Today, the importance of Electronic-Commerce through internet in the commercial market is growing up by degrees. As it were, E.C. plays a core part in arriving of digital revolution and digital economy. The technical developments and the creation of new ideas have spreaded the category of the invention which has been protected by the existing system into new area. It is accelerating the controversy on patentability of them. In 1998, CAFC (the Court of Appeals for the Federal Circuit) gave a decision that anything could be regarded as patentable as long as mathematical algorism and business model are useful, concrete and tangible in result on the State Street Bank case. This verdict set off the patent disputes between the patent holders and the people don't hold the rights. The question of patentability is the first matter of concern whether a BM has a chance of getting patent. And the matter of novelty, inventive step and infringement tends to show differences from the case of generally existing patents. In short, there are two key points related to B.M. patent. The one thing is the matter of interpretation about patentability, novelty and inventive step and the other is how to decide whether the infringement problem has happend or not. So I have looked into B.M. in this thesis like followings: First, I checked out the definition, the materials and the characteristics of B.M. patent to set up the concept. And I put the main issues of B.M. patent in order you can see later by chapter. Second, I made clear the issues of patentability by comparing other countries' legislations and cases on the patentability of B.M. (including U.S.'s, E.U.'s and Japan's) with R.O.K.(Republic Of Korea)'s Third, related to judging B.M.'s novelty and inventive step, you can see the general way of judging in R.O.K.'s patent law and the revised patent law reflecting main issues. Last, the applications for B.M. patents have been increased rapidly and the registered B.M. patents have been increased currently in number. Therefore, it is expected there will be increase in infringement disputes as a result the number of B.M.s is on the increase. So I studied the main issues related to the infringement problem B.M. can have and checked out the responding strategy of corporations for those. Compared with developed countries, I can say R.O.K. is a follower in the field of B.M. patent. As a follower, we're supposed to analyze the existing B.M. of the market in advance and prepare for the probable disputes. But we don't have established judgment yet related to B.M. patent. So positive efforts are required to prevent becoming hollow between technique and legal system by reflecting the foreign cases and disputes in the field of internet patent on R.O.K.'s main system and policy.
