This is the outcome of my research on the realities of sexual violence based on the counseling data conducted by "Chongju Counseling Center Against Sexual Violence" for one year from 1999.1 to 1999.12, combined with face to face through interviews with 4 victims of sexual violence. In this research, the personal and social situations of the victims were examined in the procedure dealing with the case of sexual violence to find out the methods to support the victims. From the result of this research on the cases, I tried to make the base the plans and programs for the prevention and cure of sexual violence and for the reform of the legal, institutional and social systems. This research is showing that the realities of sexual violence is not different fom the result of other researches. It is reconfirmed that the majority(96.2%) of the victims are women. Among them, the minors ranging from the infant to the adolescent come up to 56%, which shows the urgent need of gender education for preventing sexual violence at schools. The victims of rape are very reluctant to take legal actions, so there were not many cases to file the complaints. It is because most of them are afraid of the blames and curious eyes from others and there are many difficulties to access the judicial system. It is worth noticing that 83.9% of sexual violence were done by one of the victims' acquaintance. This peculiar high rate tells us that our education could be confusing in teaching children to respect the old and obey to them, and at the same time to be alert to their relatives and neighbors as potential aggressors. Through strenuous research based on the concrete cases, the peculiar characteristics of the damages of sexual violence, its painful effects and the victims' wishes were illuminated, which tells that the patriarchism and the dual standards in sexual problems give double pain to the victims. Especially, the victims who suffered the sexual violence in early age might be harassed repeatedly because of their ignorance and helplessness. Also the flood-tide of the chastity ideology in our society makes the victims more painful in the process after the accident, rather than the sexual violence itself. The victims want their human rights to be protected by the law, implementing the fundamental spirit in which "the special law against sexual violence" was enacted. The sexual violence must be understood in the own terms of the victims. To implement "the special law against sexual violence" effectively, I suggest some points to be reformed as follows. First, in the definition of sexual violence, 'the rights of self-determination on one's own sex' should be incorporated. Second, by abolishing the provisions which requires the victims to file the case, the sexual violence must be treated as the social crime rather than a matter of one's private life. Third, the rights to access the legal information including the procedures and schedule of the court. Fourth, the expert investigators who has professional training should be alloted for the cases of sexual violence. Fifth, The investigators should not give the victims the burden of the evidence to prove the crime of the perpetrators. Sixth, The necessity and procedure of the curing program for perpetrators must be added in the provisions. The most effective and direct method to prevent the sexual violence is sex and gender education centered on humanity and feminism. By establishing the professional counseling center in each region, the total supporting system should be prepared to support the victims whenever they need. Also, the paradigm of our recognition on the sexual violence should be shifted into correct and desirable direction and the human rights of the victims must be fully protected, by which the sexual crime that could destroy the civilization of human being could be reduced.
