1. 서론
❏ 비도시지역은 전국토의 대부분을 차지하는 공간으로, 체계적 관리가 필요
○ 비도시지역은 전국토의 83.4%(88,589㎢)에 달하는 공간으로, 우리나라 육상면적의 대부분을 차지하는 중요한 공간임

○ 비도시지역은 전국토의 83.4%(88,589㎢)에 달하는 공간으로, 우리나라 육상면적의 대부분을 차지하는 중요한 공간임
❏ 그럼에도 우리나라의 국토·도시계획 정책은 도시지역 위주의 관리에 치중하여 비도시지역의 체계적 관리에는 크게 미흡한 실정(국토해양부, 2009:1)
○ 도시지역은 총 15종의 용도지역으로 세분화하여 관리하는 반면, 비도시지역은 단 5종의 용도지역으로 구분하여 관리하며, 지구단위계획의 경우에도 비도시지역은 도시지역에 비하여 개소, 면적 모두 절반수준에 불과함
○ 따라서 현재의 비도시지역의 관리는 개발행위허가제도에 상대적으로 많이 의존하는 양상을 보이고 있음
❏ 개발행위허가제도는 비도시지역의 관리 측면에서 적합하나, 운영 부담이 과중하고, 명확성, 형평성, 예측가능성 등의 문제가 제기
○ 개발행위허가제도는 재량권을 허용하고 있어, 지역에 따라 특성 차이가 큰 비도시지역을 동시에 관리하는데 유리하며, 적용 구역이 별도로 지정되어 있지 않아 개발의 전이효과가 발생하지 않는 큰 장점이 있음
○ 또한 개발행위허가제도는 개별 필지의 개발행위에 직접적으로 관여하기 때문에, 다른 제도에 비하여 세세한 관리감독이 가능함
○ 반면, 비도시지역의 개발행위허가건수는 2004년 31,338건에서 2012년 59,195건으로 두 배 가까이 증가하여, 제도 운영에 부담으로 작용
○ 개발행위제도 내부적으로도 개발행위허가의 체계가 불명확하고, 개발의 형평성 및 예측가능성이 저해된다는 문제가 꾸준히 제기
❏ 더욱이 용도지역 내 불허용도제로의 전환, 연접개발제한규정의 폐지, 허용용도의 확대와 규제완화 등 도시계획 규제방식도 전환기를 맞이하고 있음
❏ 따라서 본 연구에서는 현행 비도시지역 개발 양상에서 부각되는 이슈를 분석하고, 개발행위허가제 및 관련 제도의 문제점을 검토하며, 합리적인 비도시지역의 관리를 위한 개발행위허가제의 개선방안을 도출하고자 함

While non-urban area is accounting for 83% of entire territory in Korea, it has been difficult to systematically manage it, compared with urban area. As some developments are extended to the non-urban area, natural landscape is damaged, conflicts between land uses occur , and some negative external effects such as noise and environmental pollution happen. In addition, if the developments in the non-urban area are scattered, not concentrated, the cost to provide infrastructures is sharply increased.
Some efforts to address the above problems in the non-urban area have been attempted in the meantime. In 2003, the National Territory Utilization and Management Act being enacted, Management Area in non-urban area was sub-divided and development control for non-urban area was attempted: introducing Land Suitability Assessment, Impact Fee for Infrastructure, and District Unit Plan; in particular, adopting the Development Permit System to entire territory.
The Development Permit System is a representative deliberation permit system providing great discretionary power to administration of urban plan which has been rigidly operated. The regulations in non-urban area, are relatively looser than those in urban area, and Urban MasterPlan and Management Plan have few contents of regulations for the non-urban area compared with for urban area. Thus, the Development Permit plays a more important role in non-urban area than in urban area.
According to deregulation tend in the late 2000s, the regulation system of urban planing are also changed recently. Related with management systems of non-urban area, the Limitation of Combined Development was abrogated and the authority of urban plan committee was strengthened in 2009, and Growth Management was introduced in 2012. In 2014, development permit regulations were changed from previous positive regulation system to negative one, and related regulations were softened, and in turn, urban planning system in non-urban area is expected to be newly established. Overall the management system in non-urban area is gradually deregulated and restructured into the system based on planning and deliberation permit system.
There are three types of problems in non-urban area management system, co-related with current situations, management systems of non-urban area, and future changes are compounded trends tools measures. Thus, countermeasures for each sector should be developed and integrated improvements need to be derived. In particular, Development permission should be operated connected to the management system of non-urban area. More specific improvements are as follows:
① Urban Master Plan: giving guidelines character to sub-plans (Urban Management Plan and Growth Management Tool) and suggesting structure of urban space and management direction
② Urban Management Plan: proactively operating land use areas considering future demand and present conditions, through frequent maintenance of land use plan and adjustment of permitted building use considering local features.
③ Growth Management: establishing basicplans of growth management for entire non-urban area and sectoral plans for intensive control districts (principal roads and edges or outskirts of urban area)
④ Development Permission: extending District Unit Plan and Growth Management and minimizing the development permit processess; operating permit institution of development behaviors and deliberation system of urban plan in areas except for the areas with District Unit Plan and Growth Management, and intensifying review process of related critera.
In addition, Addressing inaccuracy of permit/deliberation criteria and burden of discretion, assessment standards should be objectified, and a checklist to produce general judgments should be introduced.
Moreover, grouping of small non-urban area developments can be considered. It is necessary to analyze land use surrounding regions within a radius of new developments. And some policies to review conflicts and similarities of the development and the use are required.
It needs to intensify the condition of deliberation permit for developing non-urban land such as forest and field. In developing corps and rice fields and forests, it is difficult to provide infrastructures, and it is likely to damage natural environments. Therefore, development demand should be induced to existing lands through simplification of development of the existing lands and intensifying development conditions of corps and rice fields and forests.
In conclusion, escaping from the development permission-dependent system, current management system of non-urban area should be transformed into the 'permission system based on plans'. In order to promote goals and purposes of the development permit system, beyond its internal improvements, maintenance of many kinds of plans and institutions to support it and be used as basic data and permit standard should be primarily conducted.
