As a result, child abuse recur which may even jeopardize the lives of the abused children. These problems can be said to be due to lack of intervention from the court system on the administrative processes made for the benefit of the abused children by child abuse facilities and facilities administered by city and provincial offices. Hence, there is a need to systematize, improve professionalism of, and strengthening the child abuse facilities’ organization and their functions and authorities in order position these facilities as social welfare facilities. However, under current child welfare legislation, civilian child abuse facilities must obtain parental consent before intervening during instances of child abuse, and the legislation does not foresee the instances when parents’ and child’s rights conflict; other than the loss of parental rights (torts law 924) in relation to committing child abuse, the torts law does not have concrete methods to deal with other situations. In Korea, it is very rare that parents lose their parental rights due to commission of child abuse. In Korea, the authority to assert government authority that supersedes parental rights in the area of child abuse derives from exemption laws, such as torts law, child welfare law, and domestic violence law. However, limiting parental access for protection of the abused child is being conducted through administrative protections in reality. Further, because of the lack of counseling to prevent recurrence, treatment and compulsory sessions, the instances of recurrence are increasing. The paper proposes ways to discover instances of child abuse in the homes, to enable those with duties to report to report the abuse proactively, and to increase professionalism using “child abuse social welfare worker” system that involve child protection facilities’ counselors. By providing “visit-inspection authority” that will allow one to visit and inspect the homes without the company of police in plain clothes after the child abuse report has been received, we will be able to protect the abused child who has returned to the home from any future abuse. By providing “child abuse social worker” with the authority to file “loss of parental rights” application, the paper hopes that the abused child be separated from the homes immediately and be given appropriate first aid and other post treatment in order to prevent child abuse in our country where it is largely patriarchal.
