개발내용 및 결과
국내의 성공적인 CCS 법제도 개발을 위해 해외 입법 및 제도화사례를 분석한다. 국제 에너지 기구(IEA)에서 제안한 Model Regulatory Framework의 CCS 29가지 주요 이슈에 맞춰 구분하여 현재 CCS 관련법과 제도의 마련을 위한 활동이 활발한 3개 지역(일본, EU, 오스트레일리아)의 사례를 분석한다.
국내 CCS 관련 법률을 검토 및 분석한다. CCS 도입과 연관될 수 있는 국내 기존 법규 현황을 검토하고 해외 입법 및 제도화 사례분석을 기준으로 하여 국내법과 제도의 구비 여부를 파악한다.
이를 통해서 CCS 도입 활성화를 위한 법·제도 마련방향 제안한다.
해외 사례분석 결과를 국내 법률체계와 비교 분석하여 미비점 보완을 중심으로 개정안 지침을 제시한다. 나아가 CCS 활성화 관련 주요 국가 및 국제기구 협력 도모를 위한 국내 법률 및 제도 개정방안을 제안한다.
기술개발배경
국내 CCS 기술 개발 현황에 비해 CCS 도입을 위한 법제도는 준비가 미흡한 실정이다. CCS 기술의 안전한 도입을 위해 이산화탄소 포집, 수송, 저장 등의 전 분야에 걸친 안전성을 확보한 법적 규제 근거가 필요하다.
이러한 작업을 통해서 CCS의 도입의 필요에 대한 공감대 및 당위성 형성, CCS의 도입 간에 발생할 수 있는 사고와 피해 최소화, 대규모상용화에 필수적인 경제성을 갖추기 위한 재정적 지원 , 산업화 시 야기될 수 있는 소유 및 재산권에 대한 분쟁 방지 등의 기술적·경제적·산업적·사회적 측면의 파급효과를 기대할 수 있다.
