Provisions related to such trademarks first appeared and codified in the Article 6quinquies B. 3. of the Paris Convention of 1983. After several revisions of the related provisions, the Paris Convention established the principle that trademarks consisted of scandalous matter and/or containing immoral expression, especially likely to deceive the public, should not be registered. This thesis would like to shed light on how imitation of other trademarks is legally conducted whereby there are no articles within the trademarks Law restricting the application of imitating other trademarks such as individuals imitating famous foreign trademarks or trademarks that are not domestically well-known without any legal rights. Therefore I would like to demonstrate how this matter could be resolved by applying the provision supported by the Korea Intellectual Property Organization (KIPO) concerning the public order/morality along with the act of deceiving customers of Article 7. clause 1,4 and Article 11 of the Trademarks Law respectively. However, the Supreme Court has not supported such regulations under KIPO. Furthermore, there have been various interpretation and opinion in the Patent Court. Accordingly, n order to regulate such application of trademarks, KIPO has revised the law by amending Article 7, clause 1, 12, but contrary to their initial intention, the provisions of public order/morality of article 7, clause 1,4 is still being regulated. Although there are views that believe such regulations will slove in protecting in both realistic and practical day-to-day business transaction. It is also believed that the provision of public order/morality is being excessively interpreted and discriminated whereby no precise/accurate regulations can be applied, thus, implying that there are more defects to the regulations. It would be reasonable to avoid the excessive interpretation of the provision of order/morality. It would also be more reasonable to apply in accordance with other articles since the provision of deceiving customers also carries excessive interpretation. Even in the case of registration of the trademark by imitating the trademark of the first-user, the individual imitating the trademark will be restricted with the abuse of ones rights under the Unfair Competition Prevention Law by the Supreme Court whereby the first-user rights are protected. This views to be an ideal and favorable implementation. All in all, pre-established regulations concerning Trademark Law should be accurately applied to be application of imitating of other trademark instead regulating and resolving problems by using the provision of public order/morality which is excessively interpreted.
