The purpose of this study is to analyze how students actualize their positive rights and the right of participation through student council activities, and with these experiences what attitudes students take to their school lives. For this purpose, research questions are follows. 1) How do students actualize their positive rights and the right of participation through student council activities? 2) What factors have an effect on the actualization of students' rights through student council activities? To achieve these objects, this study had an open-ended interview with 7 high school students. Three students leading students councils, two students launching a campaign for the students' participation in the school steering committee, and two general students. The results of this study can be summarized as the following. First, students were infringed in actualizing their positive rights through student council activities. 1) Students' rights to express themselves were restricted extensively. The arbitrary interference and restriction of the style of students' hair and dress was the representative example. And ex-post facto control on expression in cyber spaces was also regarded as the restriction of freedom of expression. 2) The right of assembly through student council was also restricted. Even a signature-collecting campaign, a fundamental right of assembly, was not permitted. But last year students launched the 'nocut campaign' to remove the restriction of hair style and their efforts resulted in the official document of Ministry of Education & Human Resources Development which ordered the schools not to cut students hair arbitrarily. But according to the situation of student councils, the new rules of hair style was made differently. In the schools where student councils have been doing many activities for their rights, students could participate in making new rules. But in many schools, students couldn't express their own opinions in the course of making new rules. Second, the right of participation was limited. Students was not enabled to actualize the right of participation through student council activities. 1) Because students had no right to participate in the school steering committee, everything related to students was established in the exclusion of students' participation. Now students are launching a campaign for the students' participation in the school steering committee. It was found that students gave emphasis on students' perception of their own rights to promote their rights. 2) The right to participate in the disciplinary committee(due process of law) was also limited. When a disciplinary punishment for students was decided, most schools neglected the due process of law and students had to accept the judgement unconditionally. There were many cases of the violation of students' rights in the disciplinary process. But it was found that students weren't concerned about the right to participate in the disciplinary committee and hardly asserted this right. Third, four factors were found to function as negative in actualizing students' rights through student council activities. Teachers' authoritative attitude, schools' expedient attitude, parents' exam-centered attitude, and students' learned helplessness and passive attitude. 1) Teachers regarded students as immature and demanded them to obey their direction. Moreover, the schools looked upon the role of student council as the delivery of their opinions to general students. 2) Because the parents wanted their children to enter the university, they prevented students from doing all kinds of extracurricular activities. 3) As the result of adults' negative attitude toward student council activities, students have been restricted in actualizing their rights through student council. The continuous failure experiences made students passive and helpless in solving their own problems. Fourth, two factors were found to function as positive in actualizing students' rights through student council activities.
