This study was designed to identify the causes of condensation occurrence and defect judgment by analyzing judicial precedents and on-site survey results anchored on the investigation of the criteria related to condensation defects.
The results of survey on the criteria found that the case in which the insulation status of walls, windows and doors where condensation occurs does not meet the design and construction standards is deemed as defects by the defect judgment dispute resolution committee of the Ministry of Land, Transport and Maritime Affairs.
In addition, the construction litigation practice committee of the Seoul Central District Court was found to determine the principals of faults when installing windows and doors of unheated space in relation to condensation defects of unheated space.
Results of the analysis on the judicial precedents and on-site survey are as follows.
First, the analysis on the judicial precedents related to walls in the heated space showed that the proportion of contents deemed as defects is 72%. From this figure, defect in design constitutes 61% and that of construction is 11%, while defects from residents’ negligence constitute 28%.
