Ⅰ. 연구배경, 목적 및 범위
▶ 「유통산업발전법」에 대한 사후적 평가의 배경과 목적
○ 「유통산업발전법」의 규제적 요소에 대한 사후적 입법평가 요구가 날로 커짐
- 대기업의 유통시장 잠식과 중소상인 몰락에 대한 우려에 근거하여 「유통산업발전법」상 진입규제와 행위규제적 요소들이 포함되었고, 그 규제의 실효성과 필요성에 대한 사회적 여론은 분화되어 왔음
- 중소상인에 대한 강한 보호조치가 필요하다는 차원에서 현행법상의 규제만으로는 불충분하다는 주장과 현재의 규제가 실효성 없이 대규모점포등에 대한 영업 손실
Ⅰ. 연구배경, 목적 및 범위
▶ 「유통산업발전법」에 대한 사후적 평가의 배경과 목적
○ 「유통산업발전법」의 규제적 요소에 대한 사후적 입법평가 요구가 날로 커짐
- 대기업의 유통시장 잠식과 중소상인 몰락에 대한 우려에 근거하여 「유통산업발전법」상 진입규제와 행위규제적 요소들이 포함되었고, 그 규제의 실효성과 필요성에 대한 사회적 여론은 분화되어 왔음
- 중소상인에 대한 강한 보호조치가 필요하다는 차원에서 현행법상의 규제만으로는 불충분하다는 주장과 현재의 규제가 실효성 없이 대규모점포등에 대한 영업 손실만을 낳을 뿐이어서 종래의 진흥법으로 회귀하여야 한다는 주장이 대립함
- 각각의 주장은 실제로 법 개정의 요구로 이어지고 있기도 한바, 현재 시점에서 입법 이후의 상황을 객관적으로 재평가하여 「유통산업발전법」에 대한 법 개정의 수요에 객관적인 분석을 제공할 필요성이 어느 때보다 커지게 됨
○ 본 연구보고서는 입법평가를 함에 있어서 다원적 방법론, 즉 전통적인 법학 방법론 외에 입법의 효과 및 영향을 분석하기 위한 다양한 사회과학적 기법과 방법론을 복합적으로 적용하여 입법영향평가 방법론에 대한 하나의 범례를 제공하는 것을 목적으로 삼음
▶ 사후적 입법평가의 대상 범위
○ 「유통산업발전법」상 규제 대상의 개념 및 범위의 규정 방식이 적정한지 여부에대한 분석을 실시함
○ 대규모점포등 개설 및 변경에 관한 규율(법 제8조)에서 정한 등록제도 및 전통상업보존구역 지정제도(법 제13조의3)에 대한 분석을 실시함
○ 영업시간 제한 및 의무휴업일 지정 규제(법 제12조의2)에 대한 분석을 실시함
○ 위 규제와 관련하여 「유통산업발전법」이 조례에 위임한 사항에 대해서는 해당 조례를 분석하여 각 규정이 법령의 취지에 부합하는지 여부를 검토함
▶ 연구의 방법
○ 「유통산업발전법」의 체계에 대해 규범적인 평가로서 문리적 해석, 체계적 해석, 법원의 유권 해석에 대한 분석을 수행함
- 특히 입법자의 주관적 의사를 확인하기 위해 「유통산업발전법」상 관련 규정의 입법사적 변천 과정과 내용을 분석하였음. 나아가 본 연구보고서의 효용성을 높이기 위해 현재 국회에 계류되어 있는 동법 개정안의 쟁점을 분석함. 이는 간접적으로 향후 개정 입법에서 쟁점이 될 사항에 대한 사전적인 분석으로서의 의미가 있음
○ 단순 상관관계 분석이 아니라 인과관계 분석이 가능하도록 여러 가지 실증적 연구방법론을 가장 합리적인 방식으로 도입하여 분석을 수행함. 무엇보다 「유통산업발전법」 시행 이후의 단순한 사실 확인을 지양하기 위하여 규제 시간 전후의 총체적 데이터를 최대한 활용하여 규제 이외의 다른 영향을 배제한 규제의 순효과를 평가하고자 한 데 특징이 있음
○ 먼저 계량분석에 있어서 시장의 내생성을 제거한 정책의 순효과를 추정하고자 최대한 적절하게 처치군과 대조군을 선정하여 이중차분법을 적용하였고, 활용 가능한 최대한의 기존 데이터를 분석 목적에 맞게 사용함. 영업규제가 전통시장 소상인은 물론 소매업태별 매출에 미친 효과를 분석하고, 준대규모점포(SSM)의 진입이 미친 효과를 시장이 처한 상황에 맞게 재조명함
○ 설문조사의 경우에는 기존 데이터들을 병합하여 얻은 정보를 바탕으로 설계단계에서부터 정책 영향의 순효과를 효율적으로 추정할 수 있도록 주의를 기울임. 특히 전통시장 소상인에 관한 설문에 있어서 위치 정보를 활용하여 각 전통시장의 위치가 대형마트 및 준대규모점포(SSM)로부터의 거리에 따라 그 영향 여부가 달라질 수 있음을 반영하여 시장을 선정하고 해당 조사를 수행함. 최종적으로 각 영향지역의 규제 효과가 무영향 지역과 대비하여 어떻게 나타나는지 분석함
○ 그 밖에도 정밀하고 객관적인 연구결과를 도출하는 차원을 넘어 전통시장 소상인, 일반 소비자 및 대형유통업체와 중·소유통업체 등 이해당사자들의 주관적인 의견을 청취할 수 있는 정밀한 설문조사를 수행함. 나아가 조사결과를 바탕으로, 각 규제의 경제적 실효성과 사회적 효용성을 비롯한 제반 이익 분석을 시도함으로써 다면적·입체적 입법평가를 수행함
Ⅱ. 유통산업발전법에 대한 입법평가의 기본적 토대 분석
▶ 「유통산업발전법」의 법적 체계와 주요 법적 수단
○ 「유통산업발전법」의 법체계를 내용적 관점, 맥락적 관점 및 수단적 관점에서 검토함
- 내용적 관점에서 「유통산업발전법」의 법체계를 분석한 결과 현행 「유통산업발전법」은 중소상인 보호 및 대·중·소 유통업 상생협력에 기초한 지역별·종류별 균형 발전에 중점을 두고 있음을 확인함
- 맥락적 관점에서 「유통산업발전법」의 법체계를 검토한 결과 「유통산업발전법」에 대한 규범적 평가와 사회과학적 분석은 그와 동일한 입법목적을 가진 유통산업 관련 법률들과의 체계적 관계성과 상호작용을 고려하여 수행되어야 함을 확인함
- 수단적 관점에서 「유통산업발전법」의 법체계를 검토한 결과 본 연구의 대상 조문에 따른 제도에 관한 세부사항을 조례에 정하도록 위임하고 있으므로 각 제도를 실질적으로 분석하기 위해서는 관련 조례에 대한 연구가 병행되어야 함을 확인함
○ 「유통산업발전법」의 주요 법적 수단으로서 대규모점포·준대규모점포(SSM)에 대한 진입규제와 행위규제 수단을 집중적으로 검토함
- 대형마트등의 출점을 통제하기 위한 진입규제 수단으로 개설계획예고제도(제8조의3), 개설등록 및 변경등록제도(제8조) 및 전통상업보존구역 지정제도(제13조의3)의 내용을 검토함
- 행위규제 수단으로 영업시간 제한 및 의무휴업일 지정제도(제12조의2)의 내용을 검토함
○ 「유통산업발전법」의 위임에 따라 조례에서 구체화된 「유통산업발전법」의 주요수단을 검토함
- 본 연구의 대상으로 선정된 57개 전통시장이 속한 8개 (특별·광역)시·도 소속 43개 기초자치단체의 조례를 면밀히 검토·분석함
○ 전통상업보존구역 지정제도의 현황을 요건, 범위, 절차로 분류하여 분석함
- 전통상업보존구역지정 요건은 지역 유통산업의 전통과 역사 보존의 필요성임
- 전통상업보존구역지정 범위를 정하기 위한 실체적 기준을 규정한 조례는 없음
- 전통상업보존구역지정 절차는 조례마다 상이한데, 사전공고, 주민의견 청취, 유통업상생발전협의회의 협의, 전통상업보존구역의 지정·변경·지정취소에 관한 사항 공시, 시장 등 상급 지자체에 대한 전통상업보존구역 지정·변경·지정취소에 관한 사항 제출 등이 다양한 조합으로 규정되어 있음
○ 등록제도의 현황을 대상, 기준, 절차, 제한 사유, 조건부과 사유 등으로 나누어 검토함
- 등록대상의 범위는 조례마다 차이가 있으며, 크게 대규모점포의 개설·변경 및 전통상업보존구역 내 준대규모점포의 개설·변경을 규정한 경우와 전통상업보존구역 내 대규모점포등의 개설·변경을 규정한 경우로 분류됨
- 등록기준도 조례마다 상이하지만 일반적으로 상권영향평가서 및 지역협력계획서의 적절성, 유통기업 간 상생발전에 대한 적합성, 중소상인의 경영상 이익 저해 우려 등이 기준으로 제시됨
- 등록절차는 대부분의 조례가 동일하게 규정하고 있는데, 등록기준에 부적합 또는 미진하다고 인정한 경우 사유를 명시하고, 기간 내에 필요한 조치를 취하도록 등록신청자에게 권고 또는 조언을 할 수 있으며, 이를 따르지 않을 때 유통업상생발전협의회의 협의 또는 중재를 요청할 수 있음
- 등록제한 사유도 조례마다 차이가 있으나, 일반적인 사유는 ⑴ 등록기준이 부적합하다고 인정하여 위의 절차에 따라 이루어진 유통업상생발전협의회 협의가 성립하지 않은 경우, ⑵ 유통산업의 전통과 역사 및 전통시장 등의 보존이 현저하게 어려운 경우, ⑶ 전통상업보존구역에 점포가 위치한 경우 등임
- 등록조건 부과사유도 조례마다 상이하나, 일반적인 사유는 ⑴ 등록기준이 부적합하다고 인정하여 위의 절차에 따라 이루어진 유통업상생발전협의회 협의가 성립하지 않은 경우, ⑵ 전통상업보존구역에 점포가 위치한 경우, ⑶ 유통산업의 전통과 역사 및 전통시장 등의 보존을 위해 필요한 경우, ⑷ 대규모점포등의 등록 사항이 생계형 자영업에 대한 사업개시 및 확장계획을 포함하는 경우 등임
- 개별 조례 규정에서는 등록조건을 부과할 경우에 대규모점포등의 개설사업에 대한 최소한의 제한, 주민 소비자의 후생 증진, 유통산업의 지역경쟁력 제고 등을 최대한 고려하여야 함을 명시함
○ 영업시간 제한 및 의무휴업일 지정제도를 목적 및 내용, 대상, 판단기준 및 고려 사항, 절차로 나누어 검토함
- 조례에 규정되어 있는 영업시간 제한 및 의무휴업일 지정제도의 목적과 내용 및 대상은 「유통산업발전법」에서 정한 바와 동일함
- 영업시간 제한 및 의무휴업일 지정에 관한 실체적 판단기준은 43개 조례 가운데 유일하게 한 조례에서 ⑴ 대규모점포등과 중·소유통업간 상생발전과 지역경제에 미치는 영향, ⑵ 유통산업 근로자의 건강권 보호 및 행복추구권에 미치는 영향, ⑶ 명절 등 특정 시기의 전통시장 상권 보호에 미치는 영향 등으로 정하고 있으며, 일부 소수의 조례에서 영업시간 제한과 의무휴업을 명하는 경우 인근자치구의 영업시간 제한 또는 의무휴업일 지정 현황 및 계획을 고려하여야 한다고 규정함
- 영업시간 제한 및 의무휴업일 지정 절차는 조례마다 다르게 정하고 있으며, 이해 당사자의 의견 청취, 유통업상생발전협의회의 협의, 행정절차법상 처분절차(사전통지, 의견제출 기회 제공 등), 영업시간 제한 및 의무휴업일 지정 사항 공고 등의 절차를 조합하여 정하고 있음
▶ 관련 조항의 법해석에 대한 사법 해석의 내용
○ 대법원은 현재 「유통산업발전법」에 따른 규제 처분이 적법한 범위 내에 있다고 판단함
- 대법원은 헌법 제119조 제1항과 제2항을 규제입법에 대한 심사기준으로서 대등한 가치를 지닌 것으로 파악하면서, 각 조항에 따른 기본원칙과 실천원리를 경제 규제입법의 합헌성 판단 기준으로 제시함. 또한 이를 근거로 현행 규제 제도의 정당성을 인정함
- 대법원은 현재의 등록제 규제를 ‘수리를 요하는 신고’에 해당하는 것으로 해석함
- 대법원은 입법목적과 규제의 정당성을 인정하면서도 개별 규제적 처분의 적법성 여부에 대해서는 재량권 일탈·남용의 관점에서 심사하고 있는데, 현재의 규제가 재량권을 일탈·남용하여 위법한 것으로는 보이지 않는다고 판시함
- 그 밖에 대법원은 현실적으로 존재하는 대형마트 형태들이 법률상 ‘대형마트’개념에 포함되는 데 문제가 없다는 점을 확인함. 대법원 다수의견은 ‘임대매장’도 이에 포함된다고 보고 있으며, 이에 대해 소수의견의 문제점 지적도 있었음
Ⅲ. 현행 「유통산업발전법」에 대한 사회과학적 효과 실증연구
▶ 「유통산업발전법」상 규제의 경제적 · 사회적 효과 분석
○ 변화하는 유통 환경과 시장 구조에 대한 이해를 바탕으로 규제 효과에 대응하는 경제주체의 최적선택 결과와 그 흐름을 입체적으로 조망
○ 대형마트와 준대규모점포(SSM)의 입점포화도, 타 소매업태와의 유기적 관계 등을 토대로 「유통산업발전법」상 주요 규제 효과를 사회·경제학적 차원에서 실증 분석함
▶ 학제간 연구방법론 적용을 통한 「유통산업발전법」에 관한 입법평가
○ 공신력 있는 기관에서 제공하는 객관적인 데이터를 최대한 활용하여 계량경제학적으로 실증 분석하는 한편, 기존의 데이터로 분석이 불가능한 영역에 대해서는 설문을 설계하여 조사를 시행함
○ 계량경제학적 분석에서는 시장의 내생성을 제거한 정책의 순효과를 추정하고자 최대한 적절하게 처치군과 대조군을 선정하여 이중차분법을 적용하였고 활용 가능한 최대한의 기존 데이터를 분석 목적에 맞게 활용함
○ 주요 계량경제학적 분석 수행
- 영업규제가 전통시장 소상인에게 미친 중기 효과 분석
- 영업규제가 소비자에게 미친 단기 효과 분석
- 영업규제가 소비자에게 미친 중장기 효과 분석
- 준대규모점포(SSM)의 신규 입점 효과 분석
○ 설문조사의 경우 유통산업 내 이해관계가 다른 여러 경제 주체들로부터 추가적인 사실 관계를 파악하고, 의견 청취를 통해 「유통산업발전법」상 규제에 대한 인식과 평가를 측정함
○ 주요 설문조사의 설계 및 시행
- 전통시장 소상인 대상 설문 분석(총 57개 시장, 600개 점포)
- 일반 소비자 대상 설문(총 1,980명)
- 대형유통업체 및 중·소유통업체 대상 설문
▶ 계량경제학적 분석 결과
○ 영업규제가 전통시장 소상인에게 미친 중기 효과 분석 결과
- ‘무영향 시장’에 비하여 ‘대형마트영향 시장’과 ‘SSM영향 시장’에서의 점포별 일별 매출액 및 방문 고객 1인당 지출액이 규제 이전 시점인 2011년 대비 2014년과 2015년 모두 증가함
- 다만 2014년(대형마트 8.1만원, SSM 4.7만원)에 비해 2015년(대형마트 7.2만원, SSM 3.2만원) 일별 매출액은 약간 감소함
○ 영업규제가 소비자에게 미친 단기 효과 분석 결과
- 규제 대상 대형마트를 이용하던 기존 고객들의 대형마트 지출액이 월평균 약 1.9만원 감소하였고, 감소분은 대부분 전통시장과 준대규모점포(SSM)로 이전됨
- 「유통산업발전법」상 규제 대상이었음에도 준대규모점포(SSM)에서의 지출이 증가한 이유는 주말에 대형마트를 이용하지 못한 소비자들이 평일에 준대규모점포(SSM)에서 구매하는 비중이 높아졌기 때문인 것으로 확인됨
- 상대적으로 평일에 시간적 여유가 있는 전업주부의 경우 전통시장 이용을 늘린 반면, 비전업 직장 여성은 주로 준대규모점포(SSM)의 이용이 늘어난 것으로 관측됨
○ 영업규제가 소비자에게 미친 중장기 효과 분석 결과
- 대형마트에 대한 규제 효과는 지속된 반면(약 2.4만원 감소), 준대규모점포(SSM)의 경우 그 효과가 사라짐
- 사실상 대형마트와 대체관계에 있는 하나로클럽/하나로마트에서의 지출액은 규제기간 동안 상당히 증가(약 0.8만원)한 것으로 확인됨
- 전통시장에서의 지출은 소비자가 평소 전통시장을 이용하는 고객인 경우에 한해 규제기간 동안 상당히 증가한 것으로 나타남(약 3.7만원)
- 또한 온라인 및 무점포소매가 전보다 증가함(약 1.3만원)
○ 준대규모점포(SSM)의 신규 입점 효과 분석 결과
- 준대규모점포(SSM) 입점에 따라 대형마트에서의 소비자 지출은 줄어든 반면에, 준대규모점포(SSM)와 전통시장에서의 소비자 지출은 모두 증가하였음
- 다만, 교통 혼잡이 심한 도시 지역에 비해 교통이 편리한 지방 소도시에서는 준 대규모점포(SSM)의 입점이 전통시장의 매출 증진에 미치는 영향이 상대적으로 약할 수 있음
- 따라서 중소도시의 경우 신규 입점하는 준대규모점포(SSM)가 가공식품만을 취급하는 등 보다 강화된 상품차별화 전략을 도입하여 지역협력을 모색한다면, 전통시장의 매출 증진에 더욱 긍정적인 효과를 미칠 것으로 예상함
▶ 설문조사 분석 결과
○ 전통시장 소상인 대상 설문조사 분석 결과
- 2016~2017년 월 평균 매출액은 감소추세이나 ‘무영향 시장’에 대비하면 ‘대형마트영향 시장’과 ‘SSM영향 시장’에서 각각 5.1%, 7.1%로 증가함
- 이러한 효과는 특히 ‘대형마트영향 시장’에 있어 2,4주 일요일의 매출 상승으로부터 기인한 것으로 분석되며 「유통산업발전법」상의 의무휴업일 지정제도가 ‘대형마트영향 시장’에 보다 직접적인 영향을 미치는 것으로 확인됨
- 의무휴업일 지정제도 시행 이후 전통시장 소상인의 활동과 관련하여 약 51.0%가 ‘별도로 준비하는 것이 없다’고 응답했으며, 이는 개별 점포 차원에서 체계적이고 계획적인 마케팅 활동 등의 변화를 모색하기가 사실상 어렵거나 불가능하다는 사실을 반증함
- 한편 ‘대형마트영향 시장’은 농수산물직영점(94.5%)을, ‘SSM영향 시장’은 백화점(80.5%)을 각각 향후 추가 규제 필요성이 가장 큰 대상이라고 응답함
○ 일반 소비자 대상 설문조사 분석 결과
- 「유통산업발전법」상 대형마트 영업시간 제한 및 의무휴업일 지정제도에 대하여 상당히 높은 인지도(총 1,980명의 응답자 중 약 91.3%)와 순응도(약 66.7%)를 보임
- 하지만 규제를 강화하거나 완화하기보다는 ‘현행 규제를 유지해야 한다’는 응답(58.4%)이 주를 이루고 있음
○ 대형유통업체 및 중·소유통업체 대상 설문조사 분석 결과
- 각 대형유통업체별로 상권영향평가서와 지역협력계획서의 담당자가 한 명씩(총 3명) 응답하였으며, 중·소유통업체의 경우도 응답률(총 24개 점포)이 예상보다 저조하였음
- 통계적으로 유의한 결과를 도출하는 데 한계가 있었음에도 불구하고 각 업태별 입장을 확인한 것에 의의가 있음
- 중·소유통업체의 경우, 현행 상권영향평가서가 상권에 미칠 영향을 파악하는 데 최소한의 효용을 가지고는 있지만 보다 객관적·전문적으로 운영될 필요성이 있다고 인식함
- 반면 중·소유통업체의 경우, 현행 지역협력계획서가 상생에 크게 도움이 되지 않는다고 인식하고 있어 향후 제도 보완 방향에 대해 함의하는 바가 큼
Ⅳ. 입법평가의 결과
▶ 규제 대상에 대한 입법평가
○ 현행법의 규제 대상 확정 방식은 수정이 필요함
- 점포 규모와 소유관계를 복합적으로 적용하기보다 기준 면적을 현재보다 낮추더라도 규모 기준으로 규제 대상 선정을 단순화하는 것이 바람직함
- 준대규모점포(SSM) 규제는 규제의 실제 효과와 전통시장과의 보완적 운영 가능성을 감안하여 대규모점포 규제와 차별화하는 방안을 검토해 볼 만함
- 법령에서 대규모점포등에 대해 그 하위 유형을 거래형태, 거래방식, 상품 등 다양한 기준에 따라 분류하는 것은 불필요하거나 새로운 규제에 대응하기 곤란하게 할 수 있으므로 단순화하는 것이 바람직함. 대표적으로 현재의 세부 분류 기준을 보면 ‘복합쇼핑몰’ 개념이 포함되어 있으나, 이 개념은 규제 판단의 요건을 구성하는 것이 아니라 설명적인 개념에 그치고 있어 이에 대한 별도의 규제를 하려면 개념 자체의 재정립이 요구됨
○ 규제 대상의 범위 확정에서 합리성과 형평성을 보완할 필요가 있음
- 대법원의 유권해석에 따르면 현행법은 대규모점포 내에 입주하는 입점사업자도 규제 대상에 포함되는 것으로 판단함. 다만, 입법론적으로 이와 같은 규제가 합리적인지는 규제목적의 달성 여부 차원에서 재고의 여지가 있음
- 규제형평성 차원에서 법 제12조의2 제1항 단서 조항은 삭제하는 것이 바람직함.
이 경우 농수산물유통업자의 보호에 대한 별도의 보호조치가 필요한지는 검토가 요구됨
- 준대규모점포(SSM)의 경우에는 규제 효과가 통계적으로 유의하지 않은 것으로 드러난 점을 감안할 때 준대규모점포(SSM)와 전통시장과의 상호보완관계를 증진할 수 있는 규제와 유인책을 사용하는 것을 검토해 볼 만함
▶ 현행 등록제에 대한 입법평가
○ 현행 등록제는 대법원 판례의 해석론도 지적하다시피 ‘수리를 요하는 신고’로 이해되나, 수리 여부를 결정하는 기준은 별도로 규정되지 않아 자의적인 제도 운영의 가능성이 있음

▶ Methodology
○ This report utilizes the statutory interpretation methods in an effort to conduct normative analyses of the Act. In order to identify the intent of the legislators, this report looks into the legislative history of the Act. It also examines the various proposed amendments of the Act currently pending at the National Assembly.
○ Statistical techniques and econometrics, the most optimal empirical methodologies among all available ones are chosen to identify causal relationships rather than simple correlations. In an attempt to go beyond simply confirming facts, this research uses comprehensive data on the period before and after the enactment of the regulations, with which it estimates the net effect of the regulations, excluding other influences.

○ The statutory regime of the Act is reviewed focusing on its content, context, and instruments.

○ It empirically analyzes major regulatory impacts under the Act from the socioeconomic perspectives as well as based upon the entry saturation of LDSs and SSMs and their relationship interlinked with other small retailers.
▶ Multidisciplinary Research Methods Adopted for Legislative Assessment on the Act
○ Empirical analyses are conducted from econometrical perspectives with official data to the possible extent. As for the areas impossible to analyze with existing data, surveys are carefully designed and conducted.

- It is confirmed that consumers’ expenditures at Hanaro club and Hanaro mart, which are strong substitutes for LDSs, increase substantially (approximately KRW 8,000), while the regulations are in force.
- The expenditure at traditional markets increases considerably among consumers who usually go shopping at traditional markets (approximately KRW 37,000) during the regulation period.
- An increase at the online and non-store expenditures is found (approximately KRW 13,000).
○ Entry effect of new SSMs
- With the entry of a SSM, consumers spend more both at SSMs and traditional markets while they spend less at LDSs.
- The entry effect of SSMs on the increase in the revenue at traditional markets is relatively weak in local areas with smooth traffic condition compared with urban areas with frequent traffic congestion. Therefore, in small local towns, the entry of SSMs may bring a positive and substantial impact on revenue growth in traditional markets with a stronger product-differentiation strategies, for example, selling only processed foods at the SSMs, for regional collaboration.
▶ Analyses of Survey Results
○ Survey on small retailers of traditional markets
- The average monthly revenues decline from 2016 to 2017 regardless of market locations. However, those in the “LDS’s influential market” and “SSM’s influential market” relatively increase by about 5.1% and about 7.1% respectively, compared with those in “no influence market.”
- Such effects are attributed to the revenue growth on the 2nd and 4th Sundays, especially at the LDS’s influential market. The mandatory business closures forced by the Act are found to directly affect the “LDS’s influential market.”

○ As the Distribution Industry Development Act aims to establish legal instrument striving to achieve a balanced development within the distribution industry, it is advisable that the Ministry of SMEs and Startups actively promotes traditional markets by adopting laws and regulations pro-actively.
○ On the other hand, the survey on small retailers of traditional markets reveals that their proactive effort for development is significantly lacking. This suggests that traditional markets may have structural limitations for growth and co-development, and therefore, it is meaningless to urge them to find ways to grow their own businesses. With this in mind, it is important to implement and strengthen laws and regulations that force co-living and collaboration between the different sectors of the distribution industry, and facilitate customized support going forward.
