The “trademark”, inter alia, which exclusively protects signs and marks used for identification of a product, is one of the key elements of today’s business activities. The world market has formed the world trade liberalization by signing bilateral and multilateral free trade agreements (FTA) after GATT, WTO and the recent TPP agreement. And the activation of an online e-commerce and the development of a virtual market place without borders have even radically altered the traditional distribution channels. In this situation, creators and economic players are competitively putting great effort of material and time as well as a tremendous R&D cost to the development and the creation of intellectual property such as trademarks. This phenomenon is now getting more intensified whilst it is being expanded to the national level, as opposed to a personal, corporate level. Then, as a matter of fact, it can be said that any field and any aspect of creation, protection and management for intellectual property including trademarks is incomplete. In particular, the protection and management of intellectual property is often inadequate among economic players as general customers lack awareness about the protection of intangible assets, which is also due to the exclusive and dominant economic management of some large enterprises. This study is for the remedies of trademark infringement. Analysis has revealed that the domestic trademarks law is still inadequate in terms of its execution while it has come to reflect the changed environment and has gone through improvements for the implementation of international standards. Now, the protection of intellectual property such as trademarks is becoming even more important in countries with high trade dependence like Korea as it ensures human dignity and enhances the competitiveness of enterprises by inspiring individuals’ creative will. It helps avoiding trade conflicts with other countries and protecting an individual’s interest as well. In most countries, a trademark can be semi-permanently exercised as a property right by updating it every 10 years once it is authorized by a government. It is a well-known fact that a trademark is a core asset for business activities, so the key to the success of companies turns on the effective management and efficient operation of it as well as the security of a competitive trademark, the active response on violations and disputes. In this study, the protection of trademark rights – that is, the protection systems and remedies for infringement in the civil and criminal laws - which is an economically sensitive issue to both owners and consumers accounting for a large proportion and influence and has close connections with business activities of companies, is investigated from a business perspective. A trademark holder must be backed with the institutional remedies to take appropriate measures against infringement. The purpose of this study is to offer companies and trademark holders practical guidance when trademark infringement or other relevant disputes occur, and help them improve their competitiveness by suggesting substantial methods of using remedies more promptly and effectively through the consideration of civil remedies including the prohibition of trademark infringement, compensation for damage, statutory damage, credit recovery claim or action of injustice profits return, and criminal remedies including infringement, perjury, false expression, fraud or confiscation. For this purpose, the study consists of six chapters; Chapter 1 suggests the significance and methods of this study. Chapter 2 covers the basic matters such as the nature and history of trademarks and trademark rights. And chapter 3 reviews the status of infringement and a total of 75 precedents relating to domestic trademark infringement while looking into the concept and type of trademark infringement. Chapter 4 is for the development process of civil and criminal remedies provided in the domestic trademark law and the institutions with respect to the current law.
