Ⅰ. 배경 및 목적
□ 중국은 우리 국민이 관광, 사업, 유학 등 다양한 목적으로 가장 많이 진출하고 있는 국가로서, 중국의「출입국관리법(出入境管理法)」은 중국으로의 입국 및 체류 안전 및 편의에 가장 많은 영향을 미치는 법률임.
□ 중국「출입국관리법(出入境管理法)」이 2013년 7월 1일부터 시행되어 오고 있으며, 기존의 외국인출입국관리법과 중국국민출입국관리법이 폐지되었음.

Ⅰ. 배경 및 목적
□ 중국은 우리 국민이 관광, 사업, 유학 등 다양한 목적으로 가장 많이 진출하고 있는 국가로서, 중국의「출입국관리법(出入境管理法)」은 중국으로의 입국 및 체류 안전 및 편의에 가장 많은 영향을 미치는 법률임.
□ 중국「출입국관리법(出入境管理法)」이 2013년 7월 1일부터 시행되어 오고 있으며, 기존의 외국인출입국관리법과 중국국민출입국관리법이 폐지되었음.
-「출입국관리법」의 하위규정으로「외국인 출입국관리조례(外國人入境出境管理條例)」가 2013년 9월 1일부터 시행되어 우리나라 투자기업의 관리자 및 가족들의 중국 출입국에 적용되고 있음.
□ 중국 출입국관리법이나 외국인 출입국관리조례에서는 사증을 받을 수 없는 6가지 상황에 대하여서는 명시하고 있으나, 사증발급기관이 발급불허 결정을 내리는 경우 그 이유를 밝히지 않도록 규정하고 있어서 법적 명확성이 확보되지 않고 있음.
□ 또한, 사증체류기간의 상한을 180일까지로 단축하였으며, 거류증의 최장 유효기간을 5년으로 하는 한편, 거류증 심사기한을 15일로 규정하고 있어서 출입국이 잦은 외국인거류자들의 출입국과 투자에 지대한 영향을 미치고 있음.
□ 한-중 경제협력 확대와 법적 명확성 확보를 위하여 중국 출입국관리법제에 대한 상세한 비교법적 분석을 통하여 중국 출입국관리법제의 문제점과 한-중 간 자연인의 국경 이동에 대한 일정한 시사점을 도출할 필요가 있음.
Ⅱ. 주요 내용
□ 국민과 외국인의 출입국, 외국인의 체류관리, 국적취득, 난민인정 등에 관한 사항을 정하고 있는「출입국관리법」,「국적법」,「난민법」에 관한 내용을 소개하고, 이를 중국의 법제와 비교하고자 함.
□ 우리나라「출입국관리법」에는 대한민국에 입국하거나 대한민국에서 출국하는 모든 국민 및 외국인의 출입국관리를 통한 안전한 국경관리와 대한민국에 체류하는 외국인의 체류관리 등에 관하여 필요한 사항을 규율하고 있음.
- 국민과 외국인은 모두 출입국하기 위해서는 유효한 여권을 가지고 있어야 하는 것은 공통사항이며, 추가적으로 외국인의 경우 대한민국에 입국하기 위해서는 입국목적에 부합하는 사증(Visa)을 필요로 함. 다만, 사증면제협정 체결국가 국민이나 법무부장관이 지정한 무사증입국 허용국가 국민의 경우에는 관광·방문 등을 위해 사증 없이 입국할 수 있음.
- 국민의 경우 출입국의 자유가 있고, 외국인의 경우 출국의 자유가 보장되는 것이 원칙이지만, 형사범죄나 세금 미납 등과 관련하여 국민과 외국인의 출국을 금지(정지)할 수 있음.
- 외국인이 대한민국에 체류하려면 체류활동에 부합하는 체류자격을 가지고 있어야 하며, 허가 받은 체류기간의 범위 내에서 체류할 수 있음. 체류자격은 외교(A-1)부터 방문취업(H-2)까지 36가지 종류이며, 그 체류자격에 해당하는 사람과 활동범위를 규정하고 있음.
- 외국인이 취업활동을 하기 위해서는 취업활동을 할 수 있는 체류자격을 가져야 할 뿐만 아니라 지정된 근무처에서 근무해야함.
- 누구든지 취업활동을 할 수 있는 체류자격을 가지지 아니한 사람을 고용하거나 이를 알선·권유하여서도 아니 되며, 외국인을 합법적으로 고용한 고용주는 외국인을 해고하는 등의 고용변동사유가 발생하면 15일 이내에 지방출입국·외국인관서의 장에게 신고하여야함.
- 외국인이 대한민국에 90일을 초과하여 체류하려면 90일 이내에 그의 체류지를 관할하는 지방출입국·외국인관서장에게 외국인등록을 하여야 하며, 외국인이 자신에게 부여된 체류자격에 해당하는 활동과 병행하여 다른 체류자격에 해당하는 활동을 하려면 미리 ‘체류자격외 활동허가’를 받아야 함. 또한, 그가 가진 체류자격에 해당하는 활동을 마치고 다른 체류자격에 해당하는 활동을 하려면 원칙적으로 출국하여 새로 사증을 발급받아 입국하여야 하나 국내에서 체류자격 변경허가를 받을 수 있음.
- 불법입국, 불법체류, 불법취업 등으로 출입국관리법을 위반한 외국인은 강제퇴거할 수 있으며, 출입국관리공무원은 강제퇴거 대상이 된다고 의심되는 외국인을 조사할 수 있고, 도주할 염려가 있는 경우에는 보호할 수 있음.
- 출입국관리법 위반사범에 관한 사건은 지방출입국·외국인관서장의 고발이 없으면 공소를 제기할 수 없음. 출입국관리법 위반사건이 벌금형에 해당하는 경우에는 형사절차를 거치지 않고 지방출입국·외국인관서장이 벌금에 상당하는 금액으로 통고처분을 할 수 있으며, 이를 납부하면 일사부재리의 원칙이 적용되어 동일한 사건에 대하여 다시 처벌받지 아니함.
□「난민법」에는 난민협약과 난민의정서 등에 따른 난민의 지위와 처우 등에 관한 사항을 정하고 있으며, 난민인정 신청과 심사, 난민인정자·인도적 체류자·난민신청자의 처우, 난민위원회의 설치·운영, 난민지원시설의 운영 등에 관하여 규정하고 있음.
- 대한민국 안에 있는 외국인으로서 난민인정을 받으려는 사람은 지방출입국·외국인관서장에게 난민인정신청서를 서면으로 제출하여야 함.
- 난민인정 여부에 관한 결정은 법무부장관의 권한이지만지방출입국·외국인관서장이 결정할 수 있도록 위임하고 있음.
□「국적법」에는 대한민국의 국민이 되는 요건을 정하고 있으며, 외국인이 대한민국 국적을 취득하는 요건, 복수국적자의 국적선택 절차, 국적상실사유와 국적상실자의 처리, 국적보유 여부가 불분명한 사람에 대한 국적판정, 귀화허가 등의 취소 등에 관하여 규정하고 있음.
- 출생과 동시에 선천적으로 대한민국 국적을 취득하는 기준으로 부모양계혈통주의를 기본원칙으로 하고 있으며, 예외적으로 부모를 모두 알 수 없거나 부모가 모두 무국적인 상태에서 대한민국에서 출생한 아동도 대한민국 국적을 취득하는 보충적 출생지주의를 채택하고 있음.
- 외국인으로서 대한민국 국적을 취득하는 방식은 인지에 의한 국적취득(국민과 외국인 사이에 혼인 외에 출생한 자녀가 국적을 취득하는 방식), 귀화(일반귀화, 간이귀화, 특별귀화)에 의한 국적취득, 수반취득(미성년 자녀가 부 또는 모에 수반하여 국적을 취득하는 방식), 국적회복에 의한 국적취득 등이 있음.
- 외국인이 귀화, 국적회복 등의 방식으로 대한민국 국적을 취득하면 1년 내에 원국적을 포기해야 하며, 이를 이행하지 않으면 대한민국 국적이 상실됨.
- 출생 당시에 대한민국 국적과 외국국적을 함께 가진 복수국적자는 22세가 되기 전까지 하나의 국적을 선택해야 하는 국적선택의무가 있음.
- 우리국민이 자진하여 외국국적을 취득하면 외국국적을 취득한 때에 대한민국 국적이 자동 상실 됨
□ 중국은 중화인민공화국외국인출입국관리법과 중화인민공화국공민출입국관리법을 동시에 폐지하면서 2013년 7월 1일부로 중화인민공화국출입국관리법이 시행됨.
□ 출입국관리법에 근거하여 제정된 행정법규인 중화인민공화국외국인출입국관리조례가 2013년 9월 1일부터 시행되고 있으나 이는 외국인에게만 적용되는 규범임.
□ 중국 출입국관리법의 규제범위는 크게 국민의 출입국(경),외국인의 출입국(경), 외국인의 중국내 체류·거류의 관리,교통운송수단의 출입국(경)에 대한 심사로 요약할 수 있음.
- 중국 국민이 출입국(경)을 위해서는 여권 또는 그 밖의 여행증서를 소지하여야 함.
- 중국 국민이 홍콩, 마카오, 대만을 출입경하기 위해서는 여권이 아닌 별도로 절차의 통해 통행증을 발급받아야 함.
- 중국 국민은 거주이전의 자유가 인정되지만 6가지의 출국제한사유를 정함.
- 개정된 출입국관리법 및 출입국관리조례에서는 구법에 비해 사증의 종류를 세분화하여 항구사증을 포함하여 17가지 사증으로 그 종류를 확대함.
- 사증발급의 면제는 사증면제협정이 적용되는 경우, 유효한 거류증(거주증)을 소지한 경우, 중국을 경유하는 경우에 가능하고 이 중 중국을 경유하는 경우에는 종래 24시간까지 무사증 경유를 허용하였으나 국무원 승인을 받은 주요도시(현재 9개 도시)는 72시간무사증경유정책을 채택하였고 앞으로 다른 도시로 확대될 것으로 예상됨.
- 중국의 출입국관리법에서는 교통운송수단의 출입국심사에 대해서도 규정하고 있음.
- 출입국관리법은 외국인은 체류 및 거류를 180일을 기준으로 하여 엄격하게 구분하고 있음. 체류와 거류를 구분하는 이유는 장기거류 외국인에 대한 관리감독의 강화의 목적이 크다고 봄. 180일을 초과하여 거류하는 경우에는 사증을 거류증으로 전환하여 발급받아야 함.
- 체류, 거류에 구분없이 외국인이 숙박업소 이외의 장소에서 숙박하는 경우, 24시간 이내에 공안기관에서 주숙등기를 하도록 하는 주숙등기제도를 개정 출입국관리법에서도 존치시키고 있음. 주숙등기의무 위반에 대한 감독도 강화되고 있고 의무위반에 대한 과태료도 상향조정함.
- 거류증은 취업류 거류증과 비취업류 거류증으로 크게 구분되는데 중국 내 취업을 위해서는 취업류 거류증을 발급받아야 함. 특히 중국 내 불법취업에 대한 감독 및 제재가 강화되는 추세에 있음에 유의하여야 함.
- 개정 출입국관리법에슨 중국판 그린카드 제도(영구거류제도)를 법제화하였음. 국제적 인재, 외국인 직접투자 및 선진기술을 받아들이기 위해서 영구거류제도를 설립하였음. 그러나 현재까지 영구거류증을 취득하는 데에는 많은 어려움이 있음. 취득조건이 매우 까다롭기 때문에 영구거류증을 취득한 외국인의 수는 아직까지는 많지 않음.
□ 중국은 난민에 관한 국제협약에는 가입되어 있으나, 국내법으로서의 난민법을 별도로 제정하지 않고 있음.
- 다만 중국 출입국관리법에서는 난민을 신청한 외국인은 난민의 지위를 확인하는 기간 동안 공안기관이 발급한 임시 신분증명서를 소지하여 중국 경내에서 체류할 수 있으며, 난민 지위가 확인된 외국인은 공안기관에서 발급한 난민 신분증명서를 소지하고 중국 경내에서 체류·거류할 수 있다고 규정하여 난민을 실질적으로는 인정하고 있음.
- 실무에서는 난민협약과 난민의 지위에 관한 의정서에 의해 난민에 관한 처리를 하고 있음.
- 2014년 7월 2일 현재 중국에 거주하는 난민은 138명이고 410명이 난민보호신청서를 제출한 상황임. 탈북자의 난민인정에 대해서는 유엔권고를 받아들이지 않고 탈북자를 난민으로 인정하지 않고 있어 국제적 논란이 발생하고 있음.
□ 중국의 국적법에서는 부모양계혈통주의, 보충적 출생지주의를 취하고 있음. 다만 부모 쌍방 혹은 일방이 중국국민이면서 외국거주하며, 본인출생과 동시에 외국국적을 보유하면, 중국국적은 취득되지 않아 복수국적을 철저히 배척하고 있음.
- 가족법상 인지제도는 인정되지 않지만 부자관계존부확인소송 등을 통해 실무상 인지를 인정하고 있음. 그러나 인지에 의한 국적취득절차는 국적법에서도 규정하지 않고 있음.
- 중국 국적취득을 위하여 제출하는 서류 중에는 영구거류증을 포함하고 있어 영구거류증의 취득이 전제조건이 되며, 영구거류증 취득 후에 귀화를 신청할 수 있도록 하여 귀화에 영주권전치주의를 취하고 있음.
Ⅲ. 기대효과
□ 국내적 전속관할권으로 인정되는 영역(예컨대 사증발급, 입국심사)에서부터 타 법과의 연계성이 강한 영역(예컨대 국적법, 난민법)까지 한국과 중국의 관련 법제를 비교법적 방법으로 소개함으로써 양국의 관련 법제에 대한 이해도를 제고할 것으로 기대함.
□ 중국 체류교민들의 현지 법제에 대한 이해 제고와 우리 정부의 한국 체류 중국인에 대한 체류관리 정책에 기여할 것으로 기대함.

□ China is a country where Korean nationals travel most for the various purposes of tourism, business, study and in this context, the Exit and Entry Administration Law of the People’s Republic of China(中華人民共和國出入境管理法) is the law which has the biggest impact on an entry to China, safe stay and convenience.
□ The Exit and Entry Administration Law of the People’s Republic of China has been implemented since the July 1, 2013, and the Law of the People’s Republic of China on Control of the Entry and Exit of Aliens and the Law of the People’s Republic of China on Control of the Entry and Exit of Citizens has been repealed.
- The Regulations of the People’s Republic of China on Administration of the Entry and Exit of Foreigners(中華人民共和國外國人入境出境管理條例) as a sub rule of the Exit and Entry Administration Law of the People’s Republic of China is effective from September 1, 2013 and is being applied to the immigration of managers and family members of the Korean invested enterprises into China.
□ The Exit and Entry Administration Law of the People’s Republic of China and the Regulations of the People’s Republic of China on Administration of the Entry and Exit of Foreigners specify six kinds of situations in which the issue of visa is not permitted, but legal clarity is not secured because it is not required to mention the regulatory reasons in case of denied visa by the concerned authority.
□ In addition, the upper limit of the visa period of stay was reduced by up to 180 days, while the longest period of validity of five years residence permit, residence permit review period of 15 days are prescribed in the Immigration, having a profound impact on foreign investment and immigration.
□ Tn this study, there is a need to derive certain implications for the cross border movement of personnel and to scrutinize Immigration Act through a detailed comparative legal analysis to ensure the legal clarity and smooth the economic exchange between two nations
II. Main Contents
□ This report covers details of Immigration Act, Nationality Act, Refugee Act concerning immigration control of nationals and foreigners, management of foreigners’ legal residence, nationality acquisition and recognition of refugee status.
□ Immigration Act stipulates matters regarding safer border control through immigration control of nationals and foreigners, and management of foreigners staying in the Republic of Korea.
- Possession of a valid passport is required of both foreigners and nationals who wish to enter into or depart from the Republic of Korea. For foreigners, the type of visa must correspond to the purpose of entry. However, a foreigner may enter without a visa for tourism or visitation if he/she is a national of: (i) a country that has signed a Visa Waiver Agreement with the Republic of Korea thus becomes a subject of visa exemption, or (ii) a country that is granted visa free entry permission by Minister of Justice of the Republic of Korea.
- In principle, Korean nationals have the right to enter or leave the country, and foreigners have the right to leave the Republic of Korea. However, The Minister of Justice may prohibit the departure of a person who is deemed inappropriate to leave the country for pending criminal trial/investigation or tax default.
- Foreigners are granted rights to activities permitted under the status of stay, and may stay as long as their granted period of stay. Eligible applicants and scope of activities are specified by status type (36 in total), ranging from Diplomacy (A-1) to Working Visit (H-2).
- If a foreigner intends to be employed in the Republic of Korea, the person shall obtain the status of stay where employment is allowed. A foreigner who has obtained such status of stay shall be employed only at the designated place of work.
- No one shall employ, recommend, or place a person in jobs without the person being permitted to work under his/her status of stay. Those who have hired a foreigner eligible for employment shall report to the head of immigration office if any circumstantial changes occur such as dismissal no later than 15 days from the date he/she gains awareness thereof.
- If a foreigner intends to stay in the Republic of Korea for more than 90 days from the date of entry, the foreigner shall register as an alien with the head of immigration office that has jurisdiction over the place of residence. When a foreigner staying in the Republic of Korea intends to engage in activities corresponding to other status of stay than the granted one, the person shall obtain a permit from the Minister of Justice in advance, in order to engage in such activities in parallel with those allowed under the granted status of stay. Tn principle, a foreigner must leave the Republic of Korea and obtain a newly issued visa, if he/she no longer intends to engage in activities under the granted status of stay but instead commence activities permitted by other status of stay. However, those who find themselves in the aforementioned case and intend to change their status of stay accordingly, can make such applications without leaving the country.
- Violation of Immigration Act, i.e. illegal entry, failure to maintain a lawful status and/or engaging in unauthorized employment after admission, provides ground for deportation. Immigration officers may investigate foreigners that are suspected of being subject for deportation. An immigration officer may detain a foreigner, if the person presents concern to flee.
- A case on an immigration offender may not be prosecuted without an accusation that is filed by the head of immigration office. In a case involving an immigration offense for which no sentence of imprisonment will be imposed but penalties and fines, the head of immigration office may give a written notification to the offender to pay a penalty equivalent to fine. Criminal procedures are not required in such cases. Under the protection against double jeopardy, an immigration offender shall not be penalized for the same case if he/she has paid the penalty as notified.
□ Refugee Act is intended to stipulate matters on: (i) the status and treatment of refugees pursuant to the 1951 Convention relating to the Status of Refugees and the 1967 Protocol relating to the Status of Refugees, (ii) application for refugee status and refugee status determination procedure, and (iii) treatment of recognized refugee, humanitarian status holder, and refugee status applicant. The Act also governs the establishment and operation of Refugee Committee and the operation of Refugee Support Center.
- An alien in the territory of the Republic of Korea who wishes to attain refugee status may apply for refugee status by submitting an Application for Recognition of Refugee Status to the head of immigration office.
- The Minister of Justice has the authority to make a decision whether to recognize the applicant as a refugee. The Minister may, if deemed necessary, delegate such authority to the head of immigration office.
□ Nationality Act prescribes: (i) requirements for becoming a Korean national, (ii) requirements for foreigners to obtain Korean nationality, (iii) procedures for multiple nationals to choose nationality, (iv) grounds for loss of Korean nationality, (v) administration on persons who have lost Korean nationality, (vi) adjudication of a person’s nationality where it is unclear whether the person has acquired or is holding Korean nationality, and (vii) revocation of permissions, i.e. a person’s naturalization.
- In the Republic of Korea, the principle of jus sanguinis (right of blood) serves as a general rule, and the principle of jus soli (right of the soil) is only complementary. Children may automatically be Korean nationals at birth if his/her father or mother is a Korean national. Jus soli rule can be applied solely in those cases when the parents of the child are unknown or stateless.
- There are several paths to obtaining Korean nationality for foreigners. Korean nationality can be granted by acknowledgment (where a person is born to a non marital couple with one party being Korean national and the other foreigner),or through naturalization (subcategorized into general, summary, and special naturalization). Foreigners may also obtain Korean nationality through reinstatement of nationality or concomitant naturalization (where a minor child of a foreigner shall acquire Korean nationality at the time the Minister of Justice grants naturalization to his/her father if the child has concurrently applied for naturalization beforehand).
- A person who has acquired Korean nationality through
naturalization or reinstatement shall renounce his/her foreign nationality within one year from the date the person acquired Korean nationality. Those who have failed to do so before the specified period expires shall lose Korean nationality.
- A person who acquired multiple nationalities at the time of birth shall choose a nationality before fully turning 22 years of age.
- A Korean national who has voluntarily acquired a foreign nationality shall lose his/her Korean nationality at the time of acquiring a foreign nationality.
□ In China, the Exit and Entry Administration Law of the People’s Republic of China has been enforced since 1 July 2013, with the two existing Foreign Immigration Act and National Immigration Act repealed.
□ The Regulations of the People’s Republic of China on Administration of the Entry and Exit of Foreigners, a kind of Administrative regulations, enacted on the basis of the Exit and Entry Administration Law of the People’s Republic of China is effective from September 1, 2013, but it applied only to foreigners.
□ Regulation range of the Regulations of the People’s Republic of China on Administration of the Entry and Exit of Foreigners may be summarized as screening for immigration of the nationals, foreign immigration, foreign residence, means of transportation.
- Chinese nationals must be in possession of a passport or other travel certificate to the immigration.
- Chinese citizens are also required to obtain a separate pass, not a regular passport, through the procedure in order to access the environment in Hong Kong, Macao and Taiwan.
- Chinese citizens have freedom of residence and movement but six reasons for limiting the freedom exist.
- The law and the new ordinance of immigration compared to the old law subdivide the type of visa and expand its kind with 17 kinds of visa, including the port visa.
- The Law is strictly separate foreigner’s stay and residence based on the 180 days. The reason to distinguish between the residence and stay is to enhance the supervision of a long term resident foreigners. If the residence in excess of the 180 days must obtain residence permit issued by conversion of visa.
- Current residence permit can be divided into two kinds: one for employment and the other for non employment. It is also required to obtain a residence permit for employment in order to work in China. In particular, it should be noted that oversight and sanctions for illegal employment in China has been strengthening.
- The law stipulates Chinese version of Green Card Scheme (Permanent Residence program). It’s purpose is to accept a direct foreign investment, advanced technology and international talented personnels but there are many difficulties to obtain permanent residence permit. The number of foreigners who has acquired a permanent residence permit is not much yet because the acquisition conditions are very demanding.
□ Although China joined the Convention Relating to the Status of Refugees, a national law on refugees does not enacted separately.
- But, according to the Exit and Entry Administration Law of the People’s Republic of China, foreigners applying for refugee may be in possession of a temporary identity card issued by the public security organs during the period of stay to check the status of refugees in China precincts, and if foreign refugee status is identified by the public security organs, he or she is able to stay in China for residence by possession of a refugee identity card, which substantially admit the entity of refugees.
- In practice, the treatment of refugees is conducted by the Convention Relating to the Status of Refugees and the Protocol Relating to the Status of Refugees.
□ Nationality Law of the People’s Republic of China is stipulating Jus san guinis(right of blood) and complementary Jus soli(right of the soil). However, China has rejected the multiple nationalities thoroughly. For example, a person whose both parents and one are Chinese nationals and residing abroad, yet, if you hold a foreign nationality at the same your birth can not acquire citizenship.
□ The family law system does not stipulate acknowledgement but in practice nationality can be granted through lawsuit of Father son relationship confirming presence or absence. However, the Nationality doesn’t have provision on Citizenship procedures by the cognitive process.
