The purpose of this study is to investigate the effects on recidivism domains of sexual offenders based on studies on sexual offenders. The study applies significance and types of restorative justice to explore policy measures that could prevent recidivism by sexual offenders. Within the process of the study, sexual offense behavioral factors of sexual offenders, psychosocial dysfunction of victims, a factor of restorative justice, and as alternatives, concepts of restorative justice are proposed to investigate the necessary conditions that can be applied realistically to apply sexual violence crimes currently excluded from perpetrator-victim mediation models. To achieve such objectives, this study investigated the general characteristics and nine types of pre-post evaluations on 22 subjects currently incarcerated for sex crimes during the duration of sexual violence perpetrator rehabilitation;treatment programs from 2011 until 2012 within Y counseling center and U penitentiary. The results of the study are as follows. First, results of literature review show that programs based on sexual violence perpetrator rehabilitation;treatment program manuals centered on a cognitive-behavioral treatment model from the Ministry of Gender Equality & Family exhibit significant findings for efficacy of empathy ability and rape myths. However, the fact that various tools are used to verify the efficacy of sexual offender programs and that change is needed is fundamentally not a problem behavior but based on an individual…s conviction not to commit the offense again. In this way, limitations are discovered in unconscious areas of behavioral processes. Second, the general characteristics of participants within the pilot study were aged 30s and 40s, none were unmarried or divorced and a high frequency of participants did not fall into the many of the proposed occupational categories. Such findings suggest influence of psychopathological factors of abnormal sexual behavior. Regarding criminal experience, ratio of first time offenders was significantly higher than repeat criminals. Among repeat offenders, high rate of participants with similar;different criminal histories during adolescent years highlight the importance of early rehabilitation. In terms of the relationship with problematic behaviors among acceptance of criminal responsibility, participants refusing to accept responsibility showed a significantly higher level of problematic behaviors. Third, results of pre-post change analysis within the pilot study showed no significant change within cognitive change assessment tools (depression, anger level, self-esteem, impulsiveness). On the other hand, behavioral change assessment tools (rape myths, sympathy, sexual response, sexual impulse treatment, general equality) showed significant changes in four types of assessment tools with the exception of sexual impulse treatment. Based on the above results, this study carries the following implications. First, for change in perception of sexual offenders, the rights of human beings is the result of sociological training of behaviors that enables individuals to receive rights from others. Consequently, they must been recognized as victims of lacking health modeling. To become healthy members of society and grow within a relationship of mutual trust with others, a fundamental safety network is required. Second, rather than social isolation systems that highlight the dangers of sexual offenders, a body which oversees management of sexual offenders and a regional society management system must be developed to pursue the interests of sexual offenders. Current retribution based jurisdiction prevents social offenders from rehabilitating properly back into society, which leads to increased dangers of repeat crimes. In turn, likeliness of repeat crimes can be expected to decrease when sexual offenders are restored to society based on the belief that they can change based on concepts of a regional society protection system. Third, selection tools of participants must be developed in order to introduce restorative justice programs. Participants of literature review and the pilot study are participating in mandatory training based on subjective judgements of affiliated organizations, a process shown to result in low levels of significant change in terms of program efficacy. Consequently, voluntary participation and consent by victims must be prioritized for restorative justice while basic consciousness for the importance of social integration must be prioritized. Fourth, within our country…s social and cultural environment, adolescent sexual crimes exhibit similarities with adult sexual crimes. However, adolescent sexual offenders are different in the values and results that are pursued. Consequently, programs for adolescent sexual offenders must be included in child;adolescent sex protection laws through early preventative intervention for adolescent sexual offenders. Such measures to utilize restorative justice is proposed in notice systems of juvenile acts. Such must not be limited to protecting victims of sexual violence, but also to protect and educate adolescent sexual offenders based on participation by victim-perpetrator-regional society, which in turn could contribute to positive effects in repeat crimes and to strengthen restorative justice. In conclusion, with regards to the pilot study and possibilities to apply restorative justice, unless socially accepted ideas and perception of sex within the various perpetrating factors of sexual offenders are changed, punishing sex crime offenders will have minimal effect on sex crimes in general.
