In a multiple risk society, the national responsibility for safety protection can be understood through the responsibility for fundamental rights protection which means to protect fundamental rights from the infringement by the third party, beyond the simple national responsibility of fundamental rights protection and fundamental safety protection such as national defense and public peace. This national responsibility for protection can be applied to a fire, one of fundamental risk factors of domestic society. The responsibility for protection from a fire has been primarily regarded as the responsibility of related persons. However, the damage by a fire cannot but extend not only to the fire-related persons but also to the neighboring people or the whole community. As the fire environment in the modern society is remarkable with such phenomena as complexity, uncertainty, large-scale, deeper underground space and close formation, a fire is not a related persons' issue but the whole society's risk factor. In this vein, it is natural to approach the risk of fire from the aspect of the national responsibility for safety protection. In order to realize the national responsibility for safety protection against the factor of fire risk, the government concretizes the national responsibility of fire safety control through legislation or the manifestation of executive authority and it is presented as the fire safety control system in reality. This fire safety control system is prescribed in a variety of laws which are related to buildings, structures and hazardous substances, such as the Building Act, the Framework Act on Fire Services, the Act on the Installation-Maintenance and Safety Control of Fire Protection System, the Fire Protection System Work Business Act, the Special Act on the Safety Control of Multitude Use Establishments, the Hazardous Substance Safety Control Act, the Safety Control and Business Regulation of Liquefied Petroleum Gas Act, the Urban Gas Business Act, the High-Pressure Gas Safety Control Act and the Special Act on the Safety Control of Public Structures. These laws are operated not independently but complementarily. Therefore, problems in a part should have influence upon all the part, thus exposing serious problems for safety on the whole. Due to the systematic complexity, these fire safety control systems do not present the character of administrative laws. In addition, they are dispersedly prescribed in a variety of laws and cause the collision among systems. In a certain case, agencies are different for the same system and the equity of penal provisions is unreasonable. They contain technical provisions and therefore cause unclear interpretation. Thus, their provisions are insufficient. Although new systems have been introduced, the existing systems are not supplemented with subordinate statutes, thus making the systems incomplete. The aim of this study was to examine the true nature of current fire safety control system and then work out a strategy of settling down legal problems which were related to the fire safety control system. For this, the investigator analyzed the systematic reality of current laws and ordinances on the basis of the meaning and introduction background of fire prevention-related safety control system, among other systems, which was prescribed in the Fire Act. In addition, the investigator clarified the legal nature of safety control system by comparatively analyzing Japanese fire act which was the origin of domestic fire act focusing on the interpretation of systems in the fire act. Thus, the investigator deducted problems and issues which needed supplements and then presented alternatives. In the second chapter, the administrative law-based meaning of modern society's dangerousness and risk factors was arranged and then the contents, constitutional basis and limitation of national responsibility of fire safety control were examined. In the third chapter of fire safety control system, the investigator examined the meaning of fire safety control system and the characteristic and compositional philosophy of the fire administrative act―a substantial law―which realized the fire safety control system as a realization strategy of national responsibility of fire safety control. In addition, the investigator looked into the provisions of individual laws which were the base of fire safety control system. In the fourth chapter of the basic fire safety control system for fire-fighting object, the definition of fire-fighting object, one of the objects of fire safety control system, presented clearly. In addition, the investigator examined fire safety control systems which are applied to citizens, such as the fire prevention order which was issued by the fire chief as the form of command to prevent a fire, the designation of fire precaution zone which intended to guarantee the effectiveness of fire prevention administration for the fire danger zone, and the criteria of management and storage of fire-use facilities and special burnable substances. In the fifth chapter, the investigator looked into the systems which were related to the installation of fire safety system as the most important means of ensuring fire-safety for the fire-fighting object. In other words, the investigator examined the method of applying criteria to the installation of fire protection system, the flame retardant finish, the agreement of construction permission which was to guarantee lawful installation of fire protection system, the safety certification system which was related to the installation of safety facilities in the multitude use establishment, the installation permission for hazardous substance facilities, and the direction and supervising of installation of fire protection system. In the sixth chapter of systemic securing of the fire safety system, the investigator examined such safety maintenance and management measures for the existing fire protection systems as fire inspection, fire management, self-inspection, fire prevention education and training, improvement order, fire risk impact assessment, and the safety control system for hazardous substance facilities In the seventh chapter, the fire safety control system was concluded. The problems of fire safety control system which is prescribed by individual laws can be settled down through the process of legal supplement and detailed examination of it on the basis of the general principles of administrative laws which realize national safety protection. In this vein, studies on the fire prevention administrative law systems which contain the fire safety control system that can optimally satisfy the ideology of national responsibility of fire safety control must be continuously carried out in the future through the activities of administrative laws' general principle-based complement and legislation of various fire safety control systems which are realized in individual laws.
