes a lockout lever rotationally mounted on a closure member of the surgical instrument, the lockout lever includes a distal end and a proximal end with a central section therebetween, the central section being pivotally mounted to the closure member allowing the lockout arm to rotate in a controlled manner. 24. The surgical instrument according to claim 23, wherein the lockout lever is spring biased down toward a base of a supporting structure of the surgical instrument. 25. The surgical instrument according to claim 23, wherein the proximal end of the lockout lever includes a cam surface and a locking groove. 26. The surgical instrument according to claim 23, wherein the distal end of the lockout lever is shaped and dimensioned to engage a driver of the cartridge housing upon loading of a new cartridge housing into the surgical instrument. 27. The surgical instrument according to claim 23, wherein partial reapproximation is permitted after firing of the instrument. 28. A method for use of a surgical instrument, comprising the following steps: providing a surgical instrument adapted for applying a plurality of surgical fasteners to body tissue, the surgical instrument including: an anvil; a cartridge housing containing a plurality of surgical fasteners, the cartridge housing and anvil being relatively movable between a first spaced apart position and a second position in close approximation with one another; a firing mechanism associated with the cartridge housing for ejecting the surgical fasteners from the cartridge housing to be driven against the anvil; firing the surgical instrument to dispense the surgical fasteners; attempting to reapproximate the cartridge housing and anvil; and determining, based upon the ability to reapproximate, whether the surgical instrument is properly functioning.
