In the past, housing redevelopment, urban redevelopment, reconstruction and living environment improvement projects were all regulated by the Urban Redevelopment Act, the Housing Construction Promotion Act and the Act on Special Measures for the Living Environment Improvement of Low-Income Urban People. But later, those projects were integrated and reclassified into housing redevelopment, urban environment improvement, housing reconstruction and living environment improvement projects as the Urban & Living Environment Improvement Act was enacted. The implementation of the Urban & Living Environment Improvement Act brought significant changes in the improvement projects as a whole. When identified, the nature of reconstruction and redevelopment projects can provide a theoretical basis on which who will be in charge of accounting, who will be taxpayers, the range of income for taxation and the value of land that is invested in kind are all decided. Here, the taxpayer and the range of income for taxation are finally determined in accordance with the status of the steering committee and the union given by existing tax laws. Currently, there are neither clearing understanding, nor basic regulations about what status the steering committee and the union have in accordance with the tax laws, causing lots of disputes over taxation on reconstruction and redevelopment projects. According to the Basic Law for National Taxes, however, it is reasonable to consider the steering committee as a fictitious corporation and the union as a profit-making corporation. Second, this study investigates all existing taxation systems that are applied to reconstruction and redevelopment projects, identifying problems with tax items under each of the systems and proposing how to solve the problems. In addition, the study examines value-added, corporation and local taxes that are levied on the union of the projects, clarifying problems with the taxation on the union and providing how to solve them. Then, the study examines taxation on members of the union, especially focusing on dividend income and local taxes, except capital gains tax, determining problems with the taxation and proposing how to improve them. However, there are no clear legal provisions of tax requisitions regarding the range of the dividend income which needs taxation and, accordingly who should be taxpayers. This suggests relevant legislative improvements. Third, this study discusses corporate tax levied on the union separately in another chapter, which is the most controversial issue of the taxation systems for reconstruction and redevelopment projects. Currently, there are no established theories or legal regulations about whether contribution by members of the union should be included the income amount of the union and how land or building that is invested in kind by the members are appraised. This is causing confusions in relation to the application of the corporation tax system. To this problem, this study provides some solutions based on case researches. Concerning whether contribution shared by members of the union should be included the income amount of the union, the loss and profit of reconstruction or redevelopment can't belong to those of a non-profit project since the union itself is a profit-making corporation. Out of the contribution by the union members, a part that corresponds to deficiency in total construction cost can be seen as the value of investment in kind by the members. For this reason, it should be included in the income amount of a non-profit project. While, the remaining parts of the contribution should be included in the income amount of a profit-making project. Land or building that are invested in kind by members of the union should be appraised according to the market value of the land or building at the time of the investment. Thus, it's reasonable that investment in kind is actually made at the date of its management disposal permit and the appraisal of the investment is made in accordance with the previous appraised amount of invested land or building or the market value of the amount claimed for the sale of the real estate.
