세계화에 따른 국가 간의 인적, 물적 교류의 확대로 인하여 국내는 물론 국제적으로 항공기에 의한 교류가 증가하고 있으며, 항공기술의 발달로 인하여 항공기의 대형화, 고속화도 빠르게 이루어지고 있다. 이에 따라 항공기를 운항하기 위해 필요한 공항에 대한 수요도 증가하여 기존 공항을 확장하거나 새로운 공항을 건설하고 있다. 항공기 운항과 공항의 증가로 인하여 공항주변지역에서의 항공기소음도 점점 증가하고 이와 동시에 국민들의 생활수준과 권리의식 역시 높아짐에 따라 항공기소음으로 인한 피해가 심각한 환경문제로 부각되었다. 1990년대 이후 공항인근주민들은 항공기소음으로 인한 신체적·재산적 피해와 생활방해에 대하여 그 방지대책과 피해구제를 요구하였다. 그러나 정부는 지금까지 예산부족과 국가안보 등을 이유로 소극적으로 대처해왔다. 따라서 항공기소음에 대한 체계적이고 일관된 정책이 부족하고 소음피해에 대한 보상이나 실태파악도 미미한 실정이다. 체계적인 항공기소음 방지를 위한 규제와 피해구제를 위한 입법이 마련되어야 할 것이다. 다행이도 대법원은 최근 매향리사격장사건과 김포공항사건에서 원고들의 위자료청구를 인정하였다. 소음피해로 고통을 입은 주민들에 대하여 처음으로 법적구제를 하였다는 점에서 의미가 크며, 위 판결은 원고의 입증책임을 가볍게 하여 권리구제를 용이하게 하였다. 본 논문에서는 위 판결을 참고하여 항공기소음에 대한 법적 규제와 피해구제방법으로서 손해배상청구에 대하여 살펴보고자 한다. 소음이란 ‘기계?기구?시설 기타 물체의 사용으로 인하여 발생하는 강한 소리로서 인간의 건강에 악영향을 미치는 것’을 말하며, 항공기의 주행에 따르는 엔진소리, 배기소리, 타이어와 활주로의 마찰음 등을 항공기소음이라고 한다. 우리나라는 별도의 항공기소음 규제를 위한 기본법이 제정되어 있지 않고, 환경정책기본법, 항공법, 소음?진동규제법 등에서 항공기소음을 부분적으로 다루고 있다. 건설교통부장관은 항공기소음에 의한 피해를 방지하기 위하여 공항소음피해지역 또는 공항소음피해예상지역을 지정하여 소음피해방지대책을 수립할 수 있고, 그 지역 안에서의 시설물 설치를 제한할 수 있다. 그러나 군용비행장에 대한 소음피해방지대책을 수립할 법적 근거가 없어 많은 민원이 제기됨에도 불구하고 그에 대한 대책을 세우지 못하고 있으며 군용비행장 주변으로 계속하여 인구가 유입되고 있다. 그리고 항공법은 소음기준적합증명 취득, 저소음운항절차 준수, 소음부담금 납부, 운항시간과 운항코스 규제, 항공기소음피해방지대책위원회 운영 등을 규정하고 있다. 위와 같은 사전적 규제에도 불구하고 부득이 발생한 항공기소음 피해에 대한 구제방법으로는 국가 또는 한국공항공사를 상대로 한 손해배상청구가 가능할 수 있다. 그러나 민법 제750조의 불법행위책임은 과실 입증의 곤란으로 적용이 어려우며, 환경정책기본법 제31조 무과실책임 규정은 그 실체적 효력을 인정할 수는 있으나 항공기소음과 같은 구체적 사안에 적용하기 위해서는 그 요건과 효과에 대한 구체적인 보완이 필요하다. 결국 국가배상법 제5조의 영조물책임에 의한 국가배상청구를 하는 것이 가장 효과적이다. 판례는 영조물의 하자와 관련하여 ‘수인한도론’을 적용하여 종래의 하자개념을 확장하고, 영조물 자체의 통상 갖추어야 할 물리적, 외형적 흠결 이외에 영조물의 이용과 관련하여 제3자에게 사회통념상 참을 수 없을 정도의 위해를 발생시키는 경우도 그 영조물에 하자가 있다고 본다. 항공기소음 피해구제를 위한 공법적 제도가 부족한 상황에서 ‘수인한도론’에 의해 하자의 개념을 확대하여 피해자를 구제하는 것은 타당하다. 항공기소음에 의한 피해가 수인한도를 넘었는지를 판단하기 위해서 소음의 정도와 태양, 피침해이익의 성질, 공법상의 규제, 소음유발시설의 공공성 및 토지이용의 선후관계 등을 고려하여야 한다. 특히 토지이용의 선후관계와 관련하여서 판례는 원칙적으로 ‘위험에의 접근이론’을 인정하면서도 그 적용에 있어서 요건을 까다롭게 함으로써 면책을 사실상 인정하지 아니하고 있다. 그러나 판례와 같은 소극적인 ‘위험에의 접근이론’의 적용은 소음소송의 확대만 초래할 뿐이므로, 법원은 소음피해의 확산을 방지하기 위해 ‘위험에의 접근이론’을 적극적으로 적용하여야 한다. 이상에서 항공기소음 피해를 예방하기 위한 사전적인 법적 규제와 이미 발생한 피해를 사후적으로 구제하기 위한 국가배상청구소송에 대하여 알아보았다. 판례는 공법상 피해보상 관련규정이 없는 상황에서 피해구제의 공백을 하자개념의 확대를 통한 국가배상책임으로 해결하고 있으나 이는 항공기소음피해에 대한 궁극적인 ...

The expansion of human resources and product interchanges generated by globalization increased both domestic and international airtransport while aircraft has become bigger and faster thanks to the development of aviation technology. Proportionally, demands for an airport have increased so that the expansion of the existing airports and construction of a new airport have continuously been taking place. While the noise near an airport has become severe, the public's quality of life and environmental consciousness have also enhanced, which has caused aircraft noise to arise as a serious environmental problem. Since the 1990s, the local people who are living near an airport have claimed compensations for physical malfunctions, diminution in their property value and damages to their livelihood caused by aircraft noise and demanded for prevention measures. The government, however, has taken a passive action, attributing it to budget shortage and national defense. As a result, systemized and consistent policies regarding aircraft noise have not been devised, nor have compensations for or investigations on damages from aircraft noise taken place. The enactment ensuring systemized regulations on aircraft noise and compensation for damages must be prepared. Fortunately, the Korean Supreme Court recently allowed plaintiffs recovery of the damagesincurred to the local people who are living near the Air Force practice site at Maehyang-ri and the Kimpo International Airport. These two cases have a significant importance since they madelegal remedies for aircraft noise available for the first time and made easier for plaintiffs to prove the cause of action. With reference to the above rulings, this thesis is to study on claims for damages as a legal remedy and a compensation method for aircraft noise. 'Noise'is defined as a strong sound caused by the usage of machinery, apparatus, facilities and other objects, which is detrimental to human health. In particular, 'aircraft noise' includes sounds from engine operation and ventilation as well as a frictional sound caused between aircraft tires and a runway, among others. In Korea, there is no separate statute regulating aircraft noise; instead, it is partially dealt with in the Environmental Policy Act, the Civil Aviation Act, and the Noise and Vibration Control Act, etc. In order to prevent any aircraft noise damages, Construction and Transportation Minister is authorized to make counter plans against aircraft noise by designating specified damaged areas or expected damaged areas as well as restricting the construction of facilities within those specified areas. In case of military airports, however, there is no provision which enables the establishment of counter plans against aircraft noise although a lot of civil petitions have been made as population in areas near an airbase keeps increasing. Meanwhile, the Civil Aviation Act has provisions regarding noise certification requirements, compliance with procedures which produce less noise, noise payment, restrictions on flight time and routes, and operation of the Committee for Prevention of Aircraft Noise Damages, etc. In spite of the above prevention measures, if damages from aircraft noise are incurred inevitably, it is possible to claim damages against the governmentor Korea Airports Corporation; however, tort liability in the Art. 750 of the Civil Act is difficult to apply since the existence of negligence is hard to prove. Also, strict liability in the Art. 31 of the Environmental Policy Act ought to be complemented in terms of application requirements and effects, in order to be applied to a specific case such as aircraft noise. Therefore, claiming damages against the government pursuant to the Art. 5 of the National Compensation Act is most effective. The precedent cases show that defects on establishment or maintenance of public facilities could be found when the facilities caused to any person loss to the degree intolerable, not to mention any physical or external defects. Considering the fact that there is a loophole in the legal system which provides legal remedies for victims, it is reasonable to provide remedies to the victims by expanding the concept of the defect. In the meantime, the severity of noise, the nature of damage, legal regulations and the publicity of the noise generating facilities and a sequential relationship in property usage, etc ought to be taken into account. In particular, with regard to the sequential relationship in property usage, precedentcases acknowledge the nuisance theory in principle, but made it difficult to apply by imposing strict requirements. This would give rise to the increase of noise lawsuits. Consequently, the Court ought to apply the nuisance theory more actively in order to prevent the spread of noise damage. So far, regulations for the prevention of noise damage and lawsuit claiming damages against the government as acompensation for the loss incurred have been studied. Although precedent cases have expanded the concept of defect in order to provide legal remedies to victims as there is no relevant provision regarding the compensation for damages in public law at present, this cannot be an ultimate solution for damages caused by aircraft noise. The fundamental solution to this matter is the enactment of regulations which mandate a systemized management of various kinds of aircraft noise as well as a compensation for damages.
