The objective of this study is to review the possibility of ethical justification on whether the area of human cloning which can be ethically permitted by considering the ethical basis of the human cloning prohibition critically. From the liberalist and utilitarian point of views, the principles of this study are that if the human cloning do not stand against the premise of human dignity, it can be ethically justified and that the demand for using cloning technology should be critically considered in the ethical evaluation of human cloning. The freedom of reproduction, as the fundamental freedom of the human, is the private area that should not be disturbed by other people since the human individual cloning can be used for the childless couple as the complementary reproductive technology to have their hereditary chid. If the freedom of reproduction to use the new technology as a therapeutic method for sterility should be limited, this can be criticized by the certain argument that the cloning may cause harm to another person. However, in case of the human individual cloning, it does not correspond to this major argument called "harm of cloning" since the reproductive cloning of this childless couple does not result in mass production that further cause harm, such as the instrum entalization of the human or the threat to genetic variance. Also, if we accept the fact that the human is the complex creation by the interaction between the human and the environment, the clone produced by the human individual cloning to be exactly the same as the original person can not appear. Therefore, if the genetic identity does not correspond to the individual identity, the cloned person is the same individual who holds the same moral status and then as a result, it is hard to evaluate that it damaged the dignity of th cloned person. Of course, some may argue that the moral status of the cloned person is inevitable to be damaged and actually the human individual cloning may have the possibility to cause the moral damage. However, since we have never experienced the actual human cloning and the creation of the clones, it exists as all of presumptions. Even though we can not deny that it may be possible to cause the moral damage with human individual cloning and argue that the moral status of the cloned person will be violated, it can be hardly insisted that the dignity of the cloned person was violated as considered to be rather not born only with the above reasons. In conclusion, the human individual cloning can be ethically justified in terms of the freedom of reproduction when the childless couple who could not succeed with other available measures use it to have biological children. However, this does not indicate that the human individual cloning should be permitted right now since it is justified in principle. If the result of animal experiments show that the success rate of annual cloning still remains below 3% and the deaths due to severe abnormality and various kinds of diseases continue, the application of this technology to the human can not be morally permitted since it will induce the results of harm to the persons to be born and the women to be pregnant in the future. Therefore, at the present time, the trial of human individual cloning, harming the babies to be born and the women in the state of maternity, is the practice that once again should not be ethically permitted. Besides, the ethical justification of the stem cell research involving human embryos is the critical aspect of the therapeutical cloning. The fact that the stem cell research can be the method to solve the biggest problems, such as the lack of substitute organs or cells, in cell therapy or organ and cell transplant makes it to be considered as a very important research area. This study holds the position that the existence of biological life at the initial stage should not be considered as the existence whose right to live should be protected unconditionally by treating it as the same as the adults. This point of view differ to the fundamentalist point of view, but it corresponds to the historical fact that it gradually extended the range of respecting the human for his personality. Thus, the moderatist position that the embryos are considered as the moral subject since they reached the certain time is taken in this study and 14-day theory - the theory that takes the time to differentiate into the body organs as the fiducial point - was take, to be the fiducial point for the embryonic moral status. The moderatist point of view can step aside from the criticism that using the embryos at the initial stage must be the istrume,talizatio, of the human and it will even further open the way to have significant contribution for the people who suffer the various kinds of diseases. Moreover, if we accept the necessity of embryonic stem cell, the classification of the cloned embryos, the remaining embryos, and the IVF embryos lacks the consistency or coherence.
