Ⅰ. 배경 및 목적
▶ 지하에 매설된 전기, 가스, 열공급시설 및 통신시설에 대한 통합적인 데이터와 통계구축 미비
○ 우리나라의 지하에 매설된 전기, 가스, 열공급시설 및 통신시설의 경우에 건설과정에 있어서 장기적·구체적인 계획 없이 개발정책을 수립하고 시행하였기 때문에 지하에 매설되어 있는 전기, 가스, 열공급시설 및 통신시설의 에너지시설에 대한 통합적인 데이터와 안전검사에 관한 통계자료를 제대로 구축하지 못하고 있는 실정임
▶ 무분별한 지하라이프라인 개발정책으로 인한 지반침하(싱크홀)가 지속적으로 발생으로
Ⅰ. 배경 및 목적
▶ 지하에 매설된 전기, 가스, 열공급시설 및 통신시설에 대한 통합적인 데이터와 통계구축 미비
○ 우리나라의 지하에 매설된 전기, 가스, 열공급시설 및 통신시설의 경우에 건설과정에 있어서 장기적·구체적인 계획 없이 개발정책을 수립하고 시행하였기 때문에 지하에 매설되어 있는 전기, 가스, 열공급시설 및 통신시설의 에너지시설에 대한 통합적인 데이터와 안전검사에 관한 통계자료를 제대로 구축하지 못하고 있는 실정임
▶ 무분별한 지하라이프라인 개발정책으로 인한 지반침하(싱크홀)가 지속적으로 발생으로 국민의 생명권과 신체의 자유 및 재산권을 위협
○ 우리나라는 30-40년간의 압축적인 근대화를 목표로 짧은 기간을 정하여 수단과 방법을 가리지 않은 “토건국가”, “성장지상주의”, “빨리빨리”라는 최고의 가치로 삼아서 매년 각종 대형사고로 수 많은 인명과 재산상의 피해가 발생하고 있음
○ 특히, 무분별한 지하라이프라인 개발 정책으로 인하여, 2007년 서울 서대문구 가좌역 부근의 지반침하(싱크홀 )발생, 2012년 인천 지하철 공사장 지반 침하, 2014년 7월 영종도 하늘 도시 스카이뷰 붕괴, 2014년 서울 잠실역 인근 석촌호수에서 발생한 싱크홀, 2017년 12월 21일 새벽 1시 38분 서울 강서구 가양동 도로에서 중압 도시가스 배관 파열사고 및 2018년 8월 31일 서울 금천구 가산동의 아파트 인근 도로에 지반침하(싱크홀)사고, 2018년 9월 6일에 발생한 서울 상도동 다세대주택 공사현장 공사로 인하여 상도초등학교 유치원 건물이 붕괴되는 사고가 계속 발생하고 있음
○ 뿐만 아니라 2016년 9월 12일에 발생한 5.8 규모의 경주지진 및 2017년 11월 15일에 발생한 5.4규모의 지진 등으로 인하여 지하에 매설된 전기설비, 도시가스 배관, 열공급시설 및 통신시설이 붕괴되어 국민의 생명과 신체 등의 안전을 위협하게 되었다는 측면에서 전 국민들에게 극도의 불안감을 증폭시켰으며, 지하라이프라인의 안전관리에 관한 문제가 전국적인 관심사로 제기되고 있음
▶ 특히, 울산광역시의 경우에 노후화된 배관망이 복잡하게 얽혀있어 사고발생 가능성이 농후함
○ 우리나라의 산업수도라고 할 수 있는 울산광역시의 경우에 석유화학단지와 온산 국가산업단지의 지하에 매설된 라이프라인인 전기통신: 90.8킬로미터, 가스관: 572.2킬로미터, 송유관: 158.9 킬로미터, 화학관: 821.1 킬로미터 등 배관이 모두 1774.5킬로미터로 20년에서 50년이 지난 노후화된 배관망이 복잡하게 얽혀 되어 있음으로 지진 등의 사고가 발생하는 경우에 대형재난이 발생할 가능성이 농후함
▶ 지하에 매설된 전기, 가스, 열 및 통신시설에 대한 사전예방·사후안전관리의 규제체계 분석을 통하여 법제개선 방안 도출
○ 2011년부터 2016년까지 우리나라에서 발생한 지반침하(싱크홀)사고가 3,600여건이 발생했다. 그 이유가 지하에 매설된 전기, 가스, 열 및 통신시설들이 20년 이상 노후화된 전기가 67%, 공동구가 64% 등 지속적으로 증가하고 있음
○ 최근에도 계속 서울, 인천, 대구, 대전, 포항, 부산 등의 도심지에서 지반침하(싱크홀)사고가 잇달아 발생하면서 국민들의 뇌리 속에 불안감이 커지고 있고, 인적·물적인 피해가 증가하고 있음
○ 따라서 지하에 오랫동안 매설된 전기, 가스, 열 및 통신시설인 라이프라인은 국민들의 생활과 국가의 산업발전에도 절대적인 영향을 미치는 중추적인 필수공익설비로서 혁신성장이라고 할 수 있는 에너지산업과 기술 정책개발에도 안정적으로 전기, 가스, 열에너지를 공급하여야 하기 때문에 지하에 매설된 전기, 가스, 열 및 통신시설에 대한 사전예방·사후안전관리의 규제체계 분석을 통하여 법제개선 방안을 도출하고자 함
Ⅱ. 주요 내용
▶ 지하라이프라인의 안전관리를 위한 「헌법」 상 국가의 안전보호의무 이론 분석

▶ 주요국의 지하라이프 라인 안전관리 법제 분석
○ 미국
- 미국은 지하 라이프라인의 안전규제체계와 관련하여 위험물질과 파이프라인 검사체계로 구성하고 있음
- 미국은 가스배관과 관련하여 배관상태, 부식, 결함, 오염 등의 상태를 검사할 수 있는 자동화시스템을 구축하고 있음
- 이와 더불어 미국은 사용자가 스스로 위반한 사항에 대하여 연방에너지규제위원회에 신고를 통하여 벌칙을 경감해주는 “자체신고제도”를 마련하고 있으며, 특히, 미국의 루지애나 주는 굴착 및 철거, 긴급굴착, 피해예방조치, 기금 등에 관한 규정을 통하여 지하 라이프라인에 관한 안전규제를 마련하고 있음
○ 영국
- 영국도 지하서비스와 관련된 법령은 존재하고 있으나, 지하서비스와 관련된 직접적인 법령이 없다는 점에서 체계적인 안전관리와 유지를 하고 있지 않음
- 영국은 보건안전청을 통하여 작업장의 보건과 안전에 관한 검사를 하고 있는 점을 발견할 수 있고, 지하서비스 안전검사는 민간에서 주로 이루어지고 있음
- 특히, 영국은 도시계획시행자로 하여금 모든 장치에 대한 검사 및 기록을 제공하도록 하고 있으며, 이러한 지하서비스 기록을 시행하고 유지하도록 함으로써 지하서비스 내에 작업을 수행할 권한을 가진 자에게 무료로 열람하고 점검을 할 수 있도록 하고 있음
○ 독일
- 독일은 전기, 가스, 통신 등의 지하 라이프라인과 관련하여 연방네트워크청(BNetzA)이 관할하고 있으나, 지하 라이프라인 안전관리를 위하여 통합적인 법률은 마련하고 있지 않음
- 특히, 독일의 에너지사업법 제49조에서 전기안전과 가스안전을 다루고 있는바, 구체적으로 전기안전에 대한 기술적 사항은 독일 전기기술협회(VDE)의 기술규정을, 가스안전에 대한 기술적 사항은 가스 및 수자원협회(DVGW) 기술규정을 따르도록 정하고 있음
- 따라서 독일은 연방차원에서 안전규정을 마련하는 방식보다는 기술적 안전사항에 관한 관리 및 감독권을 중시하여 전기, 가스, 통신 등의 지하라이프라인 관련 법령이 통합하여 규정하고 있지 않고 개별 법령의 몇 개의 조문으로 구성되어 있음
○ 일본
- 일본은 미국, 영국, 독일의 국가와 달리 지하 라이프라인인 전기설비, 가스배관, 열공급시설, 통신시설에 대한 안전규제를 도모하기 위하여 명시적으로 지하에 대한 규제를 마련하는 것은 아니지만 「전기사업법」, 가스 3법인 「가스사업법」, 「고압가스보안법」, 「액화석유가스의 보안의 확보 및 취급의 적정화에 관한 법」, 「전기통신사업법」, 「대심도 지하의 공공적 사용에 대한 특별조치법」 등의 법제를 마련하고 있음
○ 시사점
- 미국, 영국, 독일, 일본의 주요국가의 지하라이프라인 관련 법제도 등을 분석해 보았으나, 지하 라이프라인 안전규제와 관련하여 최적화되게 규율하고 있지 않음을 발견할 수 있었고, 미국, 영국, 독일의 경우에는 안전관리체계를 민간이나, 공인검사기관, 협회 등을 통하여 “사업자 중심의 자율안전관리체계로 전환하고 있다”는 점이 특징임
- 일본의 경우에는 우리나라의 법제와 유사하게 「전기사업법」, 가스 3법인 「가스사업법」, 「고압가스보안법」, 「액화석유가스의 보안의 확보 및 취급의 적정화에 관한 법」, 「전기통신사업법」등을 개별규정을 통하여 사전-사후적인 안전관리체계를 구축하고 있다는 점이 특징임
▶ 지하 라이프라인 안전관리 실현을 위한 법제 방안 제시
○ 개별 법률상 지하 라이프라인 관련 법제도 개선방안 제시

○ 지하라이프라인의 안전관리 규제체계 분석을 통한 문제점 분석을 통하여 개별법과 특별법상의 법제개선 방안의 기초자료로 활용
○ 지하에 오랫동안 매설된 전기, 가스, 열 및 통신시설인 라이프라인에 관한 법제 개선방안 제시를 통하여 혁신성장이라고 할 수 있는 에너지新산업과 新기술 정책개발을 안정적으로 할 수 있도록 하는데 기여함

○ In the Republic of Korea, policies for the development of underground facilities for the supply of electricity, gas and heat and telecommunications systems have been established and implemented, in the course of construction, without detailed long-term plans, and consequently no appropriate system has been established for the integrated management of data about underground facilities for the supply of electricity, gas and heat and about energy facilities for telecommunications systems, let alone statistical data about safety inspections.
▶ People's Right to Life, Personal Freedom and Property Right Threatened by Continuous Occurrence of Land Subsidence (Sink Holes) due to Policies for Haphazard Development of Underground Life-Lines
○ As a consequence of policies implemented during last 30 to 40 years in the Republic of Korea with an aim to attain compressed modernization within a short period by all means, placing the highest value on “construction state”, “growth- at-all-costs”, and “hurry-up culture”, a variety of big accidents have been occurring to cause massive human casualties and property damage every year.
○ In particular, policies for haphazard development of underground life-lines have continuously caused accidents: the land subsidence (sink hole) near Gajwa Subway Station in Seodaemun-gu, Seoul in 2007; the land subsidence at the construction site in Incheon for a subway line in 2012; the collapse of a construction site of the Sky View Housing Complex in the Sky City, Yeongjong Island in July, 2014; a sink hole at Seokchon Lake near Jamsil Subway Station in Seoul in 2014; the burst of a medium-pressure urban gas pipeline under a road in Gayang-dong, Gangseo-gu, Seoul at 1:38 a.m. December 21, 2017; the land subsidence (sink hole) on a road near an apartment building in Gasan-dong, Geumcheon-gu, Seoul on August 31, 2018; and the collapse of the kindergarten building of Sangdo Elementary School due to a construction project for a multi-household building in Sangdo-dong, Seoul in September 6, 2018.
○ Moreover, the collapse of underground electrical facilities, urban gas pipelines, heat supply facilities and telecommunication systems due to the level 5.8 earthquake that occurred in Gyeongju on September 12, 2016, the level 5.4 earthquake that occurred on November 15, 2017 and other events threatened the safety of people's lives, bodies, etc. and extremely intensified people's fear. Consequently, safety management for underground life-lines has emerged as a national concern.
▶ In Particular, High Possibility of Accidents Caused by Intricately Intertwined Aged Pipelines In Ulsan Metropolitan City
○ In Ulsan Metropolitan City, which can be referred to as the industrial capital of the Republic of Korea, the life-lines buried underground in the Petrochemical Complex and the Onsan National Industrial Complex are as long as 1774.5 kilometers in total: 90.8 kilometers for telecommunications; 572.2 kilometers for gas pipelines; 158.9 kilometers for oil pipelines; 821.1 kilometers for chemical pipelines and other pipelines. The pipelines aged at least 20 to 50 years and intricately intertwined will possibly cause a huge disaster, if an earthquake or any accident occurs.
▶ Formulation of Measures for Improving Legislation by Analyzing Regulatory Systems for Preventive and Follow-up Safegy Management for Facilities Buried Underground for Electricity, Gas, Heat and Telecommunications
○ Land subsidence (sink hole) accidents occurred 3,600 times during the period from 2011 to 2016 in the Republic of Korea. The main cause of such land subsidence accidents is a continuously increasing number of facilities aged at least 20 years, which occupy 67% of facilities for electricity and 64% of utility tunnels, among facilities buried underground for electricity, gas, heat and telecommunications.
○ The land subsidence (sink hole) accidents continuously occurring even in recent tines in the city centers of Seoul, Incheon, Daegu, Daejeon, Pohang, Busan, etc. intensify a feeling of insecurity in people's mind and has increased personal injuries and property damage.
○ The life-lines, consisting of facilities buried underground since long ago for electricity, gas, heat and telecommunications, are essential public facilities with an absolute impact on people's living and national industrial development. Since the stable supply of electricity, gas and thermal energy is also needed for new energy industries for innovative growth and the development of policies for new technology, this study has been performed to formulate measures for improving legislation by analyzing regulatory systems for preventive and follow-up safe management of facilities buried underground for electricity, gas, heat and telecommunications.
Ⅱ. Major Contents
▶ Analysis of Theories on the State's Duty to Protect Safety under the Constitution for Safe Management of Underground Life-Lines
○ The State's duty to protect the safety of energy-related facilities of underground life-lines:
- The State's monopoly of power;
- Theories on, and constitutional ground for, the State's duty to protect safety.
○ Assessment standards for safety management for energy-related facilities of underground life-lines:
- The principle of prohibition of insufficient actions (Untermaßverbot);
- The Legislature's power of legislative formation;
- Primarily, the stipulation of the duty of performance through legislation by the Legislature;
- Secondarily, the realization of the duty of protection by the Executive and the Judiciary (court).
▶ Analysis of Current Legislation on Energy-Related Facilities of Underground Life-Lines
○ Analysis of regulatory systems for the safety of underground life-lines at the stage of excavation of roads, land or an ordinary subsurface area:
- Regulation for the safety of underground life-lines at the stage of excavation of a road: Permission for the occupancy of a road under Article 61 (1) of the Road Act and safety management for the occupancy of a road under Article 62 (1) of the Road Act;
- Regulation for the safety of underground life-lines at the stage of excavation of land: Safety of a building site under Article 40 of the Building Act, measures for an excavated section of land under Article 41 of the said Act, etc. - prevention of hazards, such as collapse of a slope, soil erosion, etc., while performing construction works;
- Regulation for the safety of underground life-lines at the stage of excavation of an ordinary subsurface area: The business owner's measures for safety under Article 23 of the Occupational Safety and Health Act; measures for the safety of underground workers, while performing works or excavation work; prevention of hazards, while excavating ground, etc.; prevention of hazards caused by damage to buried things, etc.; prohibition of the use of excavators, etc.
○ Analysis of regulatory systems for the safety of underground life-lines at the stage of operation and management of facilities for the supply of electricity, gas and heat and telecommunications systems:
- Analysis of ex-ante and ex-post regulatory systems under the Electric Utility Act:
- Analysis of ex-ante and ex-post regulatory systems under 3 major gas-related Acts: the High-Pressure Gas Safety Control Act; the Urban Gas Business Act; and the Safety Control and Business of Liquefied Petroleum Gas Act;
- Analysis of ex-ante and ex-post regulatory systems under the Integrated Energy Supply Act;
- Analysis of ex-ante and ex-post regulatory systems under the Telecommunications Business Act.
○ Analysis of regulatory systems for the safety of underground life-lines for facilities for the supply of electricity, gas and heat and telecommunications systems under Special Acts:
- Analysis of the regulation for the safety of underground life-lines under the Special Act on the Safety Control and Maintenance of Establishments;
- Analysis of the regulation for the safety of underground life-lines under the Special Act on Underground Safety Management;
○ Analysis of problems in the regulatory systems for the safety of life-lines buried underground for facilities for the supply of electricity, gas and heat and telecommunications systems
- Inconsistency of administrative penalties imposed upon the persons who fail to take measures for the safety of people's lives, bodies, etc. at the stage of excavation of a road, land or an ordinary subsurface area;

ㆍ Redundancy of items of self-inspections and regular inspections under the High-Pressure Gas Safety Control Act;
ㆍ Loop holes in regulation on safety where the manner of supply is changed from individual supply of LPG to storage in small tanks;

Meanwhile, the State of Louisiana in the United States has regulated the safety of underground life-lines through statutes on excavation and demolition, emergency excavation, measures for preventing damage, funds, etc.
○ United Kingdom

- Measures proposed to rearrange penalties as schemes to strengthen measures for safety at the stage of underground excavation under the Road Act and the Building Act;
- Measures proposed to improve regulation on safety at the stage of operation and management of facilities for the supply of electricity, gas and heat and telecommunications systems under the Electric Utility Act, the Urban Gas Business Act, the High-Pressure Gas Safety Control Act, the Safety Control and Business of Liquefied Petroleum Gas Act, the Integrated Energy Supply Act and the Telecommunications Business Act.
○ Measures proposed to improve legislation concerning underground life-lines under Special Acts:
- Measures proposed to apply to electrical systems, gas pipelines, heat supply facilities and telecommunications systems buried underground under the Special Act on the Safety Control and Maintenance of Establishments;
- Measures proposed to modify loop holes related to excavation works at a depth of not more than 10 meters under the Special Act on Underground Safety Management put into force on January 1, 2018;
- Measures proposed to collect information about the location of existing underground facilities for the supply of electricity, gas and heat and telecommunications systems;

○ This study will contribute to the establishment of an integrated system for data and statistics about underground facilities for the supply of electricity, gas and heat and telecommunications systems which have been developed without detailed long-term plans.
○ This study can be utilized as a basic document prepared by analyzing problems through an analysis of regulatory systems for safety management for underground life-lines to formulate measures for improving legislation by respective Acts and Special Acts.
○ This study will contribute to stable development of new energy industries and of policies for new technology to attain innovative growth, by proposing measures for improving legislation on life-lines buried underground since long ago as facilities for the supply of electricity, gas and heat and telecommunications systems.
