본 연구는 디지털 기술 발달에 따른 음악산업의 변화 양상과 국내 음반산업의 실태를 알아보고 이러한 디지털 기술이 국내 음반산업의 제조 및 유통 과정에 끼친 영향과 특히 인터넷을 통한 무료 음악파일 다운로드에 따른 음반제작자의 투자 의욕 저하에 대한 대응방안을 찾아 국내 음악 산업을 활성화 시키는 것에 그 목적이 있다.
이러한 목적 하에 우선 국내 음반시장의 특성과 규모, 디지털 기술 이용에 따른 제작 방식의 변화와 그에 따른 산업 구조, 그리고 유통의 변화 및 새로운 유통 솔루션의 모습에 대해 살펴보면서 이에 따른 문제점으로서 저작권에 대한 문제를 중점적으로 살펴보았다. 특히 국내 저작권 보호에 있어서 한국음악저작권협회(KOMCA)를 중심으로 한 저작자 즉, 작곡·작사가 중심의 보호에 치중한 반면 실연자(가수)와 음반제작자의 권리는 거의 보호를 받지 못하는 실정이 음반시장 자체의 경쟁력을 더욱 약화시킨다는 것을 문제점으로 보고 현재 국내에서 이루어진 각종 세미나와 음반회사 임직원들과의 면담을 통해 이에 대한 적절한 제도적 보완과 음악제작자를 중심으로 한 집중관리제도의 필요성, 음악제작자를 중심으로 한 온라인을 통한 음원판매의 가능성을 제시하였다.

The purpose of this study is to review the changes of the music industry and conditions of the music disc industry in Korea due to development of the digital technology, and thereupon, examine the effects of the digital technology on production and distribution of the domestic music disc industry, and particularly, the phenomenon of disc producers' discouragement due to the free downloading of the music files through Internet, and thereby, find the ways to reinvigorate the domestic music disc industry.
For this purpose, characteristics and scale of the domestic music disc market, changed production methods due to use of the digital technology, changed industrial structure and distribution thereof, and new distribution solutions were discussed, and thereby, the problem involving the copyright was reviewed. In particular, assuming that composers' and writers' copyrights are well protected owing to KOMCA's efforts but that singers' and disc producers' rights are almost not protected to weaken the competitiveness of our disc market, the researcher attempted to survey the conditions of our disc market through participation in various relevant seminars and interviews with disc producers' staff in order to discuss the ways to protect singers' and disc producers' rights, reinforce the concentrated management of their copyrights and distribute the music files on-line.
In Korea, the disc production costs are almost entirely borne by the producers, while composers and writers are rewarded in advance for their efforts. In other words, decrease of music disc sales decrease does not affect their economic interests directly. However, in foreign countries, since music production companies produce the music based on a royalty system, their interests are well protected. In contrast, in Korea, although music disc producers' damage is huge due to digital technology and free on-line distribution, it has not been discussed adequately so far. As a result, many music disc producers give up producing good music discs, leaving the music disc market. In short, the future of our music disc industry is very dark. In order to reinvigorate and establish the domestic music disc industry, music disc producers should be adequately rewarded for their efforts. To this end, this study reviews protection of the digital music files under the current copyright code, necessity of protecting domestic music disc producers' rights and managing the copyrights for on-line distribution in an integrated way, and then, attempts to find a solution model for on-line distribution by solving the problems of security and authentication, while suggesting a proper income-sharing system.
